The biggest change in the new driver’s license law is REAL ID enforcement, which took effect on May 7, 2025. From that date, TSA and other federal agencies no longer accept a state-issued license at security checkpoints or federal building entrances unless it meets REAL ID standards.1Transportation Security Administration. The change is narrower than the headlines suggest, but for anyone who flies or visits a federal building, it now matters at the door.
The REAL ID Act of 2005 set federal minimum standards for state-issued driver’s licenses and identification cards, and “official purpose” under the Act covers boarding a commercial aircraft for domestic travel, entering federal facilities, and accessing nuclear power plants.2GovInfo. How to Tell If Your License Is Already Compliant
REAL ID-compliant cards carry a marking on the upper portion of the card, usually a gold or black star. Non-compliant licenses have to state on the face of the card and in the machine-readable zone that they aren’t acceptable for official purposes.3Transportation Security Administration. Every compliant card displays your full legal name, date of birth, gender, address of principal residence, a digital photograph, and a signature, along with anti-counterfeiting features and machine-readable data. What Happens at the Airport Without One
Showing up at a TSA checkpoint without a compliant license or an acceptable alternative no longer just slows you down. TSA now offers a service called ConfirmID: a $45 fee for TSA to attempt to verify your identity through other means. There is no guarantee the verification succeeds, and if it fails you don’t get through security.5Transportation Security Administration. TSA ConfirmID
You can still fly without a REAL ID if you carry another acceptable form of identification. TSA’s list includes a U.S. passport or passport card, a military ID, a permanent resident card, a DHS trusted traveler card such as Global Entry or NEXUS, an approved mobile driver’s license based on a REAL ID, a foreign passport, a tribal government photo ID, and a Transportation Worker Identification Credential, among others.6Transportation Security Administration. That last point catches people who renew right before a trip. The paper receipt you leave the DMV with is fine for driving. It won’t get you on a plane.
What You Need to Bring to Get One
The REAL ID Act sets four categories of documentation, and your state motor vehicle agency has to verify each one before issuing the card. Bring originals or certified copies. Photocopies won’t be accepted.
- Proof of identity. An original or certified birth certificate, a valid U.S. passport, or certain immigration documents. Hospital-issued birth records don’t qualify.
- Social Security number. A Social Security card, a W-2, or a pay stub showing your full SSN. The agency verifies the number directly with the Social Security Administration.4eCFR. 6 CFR Part 37 – Real ID Drivers Licenses and Identification Cards
- Two proofs of residency. Utility bills, bank statements, lease agreements, mortgage documents, or similar items showing your name and current physical address. A P.O. box won’t satisfy this.
- Lawful status. U.S. citizens satisfy this through their identity document. Non-citizens must provide separate proof of immigration status.2GovInfo. REAL ID Act of 2005
States verify birth certificates through the Electronic Verification of Vital Events system or another electronic method, and check immigration documents through the DHS SAVE database.4eCFR. 6 CFR Part 37 – Real ID Drivers Licenses and Identification Cards That cross-checking is why the appointment takes longer than a routine renewal used to, and why the originals requirement is strict.
After the visit, you’ll typically leave with a temporary paper receipt and receive the permanent card in the mail within one to three weeks. Plan any air travel around when the physical card arrives, since the paper receipt won’t clear security.
Rules for Non-Citizens
Lawful permanent residents, conditional permanent residents, approved asylees, and refugees qualify for a full-term REAL ID with the same expiration period as any other cardholder. Non-citizens in a temporary lawful status receive a limited-term REAL ID that expires when their authorized stay ends. If there is no definite end date to the authorized stay, the card is valid for one year. Mobile Driver’s Licenses
The other current shift in license law is the arrival of mobile driver’s licenses. A growing number of states now issue digital credentials that live on your smartphone, storing the same information as your physical card in encrypted form. You present them by holding the phone near a reader or displaying a QR code. TSA accepts mobile licenses at select checkpoints through a digital ID pilot, but only if the mDL is based on an underlying REAL ID, enhanced driver’s license, or enhanced identification card.7Transportation Security Administration. The practical advantage isn’t convenience, it’s data control. A physical card hands over everything printed on it every time you show it. A mobile license built to the international mDL standard supports selective disclosure: if a bar needs to confirm you’re over 21, the app can transmit a yes-or-no age check without revealing your date of birth, home address, or license number. The issuing authority can also limit shareable fields to a birth year rather than a full date of birth. Before any release, the holder sees what the verifier is requesting and can accept or decline individual fields.
The limits are real. Most law enforcement agencies still require the physical card during traffic stops. Many businesses haven’t installed hardware to read digital credentials. TSA is also testing digital ID options from Apple, Clear, and Google at certain checkpoints, but nationwide coverage isn’t there yet.6Transportation Security Administration. Penalties for Driving Without a Valid License
Driving without any valid license is a criminal offense in every state, typically a misdemeanor. A first offense for simply never having obtained a license usually carries a fine in the low hundreds of dollars and no jail time. Repeat offenses, driving on a suspended or revoked license, or causing an accident while unlicensed can escalate the charge to a higher misdemeanor class with potential jail time of up to a year and fines reaching several thousand dollars.
Providing false information on the license application itself is a separate matter. Federal law treats producing or using a fraudulent driver’s license as a felony carrying up to 15 years in prison.8Office of the Law Revision Counsel. 18 USC 1028 – Fraud and Related Activity in Connection With Identification Documents The medical questions on the application about seizure disorders, vision impairments, or medications that cause drowsiness fall under the same honesty requirement.
An expired license is treated differently from no license at all in most jurisdictions. Many states allow dismissal of an expired-license charge if you renew within a short window after the traffic stop, though you may still owe a court processing fee. Renewing a lapsed license sometimes requires retaking the written or vision test. Set a calendar reminder for your renewal date, and if you don’t have the star on your card yet, use that renewal as the moment to upgrade to REAL ID.
