Not Valid for Employment” SSN: Meaning, Uses, and Lifting It

A Social Security card stamped “NOT VALID FOR EMPLOYMENT” is a real Social Security number issued to a noncitizen who is lawfully in the United States but has no Department of Homeland Security permission to work. A not valid for employment SSN can be used to file taxes, claim certain government benefits, open a bank account, and build a credit history. It cannot be used to get a job, and the number stays with you for life even if your immigration status later changes.

What the Legend Actually Means

Federal regulations recognize three versions of the Social Security card, and the legend printed above the name is the whole story.1eCFR. 20 CFR 422.103 – Social Security Numbers An unrestricted card, with no legend at all, goes to U.S. citizens and lawful permanent residents and works for any purpose. A card reading “VALID FOR WORK ONLY WITH DHS AUTHORIZATION” goes to noncitizens who have temporary work permission; it works for employment as long as the underlying DHS permit is current. The “NOT VALID FOR EMPLOYMENT” card is the third version, and it is the strictest: the holder has legal presence but no work authorization of any kind.

The card is issued when a lawfully present noncitizen needs a Social Security number for a purpose other than employment, usually because a federal or state law requires one. SNAP is the clearest example: every household member must have or apply for a Social Security number as a condition of receiving food benefits.2Social Security Administration. Dependents of primary visa holders often end up with this card too. A spouse or child on an H-4 or L-2 who has legal status but no independent work permission is a typical recipient.

What You Can Do With the Number

The legend blocks employment. The nine-digit number itself remains a valid federal identifier for everything else.

  • File tax returns, be claimed as a dependent, and report non-employment income like scholarships or investment gains. Once you have a Social Security number of any kind, the IRS expects you to use it rather than apply for an Individual Taxpayer Identification Number.3Internal Revenue Service.   • Satisfy the Social Security number requirement for benefit programs like SNAP.

  • Build a credit file once the number is reported to a credit bureau through an account. That history matters for leases, deposits, and future credit applications.
  • Support a driver’s license application in states that ask for an SSN, though state policies vary.

The number is permanent. When your immigration status changes, the number does not; only the card and its legend do.

Why It Can’t Be Used for a Job

The USCIS Handbook for Employers is direct: a Social Security card marked “NOT VALID FOR EMPLOYMENT” is not acceptable for Form I-9, the employment eligibility verification every new hire must complete.5U.S. Citizenship and Immigration Services. 13.3 List C Documents That Establish Employment Authorization Unrestricted cards work as List C proof of work authorization. Any card with a restrictive legend is specifically excluded. What Happens to You If You Work Anyway

Unauthorized employment by a nonimmigrant can amount to a failure to maintain status, which is itself a deportable offense.7Office of the Law Revision Counsel. 8 USC 1227 – Deportable Aliens The more lasting damage tends to show up years later. Anyone who has engaged in unauthorized employment is generally barred from adjusting to lawful permanent resident status, and that bar reaches back across any prior period of stay in the United States, not just the current one.8U.S. Citizenship and Immigration Services. Leaving the country and returning lawfully does not erase it. A brief stint of unauthorized work is enough to block adjustment.

Non-Work SSN vs. ITIN

People with a non-work card sometimes wonder whether they also need an Individual Taxpayer Identification Number. They do not. The IRS defines the ITIN as available only to nonresident and resident aliens, their spouses, and dependents who cannot get a Social Security number.3Internal Revenue Service. Removing the Restriction After You Get Work Authorization

When your immigration status changes and DHS grants you work authorization, you can get a replacement card with the legend changed or removed. The number itself doesn’t change. There are two ways to do it.

Applying at a Social Security Office

Complete Form SS-5, the Application for a Social Security Card, and bring it to a local SSA office with original documents or certified copies.   • Proof of work authorization, typically an Employment Authorization Document (EAD) or a Form I-94 with a class of admission that permits work.11Social Security Administration. 20 CFR 422.104 – Who Can Be Assigned a Social Security Number
  • Proof of immigration status, usually a valid unexpired foreign passport.
  • Proof of identity, which the passport typically satisfies alongside status.
  • Proof of age, generally a birth certificate or passport.

If your name has changed by marriage or court order, bring the original legal document showing the change. The SSA verifies work authorization with DHS before issuing the new card. Going in person is worth the trip: passports and EADs are difficult and expensive to replace if lost in the mail, and staff verifies the originals on the spot and returns them the same day.

The Enumeration Beyond Entry Route

If you’re applying for work authorization through USCIS on Form I-765, you can request the updated Social Security card at the same time without filing SS-5 or visiting an SSA office. The program is called Enumeration Beyond Entry. When USCIS approves the work authorization, it transmits your information electronically to the SSA, and the SSA issues an updated card automatically.12Social Security Administration. How Long It Takes

Once documents are submitted and DHS verification is complete, the SSA typically mails the new card within 7 to 10 business days.14Social Security Administration.
