Patent Prosecution Highway: Requirements, Filing, and Track One

The Patent Prosecution Highway (PPH) is a free work-sharing program that lets you fast-track a U.S. patent application by relying on a favorable ruling you already received from a partner patent office in another country. Instead of waiting in the standard queue, your application jumps to the front of an examiner’s line. PPH applications at the USPTO currently reach a first office action in roughly 93 to 99 days after the petition is granted, compared to an average of over 22 months for standard filings, and there is no fee to file the petition.

How the Highway Actually Works

PPH is an agreement among patent offices to reuse each other’s search and examination work. When one office (the Office of Earlier Examination, or OEE) finds at least one claim in your application patentable, a second office (the Office of Later Examination, or OLE) will accelerate its review of a corresponding application covering the same invention.1United States Patent and Trademark Office. Global PPH FAQs2European Patent Office. What Is an Office of Earlier Examination (OEE)?

The OLE still performs a fully independent review under its own laws and against its own prior art. PPH is a queue-jumping mechanism, not a rubber stamp. What the program guarantees is speed; allowance still depends on the examiner’s own judgment.

Do You Qualify?

Three conditions have to be met before you can file a PPH request at the USPTO.1United States Patent and Trademark Office. Global PPH FAQs

  • The partner office must have issued a ruling indicating that at least one claim in your corresponding application is patentable or allowable. That can be a notice of allowance, a positive office action, or favorable PCT work product such as a written opinion or an international preliminary report on patentability.
  • Your USPTO application and the application with the favorable ruling must share the same earliest priority date. The USPTO application can be a direct counterpart, a continuation, or a national-stage entry of the same invention.
  • You must submit the PPH request before the USPTO has begun substantive examination. Once a first office action on the merits is mailed, the window closes.

All claims in your USPTO application must also sufficiently correspond to the claims the OEE found patentable. You cannot use PPH to slip in broader claims that go beyond what the first office approved. If your desired claims differ, amend them to fit before filing the PPH request.

Which Offices You Can Use

Most applicants file through the Global PPH, launched in January 2014, which replaced dozens of separate bilateral arrangements with a single standardized program covering three PPH types (standard, Mottainai, and PCT-PPH) between any two participating offices. The IP5 PPH is a parallel pilot among the five largest patent offices: the USPTO, the European Patent Office, the Japan Patent Office, the Korean Intellectual Property Office, and the China National Intellectual Property Administration. At the USPTO, the filing requirements and forms for IP5 PPH are the same as for Global PPH.

The USPTO’s Global and IP5 PPH partners include Australia, Austria, Brazil, Canada, Chile, China, Colombia, Denmark, Estonia, Finland, Germany, Hungary, Iceland, Israel, Japan, Korea, New Zealand, Norway, Peru, Poland, Portugal, Singapore, Spain, Sweden, the United Kingdom, the European Patent Office, the Nordic Patent Institute, and the Visegrad Patent Institute. Separate bilateral PPH agreements cover offices not yet in the Global PPH, including those in Bahrain, the Czech Republic, France, Malaysia, Mexico, Morocco, Nicaragua, the Philippines, Romania, Saudi Arabia, and Taiwan.3United States Patent and Trademark Office. If you have no national-phase decision yet from any participating office but do have a positive written opinion or international preliminary report on patentability from your PCT filing, the PCT-PPH pathway lets you use that international work product as the basis for your request.3United States Patent and Trademark Office. What To File

The petition is built around a standardized form and supporting documents. For Global PPH and IP5 PPH requests, the USPTO uses form SB/20GLBL. Bilateral PPH agreements each have their own country-specific form (SB/20FR for France, SB/20MX for Mexico, and so on).3United States Patent and Trademark Office. Patent Prosecution Highway – Fast Track Examination of Applications The form asks for the OEE application number, identifies the allowable claims, and includes a claims correspondence table mapping each claim in your USPTO application to a claim found patentable at the OEE.

