The Navy contract writing system is the electronic Procurement System, or ePS, a Department of the Navy platform that manages procurement actions from initial requisition through award, execution, modification, and closeout. It replaced the Standard Procurement System and consolidated a fragmented set of legacy tools used across ten Heads of Contracting Activity into a single standardized environment.1CHIPS Magazine. Electronic Procurement System Brings Functional Future to Department of the Navy Contract Writing The Department of Defense has set a final sunset date of September 30, 2026 for all remaining SPS activity, which makes ePS the Navy’s forward path for writing contracts.2U.S. Department of Defense. What ePS Does
Once fully operational at a command, ePS provides end-to-end contract management of services, supplies, and construction across the Department of the Navy.1CHIPS Magazine. Electronic Procurement System Brings Functional Future to Department of the Navy Contract Writing It handles drafting solicitations, routing approvals, issuing awards, obligating funds, processing modifications, and archiving the complete file.
The system integrates with Navy financial systems so that fund availability is confirmed before a contract is finalized, which is one of the practical safeguards against Antideficiency Act violations. Everything produced in ePS must comply with the Federal Acquisition Regulation, the Defense FAR Supplement, and the Navy Marine Corps Acquisition Regulation Supplement, which sets uniform Department of the Navy policies implementing FAR and DFARS.3Acquisition.GOV. Navy Marine Corps Acquisition Regulation Supplement Part 5201 – Federal Acquisition Regulations System Clause libraries stay current in the system so contractual language reflects the most recent regulatory updates.
Replacing the Standard Procurement System
Work on an enterprise-wide contract writing solution began around 2013, driven by SPS’s lack of interoperability and data transparency. After evaluating commercial alternatives, the Navy chose to modify CON-IT, the Air Force’s contracting platform, as the baseline for the ePS Core Contracting Module.1CHIPS Magazine. Electronic Procurement System Brings Functional Future to Department of the Navy Contract Writing Using an existing DoD system as the foundation avoided building from scratch.
The transition has run into schedule delays, and rollout to all Navy contracting commands is still ongoing. Under a 2021 DoD memorandum, no new contracts, orders, or solicitations could be awarded through legacy SPS after September 30, 2023. Modifications to contracts originally issued in SPS may continue through September 30, 2026, after which all SPS activity must stop. Any component still needing SPS support during that wind-down must fund it through the Defense Logistics Agency’s SPS Joint Program Management Office.2U.S. Department of Defense. Who Uses ePS and How They Get In
ePS sits behind DoD network authentication, so every operator needs a Common Access Card, the standard identification and digital credential for military personnel, DoD civilians, and eligible contractors. The CAC handles both physical building access and secure login to DoD networks and systems.4Department of the Navy Chief Information Officer. Common Access Card – Security and Privacy
Personnel handling sensitive acquisitions also need a security clearance at a level appropriate to the work. The Defense Counterintelligence and Security Agency conducts the background investigations, with the depth of investigation depending on the potential for harm in the position.5Defense Counterintelligence and Security Agency. Investigations and Clearance Process A Secret investigation can take one to six months; a Top Secret investigation often runs four to twelve. Supervisors need to factor those timelines into workforce planning, because a contracting professional cannot touch classified acquisitions until the clearance comes through.
On the professional credential side, the Federal Acquisition Certification in Contracting does not apply to Navy personnel. FAC-C covers civilian executive agencies and explicitly excludes the Department of Defense. DoD contracting professionals instead earn the DoD Contracting Professional Certification, a single-level credential that prepares the workforce for initial readiness to perform contracting tasks.6U.S. Department of Defense. DPC – Contract Policy – Workforce Development This distinction trips up people moving between civilian agencies and DoD.
Inside the system, roles are separated. Contract Specialists prepare and manage contract documents. Contracting Officers hold the legal authority to enter into, administer, or terminate contracts and bind the government, and they can obligate funds only up to the limits of their delegated warrant authority. Those warrant limits must be readily available to both agency personnel and the public.7Acquisition.GOV. 48 CFR 1.602-1 – Authority A specialist can draft a $50 million contract, but it binds no one until a warranted Contracting Officer signs.
What Goes Into a Contract in ePS
Building a contract requires structured data at each stage. Errors or gaps here can trigger protests, audit findings, or funding violations, so the system enforces specific inputs before a document can move forward.
Contract Line Items and Product Service Codes
Every procurement identifies what is being purchased through Contract Line Item Numbers. Under DFARS, each CLIN must be separately identifiable, carry a single unit price or total price, and correspond to a distinct deliverable.8Acquisition.GOV. DFARS Subpart 204.71 – Uniform Contract Line Item Numbering System The CLIN structure set at award determines how accurately the contract tracks pricing, delivery, and funding for its entire life.9Acquisition.GOV. Federal Acquisition Regulation Subpart 4.10 – Uniform Use of Line Items
Each line item also needs a Product Service Code, a four-digit identifier that classifies the purchase for federal reporting. PSCs feed the Federal Procurement Data System and let DoD map spending across portfolio categories. DFARS requires a PSC at the contract line item level for all service contract requirements.
Vendor Verification Through SAM.gov
Before award, the Contracting Officer must confirm that the vendor has an active registration in the System for Award Management and holds a valid Unique Entity Identifier.10SAM.gov. System for Award Management The Contracting Officer must also check SAM’s exclusion records to confirm the vendor is not debarred, suspended, or otherwise barred from federal contracting. Federal agencies are prohibited from awarding contracts to excluded entities unless the agency head makes a written determination that a compelling reason exists.11eCFR. 48 CFR 9.405 – Effect of Listing Exclusion records must be reviewed both after proposals arrive and again immediately before award.
