Passport Name Discrepancies: Forms, Documents, and Fees

A passport name discrepancy only needs correcting when the name printed on the data page is actually wrong or no longer matches your legal name. The State Department accepts a fair amount of variation from your birth certificate or driver’s license without treating it as an error, so before you pay a fee or send in your passport, it’s worth knowing which differences matter and which don’t. When a correction is genuinely needed, the right form depends on when your passport was issued and when the name change happened.

Variations the State Department Already Accepts

Federal regulations give passport adjudicators broad discretion to accept minor name variations.1eCFR. 22 CFR 51.25 – Name of Applicant to Be Used in Passport A middle initial in place of a full middle name is fine. Dropping middle names entirely is fine. Suffixes get even more latitude. You can add or drop Jr., Sr., II, or III based on preference, whether or not the suffix appears on your citizenship evidence. Hyphenated surnames follow your stated preference. The passport prints the hyphen without extra spaces, and you can request adding or removing one based on how you actually use your name. When You Actually Need to Fix Your Passport

Two situations call for action. The first is a printing or data error: a misspelled first or last name, a wrong middle name, a name that doesn’t match what you wrote on your application. The second is a legal name change since your passport was issued, most commonly through marriage, divorce, or a court order.

Both of those are handled by filing a new application. Which form you use, and what it costs, depends on the timing.

Choosing the Right Form

Form DS-5504 for Recent Passports and Recent Changes

DS-5504 is the fastest and cheapest path, but it has narrow eligibility. It applies when your passport was issued less than one year ago and your name change also happened less than one year after that passport was issued.3U.S. Department of State. A marriage two years after passport issuance doesn’t qualify even if the passport itself is still under a year old.

DS-5504 also covers data corrections, like a name the State Department printed wrong, regardless of when the passport was issued. You submit it by mail with your current passport, the documentation of your name change or the error, and a color photo. Form DS-82 for Renewal by Mail

If your most recent passport was issued when you were 16 or older, is undamaged, hasn’t been reported lost or stolen, and was issued within the last 15 years, you can renew by mail with DS-82 and update your name in the process.5U.S. Department of State. One catch: the State Department’s online renewal system explicitly does not accept name changes. Online renewal also requires you to be 25 or older and not traveling for at least six weeks.7U.S. Department of State. Form DS-11 for In-Person Application

You must apply in person with DS-11 if your current passport was issued before you turned 16, was issued more than 15 years ago, is damaged, or has been lost or stolen.8U.S. Department of State. Documents That Prove the Name Change

Whichever form you file, the State Department needs original or certified legal documents showing that a government body or court authorized the change. The usual documents are a certified marriage certificate, a divorce decree that specifically restores a former name, or a court order granting a name change. Ordering a certified copy from your county or state vital records office generally costs between $6 and $35 depending on where you live, and some offices take weeks to process mail requests. Factor that into your timeline.

If your name changed informally, without marriage or a court order, you’ll need Form DS-60 (Affidavit Regarding a Change of Name). DS-60 requires three or more original or certified public documents showing you’ve used the new name exclusively for at least five years. If you can’t produce a third document, two affidavits from people who know you by both names can substitute for one. The affiant should ideally be a blood relative and must include a photocopy of their own ID.9U.S. Department of State. Fees and Processing Times

You can also pay $22.05 for 1-to-3-day return delivery of the completed passport.10U.S. Department of State. United States Passport Fees for Acceptance Facilities

Routine processing currently runs four to six weeks. Expedited runs two to three weeks.11U.S. Department of State. Processing Times for U.S. Passports Those windows cover only the time your file sits at a passport agency. Mail transit adds up to two weeks in each direction. You’ll send in your current passport with the application, so you’ll be without it for the entire process. Original supporting documents come back to you separately after the new passport is issued. If You’re Traveling Soon

Routine and even expedited mail service may not be fast enough if you catch a discrepancy close to your departure date. Regional passport agencies book in-person appointments for people traveling internationally within two to three weeks. If you haven’t yet applied, book the appointment online. If you’ve already sent in an application and want to speed it up, call 1-877-487-2778. Walk-ins are not accepted, and appointments aren’t guaranteed, so don’t push it to the final day.

A separate life-or-death emergency service is available for travelers who must go abroad within two weeks because an immediate family member outside the U.S. is dying, critically ill, or has died. Documentation like a hospital letter or death certificate and proof of imminent travel is required. The State Department defines immediate family narrowly: parents, children, spouses, siblings, and grandparents. Aunts, uncles, and cousins don’t qualify.13U.S. Department of State. Records That Won’t Update on Their Own

A corrected passport doesn’t ripple through the rest of your identity documents. Social Security card, driver’s license, and voter registration each need separate updates. Many people update Social Security first because some state DMVs verify names against SSA records before issuing a new license.

Trusted Traveler Program memberships are the other common blind spot. A mismatch between your Global Entry, TSA PreCheck, NEXUS, or SENTRI profile and your new passport will suspend your expedited screening until the records match. If you hold valid foreign visas in your old passport, don’t assume they carry over. Many countries let you travel with both books, the old one holding the visa and the new one carrying your current name, but policies vary. Some consulates recommend or require a fresh visa in your current name. Check directly with each country you plan to visit, and carry the marriage certificate or court order with you when traveling on mismatched documents.
