Mortgage Seasoning Requirements: Waiting Periods and Refinance Rules

Mortgage seasoning requirements are the mandatory waiting periods a lender applies before you qualify for a new home loan, either after a derogatory credit event like foreclosure or bankruptcy, or between an existing loan and a refinance. The waits range from as little as twelve months to as long as seven years, and the exact number depends on what happened, which loan program you’re using, and when the clock actually started. Getting the date wrong is the difference between an approval and a denial, so the details matter.

Waiting Periods After Foreclosure

Foreclosure carries the longest standard waits of any credit event. By loan program:

  • Conventional (Fannie Mae/Freddie Mac): seven years from the completion of the foreclosure, dropping to three years with documented extenuating circumstances.
  • FHA: three years from completion, with the possibility of a shorter wait when extenuating circumstances are documented.
  • VA: two years from completion, the fastest path back for eligible veterans.
  • USDA: three years from completion for the rural housing guaranteed loan program.

The clock starts on the date the foreclosure was completed, not the day you missed your first payment or moved out. That completion date sits on the trustee’s deed or the court order finalizing the sale. If you’re not certain of it, pull a copy from your county recorder before you start counting months.

Waiting Periods After Bankruptcy

Bankruptcy waits split by chapter, and the clock starts from different points.

Chapter 7

Chapter 7 discharges wipe your debts. The waiting period runs from the discharge date on your court documents, not the filing date. Months can pass between the two.

Chapter 13

Chapter 13 is a court-supervised repayment plan, which opens two paths. After a completed plan and discharge, the conventional waiting period is two years from the discharge date.2Fannie Mae. Significant Derogatory Credit Events – Waiting Periods and Re-Establishing Credit

While a Chapter 13 plan is still active, FHA and VA loans become available after twelve months of on-time plan payments, with written permission from the bankruptcy court or trustee.1U.S. Department of Housing and Urban Development. How Does a Bankruptcy Affect a Borrowers Eligibility for an FHA Mortgage Your payment history during the plan has to be spotless. USDA also allows approval during an active Chapter 13 plan when all payments are current and accounted for; twelve months after plan completion, USDA effectively treats the bankruptcy as resolved.3U.S. Department of Agriculture. A dismissed Chapter 13, one that ended without a discharge, is treated more harshly. Fannie Mae imposes a four-year wait from the dismissal date.2Fannie Mae. Significant Derogatory Credit Events – Waiting Periods and Re-Establishing Credit

Waiting Periods After a Short Sale or Deed in Lieu

Selling for less than you owe (short sale) or handing the property back to the lender (deed in lieu) carries shorter waits than a full foreclosure, because you took proactive steps to resolve the debt.

  • Conventional: four years from the date of the short sale or deed in lieu, dropping to two years with documented extenuating circumstances.2Fannie Mae. Significant Derogatory Credit Events – Waiting Periods and Re-Establishing Credit
  • FHA: three years as the general rule. Borrowers current on all payments at the time of the sale may face no waiting period, though proving it takes thorough documentation.
  • VA: no mandatory VA-set wait, but most VA lenders impose two years. If you had no missed payments in the twelve months before the short sale, some lenders waive the wait.
  • USDA: three years from the event.

Whether you were current or in default at the time of a short sale genuinely changes your FHA and VA options. If you negotiated the sale before falling behind, keep every statement and payment record proving it. Underwriters look at this closely.

When Bankruptcy and Foreclosure Involve the Same Loan

Plenty of borrowers go through both a bankruptcy and a foreclosure, often on the same property. Fannie Mae has a specific rule for this situation: if the mortgage debt was discharged in the bankruptcy, the lender can apply the bankruptcy waiting period instead of the longer foreclosure period, provided you can produce documentation that the mortgage was included in the discharge. Without that proof, the longer period applies.2Fannie Mae. Significant Derogatory Credit Events – Waiting Periods and Re-Establishing Credit

The stakes are real. A Chapter 7 discharge followed by foreclosure on the same property can mean a four-year wait rather than seven, if the paperwork is in order. Borrowers unaware of the rule often assume they’re stuck with the longer number.

Multiple bankruptcy filings within the past seven years trigger a five-year conventional wait, dropping to three years with documented extenuating circumstances, measured from the most recent discharge or dismissal date.2Fannie Mae. Extenuating Circumstances That Shorten the Wait

Both Fannie Mae and FHA recognize that some financial catastrophes happen through no fault of the borrower. When you can prove it, the waits shrink.

Under Fannie Mae guidelines, extenuating circumstances reduce the post-foreclosure wait from seven years to three, the post-short-sale wait from four to two, and the post-Chapter 7 wait from four to two.2Fannie Mae. Significant Derogatory Credit Events – Waiting Periods and Re-Establishing Credit You’ll need a written letter explaining what happened, plus supporting documents such as medical records, a death certificate, or an employer layoff notice. The event has to be a nonrecurring situation genuinely beyond your control.