You also need to include copies of the office actions or work products from the OEE containing the favorable determination. If the OEE examiner cited prior art references during prosecution, include those as well. If any OEE documents are in a language other than English, provide a translation. A machine translation is acceptable, but if the USPTO finds the quality too poor to understand, it may ask for a manual translation. That manual translation does not need to be certified.1United States Patent and Trademark Office. Global PPH FAQs

How To File the Request

PPH petitions must be filed electronically through the USPTO’s Patent Electronic System and indexed under one of two document descriptions: “Petition to make special under Patent Pros Hwy” or “Petition to make special under PCT-Patent Pros Hwy.”4United States Patent and Trademark Office. Patent Prosecution Highway There is no fee.3United States Patent and Trademark Office. Patent Prosecution Highway – Fast Track Examination of Applications

Timing is the most common filing mistake. File before the USPTO mails any office action on the merits. If a first action arrives first, that application is no longer PPH-eligible.

National-stage applicants have an additional trap to watch for. If your application entered the U.S. under 35 U.S.C. 371, you also need to expressly request that national-stage processing begin under 35 U.S.C. 371(f). Without that express request, the USPTO will not start processing until 30 months from your earliest priority date, even if the PPH petition is granted, which effectively cancels the speed benefit.3United States Patent and Trademark Office. What Happens After You File

The USPTO first checks whether your petition is complete and meets the requirements. Recent data puts the average time from petition to decision at roughly 26 to 28 days.5United States Patent and Trademark Office. CY 2024 PPH Statistics Data If approved, your application receives “special” status and moves to the front of an examiner’s queue. Special status stays with the application through its entire prosecution at the USPTO, not just through the first action.6United States Patent and Trademark Office. Manual of Patent Examining Procedure Section 708

As of January 1, 2026, the USPTO’s internal target for a first office action after a granted PPH request has been revised from three months to six months, reflecting growing demand on the program.3United States Patent and Trademark Office. Patent Prosecution Highway – Fast Track Examination of Applications Even at six months, that is a dramatic improvement over the standard 22-plus-month wait.

Dismissal Is Fixable. Denial Is Not.

This distinction matters because the consequences are very different.

A dismissal means the petition had correctable problems, such as missing documents, an incomplete claims correspondence table, or a translation issue. You get one chance to fix the deficiencies within one month of the dismissal notice. No extensions are permitted. Fix everything in time and the request is reconsidered. Miss the deadline and your application drops back into the standard examination queue.7United States Patent and Trademark Office. General PPH Filing a PPH Request

A denial is final. If the USPTO denies your PPH request, typically because the eligibility requirements were not met, you cannot file a new or renewed PPH request in the same application. Your only option is to file a continuing application and try again there.7United States Patent and Trademark Office. General PPH Filing a PPH Request A denial does not kill the patent application itself; it just proceeds through normal prosecution.

What You Actually Get Out of It

According to the USPTO’s most recent annual statistics, PPH applications based on work products from larger participating offices had a grant rate of about 57 percent and a first-action allowance rate of roughly 33 percent. Applications based on work products from smaller offices had a grant rate closer to 44 percent.5United States Patent and Trademark Office. CY 2024 PPH Statistics Data The first-action allowance numbers are significantly higher than the standard prosecution average, which makes sense: you are presenting claims another examiner already vetted.

CY 2024 PPH Statistics Data For applicants racing to secure patent rights before a product launch or a licensing negotiation, that speed advantage alone justifies the paperwork.

PPH vs. Track One Prioritized Examination

The USPTO offers another acceleration option called Track One prioritized examination. The key differences come down to cost, prerequisites, and claim scope.

  • PPH is free. Track One requires a prioritized examination fee that, for a large entity, runs over $2,000, with reduced fees for small and micro entities.
  • PPH requires favorable results from a foreign patent office or PCT authority. Track One does not; you can file it with a brand-new application that has no foreign counterpart.
  • PPH requires your claims to correspond to those found allowable abroad, which constrains what you can claim. Track One imposes no such limitation on claim scope, though it caps applications at four independent claims and 30 total claims.

If you already have a favorable foreign ruling and your claims align with it, PPH is the obvious first choice: same speed benefit, no fee. Track One makes more sense when you have no foreign filing history or when you need broader claims than a foreign office approved. Some practitioners file PPH first, and if the claims need to diverge substantially, pivot to Track One in a continuation.
