OSHA’s hand and power tool regulations, set out in 29 CFR 1910 Subpart P, require every employer to keep tools on its worksite in safe working condition and to protect workers from the hazards those tools create.1eCFR. 29 CFR Part 1910 Subpart P – Hand and Portable Powered Tools and Other Hand-Held Equipment The rules apply whether the company furnishes the tool or the employee brings it from home, and they cover everything from chisels and wrenches to circular saws, grinders, powder-actuated fasteners, and mechanical jacks. Serious violations can cost up to $16,550 each, and willful or repeated ones up to $165,514.
Who Is Responsible, and For Which Tools
The employer is responsible for the safe condition of every tool used on the worksite.2Occupational Safety and Health Administration. 1910.242 – Hand and Portable Powered Tools and Equipment, General That obligation does not shift because a worker supplied the tool. If it is used on the job, the employer is on the hook for its condition.
Any tool that is not in proper working order must be pulled from service immediately. Common warning signs include chisels or punches with mushroomed striking heads, wrenches with sprung jaws, and wooden handles that are split or splintered. Tools must be used only for their intended purpose, with the manufacturer’s guards, shields, and attachments in place during operation. A defective tool cannot go back into use until it has been repaired to the manufacturer’s specifications.
Guards, Switches, and Shock Protection on Portable Power Tools
Portable power tools get the most detailed treatment in Subpart P because they combine speed, sharp edges, and stored electrical or pneumatic energy. Three areas drive most citations: physical guarding, switch controls, and electrical protection.
Circular Saw Guards
Any hand-held circular saw with a blade over two inches must have guards above and below the base plate. The upper guard covers the blade to the depth of the teeth, except for the arc needed to tilt the base for bevel cuts. The lower guard also covers the blade to the depth of the teeth and must snap back to its covering position automatically and instantly when the saw is pulled away from the work.3Occupational Safety and Health Administration. 1910.243 – Guarding of Portable Powered Tools Pinning or tying back the lower guard defeats the protection and is a clear violation.
Switch Requirements by Tool Type
OSHA divides portable power tools into three groups based on the danger of accidental activation and assigns switch requirements accordingly.3Occupational Safety and Health Administration. 1910.243 – Guarding of Portable Powered Tools
- Hand-held circular saws with blades over two inches, chain saws of any power type, and percussion tools without positive accessory holding must have a constant-pressure switch that shuts the tool off the moment the trigger is released. A lock-on is not permitted.
- Drills, tappers, fastener drivers, grinders and disc sanders with wheels over two inches, belt sanders, reciprocating saws, and jig saws with blade shanks greater than one-quarter inch must have a constant-pressure switch, and may have a lock-on only if it can be released with a single motion of the same finger that engaged it.
- Platen sanders, small grinders and disc sanders (two inches or less), routers, planers, laminate trimmers, nibblers, shears, and jig saws with narrow blade shanks may use a positive on-off switch.
Grounding and Double Insulation
Portable electric tools must either be grounded through a three-wire cord and plug or be approved double-insulated tools, which are marked with a square-inside-a-square symbol on the nameplate.3Occupational Safety and Health Administration. 1910.243 – Guarding of Portable Powered Tools Removing the ground prong from a three-wire plug to fit a two-prong outlet is one of the most common shortcuts on the job and one of the most dangerous.
Pneumatic Tool Retainers
Any pneumatic tool that could eject an attachment during operation must have a retainer installed to prevent it.3Occupational Safety and Health Administration. 1910.243 – Guarding of Portable Powered Tools On an impact wrench or chisel hammer, a loose socket or bit becomes a projectile at high speed. Clips, locks, or other retainers keep the accessory seated.
Abrasive Wheel Machinery
Bench grinders, pedestal grinders, and portable grinding wheels spin brittle wheels at thousands of RPM. A wheel that shatters throws fragments with enough force to kill, and Subpart P builds most of its abrasive-wheel rules around preventing that failure.
Guards and Tongue Guards
Every abrasive wheel must be used on a machine fitted with a safety guard strong enough to contain fragments if the wheel breaks.4Occupational Safety and Health Administration. 1910.215 – Abrasive Wheel Machinery On portable vertical (right-angle) grinders, the maximum exposure angle is 180 degrees, with the guard positioned between the operator and the wheel.3Occupational Safety and Health Administration. 1910.243 – Guarding of Portable Powered Tools On bench and pedestal grinders, an adjustable tongue guard at the top of the safety guard must stay within one-quarter inch of the wheel surface. As the wheel wears, that gap has to be reset.
Work Rest Adjustment
On offhand grinders, where the operator holds the workpiece against the wheel, the gap between the work rest and the wheel can be no more than one-eighth of an inch.4Occupational Safety and Health Administration. 1910.215 – Abrasive Wheel Machinery A wider gap lets the work jam between rest and wheel and shatter the wheel instantly. The adjustment must be made with the wheel stopped, and the rest clamped securely afterward.