Contract Type
The system requires selection of a contract type, which allocates financial risk between the government and the contractor. Firm-fixed-price contracts put the cost risk on the contractor. Cost-reimbursement contracts put it on the government and are appropriate only when the agency cannot define its requirements well enough for a fixed-price approach or when performance uncertainties make accurate cost estimates impossible.12Acquisition.GOV. FAR Subpart 16.3 – Cost-Reimbursement Contracts The choice flows through the rest of the document, affecting clause requirements, oversight, and payment structure.
Defense Priorities and Allocations System Ratings
Many Navy contracts carry a Defense Priorities and Allocations System rating that tells the contractor how urgently the government needs delivery:
- DX ratings are reserved for programs of the highest national priority. Contractors must accept or reject a DX-rated order within 10 working days.
- DO ratings apply to other authorized defense programs. Contractors have 15 working days to accept or reject.
A DX order takes priority over a DO order, which takes priority over any unrated commercial order. A contractor receiving a rated order must extend that rating down through its supply chain, and giving higher priority to a lower-rated or unrated order is a regulatory violation.13Defense Contract Management Agency. Defense Priorities and Allocations System (DPAS)
Negotiation and Small Business Set-Asides
When the Navy acquires goods or services through negotiation rather than sealed bidding, FAR Part 15 governs. The Contracting Officer selects from a best-value continuum that may weigh technical capability, past performance, and cost differently based on how well-defined the requirement is and how much performance risk exists.14Acquisition.GOV. Part 15 – Contracting by Negotiation The system prompts for the applicable solicitation provisions and clauses based on the approach chosen.
Contracting officers must also evaluate whether acquisitions can be set aside for small businesses, including service-disabled veteran-owned firms and other socioeconomic categories. For contracts above $250,000, SBA regulations and FAR require consideration of socioeconomic set-asides.15U.S. Small Business Administration. Set-Aside Procurement
How a Contract Moves Through the System
Once the data fields are populated, ePS starts a structured electronic routing process. The draft moves through reviewers without anyone printing, hand-carrying, or emailing documents between offices.
Small Business Coordination
Before a solicitation goes out, the Contracting Officer completes a DD Form 2579, the Small Business Coordination Record. The form documents the set-aside decision and requires input from the activity’s Small Business Professional, who evaluates whether the acquisition strategy maximizes small business participation. If the acquisition plan changes significantly after initial coordination, the form must be re-evaluated.16Acquisition.GOV. PGI 253.219-70 DD Form 2579, Small Business Coordination Record
Legal Review and Digital Signature
The draft routes to legal reviewers who can leave comments and request modifications directly within the system. After legal approval, the document moves to execution. The system uses Public Key Infrastructure technology for digital signatures, which rely on asymmetric cryptography to validate the signer’s identity and confirm the document has not been altered after signing.17Cybersecurity and Infrastructure Security Agency. Understanding Digital Signatures The strength of those signatures depends on protection of the private key, which is why CAC-based authentication carries so much weight.
Fund Obligation and File Retention
Once the Contracting Officer signs, the system transmits the executed contract electronically to the contractor and synchronizes with financial management systems to obligate funds. Accounting records reflect the new commitment immediately. Federal law requires the head of each agency to make and preserve records containing adequate documentation of the agency’s essential transactions, including those needed to protect the legal and financial rights of the government.18Office of the Law Revision Counsel. 44 USC 3101 ePS holds the complete contract file as a permanent record available for later audits or inquiries.
Modifying a Contract After Award
Contracts rarely finish exactly as awarded. When scope, deadlines, funding, or administrative details change, the system generates a Standard Form 30. The Contracting Officer must categorize the modification:
- Change order: a unilateral direction from the Contracting Officer under the contract’s Changes clause, typically adjusting scope or delivery requirements.
- Administrative change: corrections to details such as the paying office or appropriation data that do not affect substantive terms.
- Supplemental agreement: a bilateral modification requiring agreement from both the government and the contractor, often used for negotiated price adjustments or scope changes beyond the Changes clause.
Effective dates vary by type. Change orders and administrative changes take effect on the date issued. Supplemental agreements take effect on the date the parties agree upon. Every modification specifies whether the total contract price increased, decreased, or stayed the same, along with detailed accounting data for any funds added or removed. Once the Contracting Officer signs, the modification flows through the same financial integration and archiving process as the original award.
How Contractors Connect to It
Contractors do not log into ePS. Their interface with DoD procurement is the Procurement Integrated Enterprise Environment, a cloud-based platform managed by the Defense Logistics Agency that hosts DoD’s enterprise procurement capabilities.19U.S. Department of Defense. Procurement Integrated Enterprise Environment (PIEE) Through PIEE, contractors reach tools such as Wide Area Workflow for submitting invoices and receiving payments, and Electronic Document Access for retrieving executed contracts and modifications. PIEE offers single sign-on and centralized account management, so a vendor works with one portal rather than a separate system for each military service.
The split is deliberate. The Navy’s internal drafting, review, and approval workflow stays inside ePS behind DoD network authentication, while contractor-facing distribution and payment functions live in PIEE. The two exchange data electronically, but contractors never touch the internal deliberative process. For a vendor trying to find a signed contract or submit an invoice, PIEE at piee.eb.mil is the starting point.
