Confirm You’re Eligible Before You File

Two thresholds decide whether your leave actually gets FMLA protection. Complete the Medical Certification

If your leave is for a serious health condition (yours or a family member’s), the certification form is the piece that most often stalls a claim. New York Life publishes two separate forms on its forms page: one for an employee’s own illness and one for care of a family member.4New York Life.   • The date the serious health condition began.
  • The probable duration of the condition.
  • Relevant medical facts within the provider’s knowledge.
  • For your own condition: a statement that you cannot perform the functions of your job.
  • For a family member’s condition: a statement that you’re needed to provide care, plus an estimate of how much time that care will take.

Hand your doctor a copy of your job description before they fill out the form. Providers often write vague statements about what you can’t do because they don’t know what your job requires. A job description lets them tie your medical limitations to specific duties, which is exactly what the claim manager is looking for.

The 15-Day Deadline

Once New York Life requests the certification, you have 15 calendar days to return it. The exception is when circumstances genuinely prevent you from meeting that deadline despite a good-faith effort, such as a provider on vacation, a records-transfer delay, or a medical emergency.7eCFR. 29 CFR 825.305 – Certification If you can see it will be tight, call your claim manager early rather than letting the deadline pass in silence.

If the Form Comes Back Incomplete

If the certification is missing details or is otherwise insufficient, you get seven calendar days to cure the problem.7eCFR. 29 CFR 825.305 – Certification That window is short. Stay in touch with the provider’s office during the review period, and if the practice is slow to respond, walk the corrected form in rather than waiting on faxes.

Intermittent Leave and Reduced Schedules

If your condition calls for periodic treatment (chemotherapy, dialysis, physical therapy) or flares unpredictably, you can take leave in smaller increments or on a reduced schedule. The certification needs more detail in that case: your provider must estimate how often absences will occur, how long each will last, and explain the medical necessity for the pattern.8U.S. Department of Labor. Something like “approximately two episodes per month, lasting one to two days each” is what the reviewer needs.

What Happens After You Submit

Eligibility Notice Within Five Business Days

Within five business days of your request, you must receive an eligibility notice stating whether you qualify. Designation Notice

If the Claim Is Denied for a Paperwork Problem

A denial tied to an incomplete or late certification isn’t always permanent. If you missed the deadline on foreseeable leave, the employer can deny FMLA protection only for the gap between the deadline and the date you finally submit a sufficient certification. For unforeseeable leave, the same principle applies: once adequate documentation is in, FMLA protection takes effect going forward.10eCFR. 29 CFR 825.313 – Failure to Provide Certification If you never provide the certification, the leave gets no FMLA protection. Your denial notice should spell out the specific reason, which tells you what to fix.

If You Also Have Short-Term Disability Through New York Life

When your own medical condition is the reason for leave and New York Life administers both your employer’s FMLA program and your short-term disability coverage, filing a disability claim automatically triggers the FMLA request.11New York Life. Confirm with HR that both benefits sit with New York Life before you rely on this, because some employers split administrators.