FHA no longer runs the “Back to Work” program under Mortgagee Letter 2013-26, which allowed twelve-month qualification after an Economic Event; that program expired September 30, 2016.4U.S. Department of Housing and Urban Development. Mortgagee Letter 2013-26 – Back to Work – Extenuating Circumstances Under current FHA rules, extenuating circumstances like the death of a wage earner or a serious medical event can still reduce the three-year post-foreclosure wait, but FHA evaluates these case by case.

The documentation bar is high in either program. You need to show clean credit before the event, prove the derogatory item was caused by the event, and demonstrate rebuilt credit since. Vague hardship letters won’t clear underwriting.

Seasoning Requirements for Refinancing

Refinancing has its own rulebook, separate from the post-default waits above. These focus on how long you’ve held the current loan.

Conventional Cash-Out Refinance

You must own the property for at least six months before the new loan can be disbursed. That six months runs from the closing date of the original purchase to the disbursement date of the refinance.5Fannie Mae. Cash-Out Refinance Transactions

Conventional Rate-and-Term Refinance

If you’re just lowering your rate or changing your term without pulling cash, there’s essentially no wait. These transactions can close almost immediately after the original purchase, as long as the new loan doesn’t exceed the existing payoff.6Fannie Mae. Limited Cash-Out Refinance Transactions

FHA Cash-Out Refinance

You must be current on the existing mortgage and have made all payments within the month due for the previous twelve months. If you’ve held the loan fewer than twelve months but more than six, every single payment must have been on time. Mortgages with fewer than six months of payment history are not eligible for a cash-out refinance.7U.S. Department of Housing and Urban Development. HUD 4155.1 Chapter 3 Section B – Maximum Mortgage Amounts on No Cash Out and Cash Out Refinance Transactions

FHA Streamline Refinance

The Streamline requires at least six payments made on the existing FHA loan, at least six months since the first payment due date, and at least 210 days since the original closing date. All mortgage payments must have been made within the month due for the prior six months, with no more than one 30-day late payment.8Federal Deposit Insurance Corporation. Streamline Refinance

VA Interest Rate Reduction Refinance Loan

The VA IRRRL requires 210 days of seasoning from the due date of the first monthly payment on the existing VA loan.9U.S. Department of Veterans Affairs. Circular 26-20-16 Exhibit A There is no corrective action for an IRRRL that closes short of the 210-day mark. The lender would have to sign an indemnification agreement holding the VA harmless, and most refuse to do so.

Delayed Financing for Cash Buyers

If you bought with cash and want to pull that money back out through a mortgage, you’d normally face the six-month cash-out seasoning. The delayed financing exception waives it.

To qualify under Fannie Mae’s rules, every one of the following has to be true:5Fannie Mae. Cash-Out Refinance Transactions

  • The original purchase was an arm’s-length transaction between unrelated parties.
  • The settlement statement confirms no mortgage financing was used on the original purchase.
  • A preliminary title search shows the property free of liens.
  • You can document where the cash came from using bank statements, personal loan documents, or similar records.
  • The new loan doesn’t exceed your documented cash investment plus closing costs and prepaids, and doesn’t exceed the maximum LTV based on current appraised value.
  • Any portion of the purchase funded with gift money cannot be recouped through the refinance.

One detail that trips up investors: if you used an unsecured loan or a HELOC on another property to fund the cash purchase, the refinance proceeds must be used to pay off that original loan, and the lender will verify it on the settlement statement.

Rebuilding Credit During the Waiting Period

Waiting out the seasoning period is only half the requirement. When it expires, you still need a credit profile strong enough to qualify.

FHA’s minimum credit score is 580 for a 3.5% down payment, or 500 to 579 with 10% down. Conventional loans typically require 620 or higher. After a foreclosure or bankruptcy, meeting the minimum isn’t enough on its own; lenders want to see active, well-managed accounts.

The VA considers your credit re-established after two years of clean credit history following bankruptcy. FHA lets you demonstrate good credit either by opening new accounts and paying on time or by showing a stable financial pattern without new debt. The first path is more common because it produces the tradeline history underwriters look for.

Start rebuilding well before the wait ends. A secured credit card opened two years before your target application date gives you 24 months of on-time history. Waiting until the seasoning period runs out and then scrambling to build credit adds delay to an already long process.

Tax Consequences to Factor In

Seasoning rules govern when you can borrow again, but they don’t address a separate cost of foreclosure, short sale, or deed in lieu: forgiven mortgage debt is generally treated as taxable income by the IRS, reported on Form 1099-C.10Internal Revenue Service. Topic No. 431, Canceled Debt – Is It Taxable or Not The Mortgage Forgiveness Debt Relief Act exclusion for primary residences expired on January 1, 2026, for discharges not covered by a written arrangement entered before that date. Two exceptions still apply regardless: insolvency at the time of cancellation (up to the extent of insolvency) and debt discharged through bankruptcy. If you’re heading into a short sale or foreclosure, price the potential tax liability into your plan alongside the waiting-period math.
