On post-completion OPT, you get 90 days of unemployment across the whole authorization period. If you receive the 24-month STEM OPT extension, that budget rises to 150 days total across both periods combined. Every calendar day without a qualifying job reported in SEVIS counts against your OPT unemployment days, and going over the limit means losing F-1 status with no grace period to stay in the country.
The 90-Day and 150-Day Limits
Federal regulations tie your F-1 status during post-completion OPT directly to employment. Two numbers govern the entire system:
- Standard post-completion OPT: no more than 90 days of unemployment across the full authorization period.
- STEM OPT extension: 150 days total across the initial OPT and the 24-month extension combined.
The 150-day figure is not 90 plus a separate 60. It is a single running total. When the Clock Starts and What Counts
Your unemployment counter starts on the OPT start date printed on your Employment Authorization Document, not on your graduation date or the day the card arrives in the mail.3Study in the States. Unemployment Counter If your EAD start date arrives and you have no job, the clock is already running.
SEVIS counts every day without employer information on file toward your unemployment total.4U.S. Citizenship and Immigration Services. Once you do have an employer in the system, the picture changes. Days when your employer is closed for weekends, holidays, or scheduled breaks do not count as unemployment, because you are still employed. Approved vacation or leave works the same way, as long as your employer treats you as an active employee.5Study in the States. Leaving the country does not pause the clock. If you travel abroad while unemployed, those days still accumulate. SEVIS has no way to distinguish between sitting at home without a job and sitting in another country without a job. It simply counts calendar days without employer data.
Employment That Stops the Clock
To stop the counter, you need qualifying employment of at least 20 hours per week that is directly related to your major.6U.S. Citizenship and Immigration Services. Optional Practical Training (OPT) for F-1 Students What qualifies depends on which phase you are in.
Standard Post-Completion OPT
On regular OPT, the range of qualifying arrangements is fairly broad. You can work as a traditional paid employee, an unpaid intern, or a volunteer, as long as the position does not violate labor laws and relates to your degree.7U.S. Citizenship and Immigration Services. You can start a business or take on freelance contract work, and you should keep documentation of your business licenses, contracts, and active engagement in the field. Multiple part-time jobs can be combined to meet the 20-hour minimum.
STEM OPT Extension
The STEM extension is significantly more restrictive. Unpaid and volunteer positions do not qualify. USCIS has stated explicitly that an F-1 student on the STEM extension may not work for the employer on a volunteer basis.7U.S. Citizenship and Immigration Services. Reporting a Job So the Clock Actually Stops
When you land a job, updating your records promptly is the only thing that stops the counter. You can report employment yourself through the SEVP Portal, or you can provide the information to your DSO for entry into SEVIS.9Study in the States. OPT Student Reporting Requirements Do not wait. Every day between starting work and getting that employer into the system is a day SEVIS may still count against you.
Reporting an employer requires the employer’s name and work address, your job title, whether you work full-time or part-time, your start date, and how the job relates to your degree. STEM OPT students face additional fields: the employer’s EIN and the supervisor’s name, phone number, and email.10Study in the States. STEM OPT students must report changes in employment, address, or legal name within 10 days.11Study in the States. Students STEM OPT Reporting Requirements The same 10-day deadline applies to reporting a job loss. If the gap between employers stretches past 10 days, report the loss first and submit a new Form I-983 once you start the next position.
What Happens If You Exceed the Limit
Going over your unemployment limit means you have failed to maintain F-1 status. DHS can terminate your SEVIS record. You lose the right to work immediately, and unlike students who complete their OPT period cleanly, you do not receive a 60-day grace period to prepare for departure or apply for a change of status. The regulation is blunt: a student who “otherwise fails to maintain status is not eligible for an additional period for departure.”1eCFR. 8 CFR 214.2 – Special Requirements for Admission, Extension, and Maintenance of Status
A terminated SEVIS record creates a lasting paper trail. Future applications for work visas, green cards, or even tourist visas may require you to disclose and explain the status violation. Consular officers and border agents can see the termination in the system, and it tends to raise questions during interviews for years afterward.
Options After a SEVIS Termination
If your record is terminated, you still have some paths forward, though none are quick or guaranteed.
- Reinstatement through USCIS. You generally must show that circumstances beyond your control caused the violation, that you have not worked without authorization, and that you intend to resume a full course of study. Filing within five months of termination is significantly easier. After five months, you must explain the delay and pay the I-901 SEVIS fee again.
- Depart and re-enter. Leave the United States, obtain a new SEVIS number and Form I-20 from a school, pay a new I-901 fee, and re-enter on a fresh record. This restarts the visa process, including a new visa stamp if yours has expired.
Reinstatement is discretionary. USCIS can deny it, and the process can take months. Students with a history of repeated violations or unauthorized work face long odds.12Study in the States. Why Unemployment Days Matter for a Cap-Gap H-1B
If your employer files a cap-subject H-1B petition requesting a change of status while your OPT is still active, you can receive an automatic cap-gap extension of F-1 status and work authorization through the October 1 H-1B start date. But if you have already exhausted your 90 or 150 days before the H-1B filing window opens, you no longer have the OPT employment authorization that makes cap-gap work authorization possible. And if the petition is filed only after you have entered the 60-day post-OPT grace period, your F-1 status can be extended but you cannot work during the cap-gap.13U.S. Citizenship and Immigration Services.
