An IRS Verification of Non-filing Letter is a free document from the IRS stating that the agency has no record of a processed federal tax return for a specific tax year. What the Letter Looks Like
The letter arrives on official IRS letterhead from the agency’s processing center. It identifies you by name and shows a taxpayer identification number for matching, with personal information masked so that only the last four digits of your Social Security Number appear.2Internal Revenue Service. The body names the tax period searched and states, in substance, that the IRS has no record of a filed Form 1040, 1040A, or 1040EZ using that Social Security Number, and that the letter can be considered a verification of non-filing. It also shows the request date, a tracking ID, and an IRS phone number for questions. That statement is the piece lenders and institutions are looking at when they ask for the document.
What It Proves and What It Doesn’t
The letter proves one thing: the IRS has no processed return on file for the year listed. The IRS itself notes the letter “doesn’t indicate whether you are required to file a return for that year.”1Internal Revenue Service. Transcript Types for Individuals and Ways to Order Them
If your income was above the filing threshold and you simply never filed, the letter will still generate. It does not excuse you, and it does not stop penalties or back taxes from accruing. For the 2025 tax year, a single filer under 65 must file at $15,750 of gross income, and a married couple filing jointly under 65 must file at $31,500.3Internal Revenue Service. When Your Lender Handles the Request
During mortgage underwriting, your lender may skip you and request tax information from the IRS directly. Lenders do this through the Income Verification Express Service (IVES) using Form 4506-C, which authorizes an approved IVES participant to receive your tax information electronically.8Internal Revenue Service. Income Verification Express Service You sign the authorization; the lender submits it. If your lender is using IVES, you typically do not need to order a separate letter yourself.
If You Were Required to File and Didn’t
A non-filing letter for a year you were supposed to file is not a clean bill of health. It just means the IRS has not processed a return yet. The failure-to-file penalty runs 5% of the unpaid tax per month the return is late, up to 25%. For returns more than 60 days overdue, the minimum penalty is the lesser of $435 or the full amount of tax owed.9Office of the Law Revision Counsel. 26 USC 6651 – Failure to File Tax Return or to Pay Tax A separate failure-to-pay penalty of 0.5% per month accumulates on any balance due, with interest compounding on both.
Filing a late return voluntarily is almost always better than waiting for the IRS to catch up. Enforcement tends to focus on taxpayers who have to be chased rather than those who come forward.