Ring Test and Speed Check Before Mounting
Every wheel must be inspected and tested immediately before mounting. Tap the wheel gently with a light nonmetallic object such as a wooden mallet handle. A sound wheel rings clearly; a cracked wheel produces a dull, dead sound and must be discarded on the spot. Then confirm that the machine’s spindle speed does not exceed the maximum operating speed marked on the wheel by the manufacturer. Compressed Air, Fuel-Powered, and Powder-Actuated Tools
Compressed air used for cleaning must be reduced to less than 30 psi, and even at that reduced pressure, workers need effective chip guarding along with personal protective equipment.2Occupational Safety and Health Administration. 1910.242 – Hand and Portable Powered Tools and Equipment, General This is one of the most frequently cited tool-related violations, probably because the hazard looks harmless.
Fuel-powered tools carry fire and fume risks. Employers must ensure safe refueling procedures and adequate ventilation whenever these tools run in enclosed or confined spaces.
Powder-actuated tools use an explosive charge to drive fasteners into concrete, steel, or masonry, and OSHA treats them more like firearms than power tools. Before every use, the operator must confirm that the tool is clean, that moving parts operate freely, and that the barrel is unobstructed.3Occupational Safety and Health Administration. 1910.243 – Guarding of Portable Powered Tools The loads must be manufactured for the specific tool and identifiable by power level. No load is permitted if it would drive a fastener at a mean velocity greater than 300 feet per second measured 6.5 feet from the muzzle. Operators must be trained and certified before using the tool.
Mechanical Jacks
Every mechanical jack must be legibly and permanently marked with its rated load capacity, and the operator must confirm the rating is sufficient for the load before use.5Occupational Safety and Health Administration. 1910.244 – Other Portable Tools and Equipment Inspection frequency depends on use:
- A jack in regular use at a fixed location must be inspected at least every six months.
- A jack sent off-site for special work must be inspected when it goes out and again when it comes back.
- Any jack subjected to abnormal load or shock must be inspected immediately before and immediately after the event.
All jacks must be lubricated at regular intervals, and any replacement parts must be checked for defects before installation.5Occupational Safety and Health Administration. 1910.244 – Other Portable Tools and Equipment
PPE the Employer Must Provide and Pay For
Employers must ensure that every employee exposed to eye or face hazards from flying particles, molten metal, chemical splashes, or injurious light uses appropriate protection, and where flying objects are a hazard, that protection must include side shields.6Occupational Safety and Health Administration. 1910.133 – Eye and Face Protection Almost every tool operation produces flying particles, so safety glasses with side protection are effectively standard gear.
Required PPE has to be provided at no cost to the employee. The narrow exceptions are non-specialty safety-toe footwear and non-specialty prescription safety eyewear, and only when the employer allows the worker to wear those items off the job.7Occupational Safety and Health Administration. 1910.132 – General Requirements Face shields, cut-resistant gloves, hearing protection, and specialty footwear come out of the employer’s budget.
Before any task requiring PPE, the employer must train the worker on when PPE is necessary, what specific equipment is required, how to put it on and adjust it, its limitations, and how to care for and maintain it.7Occupational Safety and Health Administration. 1910.132 – General Requirements The worker must then demonstrate understanding before starting the task. Workplace changes or gaps in knowledge trigger retraining.
Noise and Hearing Protection
Grinders, impact wrenches, circular saws, and pneumatic hammers routinely push past safe noise levels. OSHA sets the permissible exposure limit at 90 dBA over an eight-hour shift, with an action level of 85 dBA that triggers a hearing conservation program.8Occupational Safety and Health Administration. 1910.95 – Occupational Noise Exposure Once time-weighted exposure reaches 85 dBA, employers must provide hearing protectors at no cost and run a continuing program that includes audiometric testing. If engineering or administrative controls cannot bring exposure below 90 dBA, hearing protection use becomes mandatory rather than voluntary. A single angle grinder can easily exceed 100 dBA, so shops running these tools all day almost always need a formal program.
Penalties for Tool Safety Violations
OSHA classifies citations by severity and by what the employer knew.
- A serious violation is issued when a workplace condition could probably cause death or serious physical harm (amputations, fractures, severe burns, hearing loss) and the employer knew or should have known about it. The 2025 maximum penalty is $16,550 per violation.
- A willful violation is issued when the employer intentionally disregarded an OSHA requirement or showed plain indifference to worker safety. The maximum penalty is $165,514 per violation.
- A repeated violation is issued when the employer already received a final citation for the same or a substantially similar hazard within the previous five years. The maximum matches willful violations at $165,514.
These 2025 figures typically increase slightly each year with inflation.9U.S. Department of Labor. A missing guard on one grinder is one citation; missing guards on ten grinders can be ten.
