Nozei Kanrinin: Tax Representative for Non-Resident Owners

A Nozei Kanrinin is the Japan-based tax representative that non-resident owners of Japanese real estate are legally required to appoint to receive tax notices, make payments, and file returns with domestic tax authorities. The requirement exists because Japan’s tax offices will not send bills or correspondence to an overseas address; they need a domestic point of contact for every taxpayer. Get this appointment wrong and tax notices you never see can quietly turn into penalties you didn’t know were accumulating.

The obligation comes from Article 117 of the Act on General Rules for National Taxes, which requires any taxpayer without a domicile or residence in Japan to designate someone within the country to handle their national tax affairs.1Japanese Law Translation. Act on General Rules for National Taxes The National Tax Agency confirms the same rule for anyone who leaves Japan or acquires property without establishing residence.2National Tax Agency. Who Can Serve as Your Tax Representative

The eligibility rules are simple. Your representative must have an address in Japan where tax authorities can deliver mail and serve documents. There are no licensing or professional requirements beyond that. A friend, business associate, or family member living in Japan qualifies.3Kyoto Prefecture. Tax Agent (Nouzei Kanrinin)

Many non-resident owners still hire a licensed tax accountant, called a Zeirishi. A Zeirishi understands the filing requirements, tracks changing rates, and can handle situations like rental income deductions or withholding tax refund claims. Cost varies with the scope of work, but a professional is worth considering if your property generates income or you don’t have a trusted contact in Japan who will reliably deal with government correspondence.

One boundary to know upfront: the standard Nozei Kanrinin appointment does not cover formal disputes. If you want to appeal an assessment to the National Tax Tribunal or a court, you need a separate agency agreement for that. The appointment covers routine administrative tasks like filing, receiving notices, and making payments.

National and Local Appointments May Both Be Needed

A detail that catches many owners off guard: you may need more than one appointment. The notification filed with the National Tax Agency covers national taxes like income tax and consumption tax. Property-related taxes like the Fixed Asset Tax and City Planning Tax are assessed and collected by your local municipal or prefectural government, which runs its own system. Prefectural governments maintain their own tax agent notification process.3Kyoto Prefecture. Tax Agent (Nouzei Kanrinin)

Confirm with both the national tax office and the local municipal office whether separate filings are required for your situation. If your property generates rental income and you also owe annual property taxes, you may need to submit representative notifications to each authority independently. Using the same person for both keeps things simple.

How to Appoint a Tax Representative

The appointment is formalized through a notification form submitted to the relevant tax office. For national taxes, the form is called the Notification of Tax Agent for Income Tax/Consumption Tax, available from the National Tax Agency website or in person at a district tax office.4National Tax Agency. Notification Form of Appointment of Tax Agent (For Individuals)

Information the Form Requires

You’ll need to provide:

  • Your full legal name and your residential address outside Japan
  • Your representative’s full name and their verified address within Japan
  • Any tax identification numbers previously issued to you or associated with the property
  • Property details matching the local land registry, including lot number and building specifications

The property information links your representative to the correct assessment district. Verify these details against your purchase contract or property deed before filling in the form, because discrepancies between your submission and the registry records can slow processing. Both you and your representative must sign or affix a personal seal to the completed form.

Where and When to Submit

The completed notification goes to the district tax office with jurisdiction over the property’s location. If you previously lived in Japan, it may instead go to the office that served your last domestic address.1Japanese Law Translation. Act on General Rules for National Taxes You can submit by certified mail or deliver the form at the tax office counter. Mail is usually the practical option for owners living abroad.

The National Tax Agency instructs that the notification be submitted as soon as possible after appointing your representative.5National Tax Agency. If you’re buying property, get the appointment filed before or immediately after closing. Once the tax office processes the notification, all correspondence routes to your representative’s Japanese address, and you stop receiving physical tax mail overseas.

Taxes Your Representative Handles

Owning property in Japan triggers several recurring and one-time tax obligations. Your representative handles most of them.

Fixed Asset Tax and City Planning Tax

Every property owner in Japan as of January 1 each year owes Fixed Asset Tax, assessed on the value of land and buildings. Properties within designated urban planning areas also owe City Planning Tax, calculated on the same assessed value and collected alongside it.6Kanazawa City. Fixed Asset Tax Guide Notices arrive from the local property tax office during or after April each year, with payments typically due in quarterly installments. Your representative receives these notices, confirms the amounts, and pays before each installment deadline.

Real Estate Acquisition Tax

This one-time tax is assessed by the prefectural government after you purchase property. The standard rate is 4% of the government-assessed value, though a reduced rate of 3% applies to land and residential buildings acquired before March 31, 2027, and the taxable base for land purchases during that period is further reduced by half. The bill typically arrives between six months and a year after purchase, which can surprise owners who thought they had settled all closing costs. Your representative needs to be in place before this notice arrives, or it goes unanswered.

Income Tax on Rental Revenue

If your property generates rental income, your representative files an annual income tax return on your behalf. Japan’s income tax filing deadline is March 15 of the year following the tax year. Your representative reports the gross rental income, claims allowable deductions for expenses like maintenance, depreciation, and management fees, and settles the resulting liability.

One critical point: the non-resident owner remains personally liable for any penalties from late filing or non-filing, even after appointing a representative. If your representative misses a deadline, the penalties fall on you. That is why choosing someone reliable, or paying a Zeirishi, matters.

Withholding Tax on Rent

When a tenant pays rent to a non-resident landlord, the tenant (or their property management company) generally withholds 20.42% of each payment and remits it to the tax authorities. This withholding applies regardless of your actual tax liability, and for many owners it exceeds what they actually owe after deductions. There is one exception: no withholding is required if the tenant is an individual who rents the property for themselves or their family members to live in.7National Tax Agency. Real Estate Income of Non-Residents Corporate tenants and management companies always withhold.

This is where your representative earns their fee. When your annual return shows the actual liability is lower than the amount withheld, your representative files for a refund. If a tax treaty between Japan and your home country provides for a reduced rate and the treaty application wasn’t submitted before payments began, your representative can apply for a refund of the difference.8National Tax Agency. Withholding at Sale

Withholding comes up again when you sell. When a non-resident sells real estate in Japan, the buyer or their agent is generally required to withhold 10.21% of the sale price and remit it to the tax authorities. Your actual capital gains tax liability depends on factors like how long you held the property and what deductions apply, so the withheld amount often differs from your final obligation. Your representative files the return that reconciles the two and claims any refund owed. For this reason you should not dismiss your representative the moment the property changes hands. Keep the appointment active until all sale-year filings are resolved.

Changing or Dismissing Your Representative

If you need to replace your representative, you must notify the tax office. Article 117 requires notification both when appointing and when dismissing a tax agent.1Japanese Law Translation. Act on General Rules for National Taxes The NTA provides a dismissal notification form for this purpose.4National Tax Agency. Notification Form of Appointment of Tax Agent (For Individuals)

The cleanest approach is to submit the dismissal of the outgoing representative and the appointment of the new one at the same time. A gap in coverage means tax notices sent during the interim have no recipient, and you won’t know about them until penalties have already started accruing.

What Happens If You Skip This

Not appointing a representative doesn’t make your tax obligations disappear. Bills continue to be assessed against your property, and without anyone to receive them, you simply accumulate unpaid balances. Late payment triggers additional charges, and persistent non-compliance can escalate to seizure proceedings against the property itself.

Since a 2021 amendment, the tax authorities can also act on their own. If the tax office requests that you designate a tax agent and you fail to respond, they can appoint one for you.5National Tax Agency. Appointing your own representative before that point keeps control of who handles your affairs and how.
