You can file your federal return even if a W-2 never arrives. The IRS expects you to report every dollar of wages you earned, and it publishes Form 4852 as an official substitute when the real form is missing or wrong. If you want to know how to file taxes without a W-2, the short version is this: chase the employer first, ask the IRS to intervene if that fails, reconstruct your numbers from your final pay stub and an IRS wage transcript, and either file Form 4852 by April 15 or request an extension.
When a Missing W-2 Becomes a Problem
Federal law requires any employer that withheld income or payroll taxes to furnish your W-2 by January 31 of the following year, whether by mail or electronically.1Office of the Law Revision Counsel. 26 U.S. Code 6051 – Receipts for Employees If nothing has landed by mid-February, treat it as a real problem: an outdated address, a payroll error, or a noncompliant employer.
Your own filing deadline is April 15, 2026.2Internal Revenue Service. When to File That leaves roughly ten weeks to work the problem. Missing the deadline without an extension triggers a failure-to-file penalty of 5% of unpaid tax per month, capped at 25%. If your return is more than 60 days late, the minimum penalty is $525 or 100% of the unpaid tax, whichever is less.3Internal Revenue Service. Failure to File Penalty
Ask Your Employer First
Call or email payroll or HR before anything else. Most missing W-2s come down to a wrong address or a clerical slip, and a request for a reissue usually clears it up in days. Confirm your current mailing address while you’re on the line. Write down the date you made contact and the name of the person you spoke with. You’ll need those details later if you end up filing a substitute.
Ask the IRS to Step In
If your employer is unresponsive, out of business, or refuses to help, the IRS will contact them on your behalf. Wait until the end of February to give any mailed form a chance to arrive, then call 800-829-1040.4Internal Revenue Service. If You Don’t Get a W-2 or Your W-2 Is Wrong Have ready:
- Your name, address, phone number, and Social Security number
- Your employer’s name, address, and phone number
- The dates you worked for that employer during the tax year
An IRS representative will send a letter to the employer asking for the missing form.5Internal Revenue Service. W-2 – Additional, Incorrect, Lost, Non-Receipt, Omitted
Pull an IRS Wage and Income Transcript
While you’re waiting, request a wage and income transcript. It pulls the federal wage and tax data your employer already reported to the Social Security Administration, which is enough to fill in most of a substitute form. Three ways to get it:
- Online through your Individual Online Account at IRS.gov, viewable and downloadable immediately
- By phone at 800-908-9946
- By mail using Form 4506-T
One limitation matters: the transcript carries only federal figures. It does not include state or local withholding.7Internal Revenue Service. Transcript or Copy of Form W-2 For state numbers, your final pay stub is likely your only source.
Fill Out Form 4852 as a Substitute W-2
When April is closing in and the W-2 still hasn’t shown up, Form 4852 is the IRS-approved stand-in. It covers both missing and incorrect W-2s and lets you report wages and withholdings from the best evidence you have.8Internal Revenue Service. Where the Numbers Come From
Your final pay stub of the calendar year is the most reliable starting point. It usually shows year-to-date gross wages, federal income tax withheld, and Social Security and Medicare taxes.9Internal Revenue Service. Form 4852 – Substitute for Form W-2, Wage and Tax Statement Cross-reference those totals with your wage and income transcript. Where the two agree, you can trust the figures. Where they disagree, investigate before guessing; a wrong number here can slow your refund or invite penalties.
No pay stub and no transcript? Reconstruct income from bank deposits, earlier pay stubs, or an employment contract. Add every paycheck for the year and estimate withholdings proportionally. Keep your worksheet in case the IRS asks how you arrived at the totals.
Describe What You Did to Get the Original
Form 4852 includes a section asking what steps you took to obtain the real W-2: the dates you contacted your employer, when you called the IRS, and how they responded.9Internal Revenue Service. Form 4852 – Substitute for Form W-2, Wage and Tax Statement This is your good-faith record. Specific dates and names reduce the chance the IRS flags your return.
More Than One Missing W-2
Use a separate Form 4852 for each employer that failed to issue one. The form has room for a single employer’s name, address, and zip code, so there’s no way to combine them.9Internal Revenue Service. Form 4852 – Substitute for Form W-2, Wage and Tax Statement
Filing the Return
You can e-file or mail a return that includes Form 4852. The IRS explicitly permits e-filing with a substitute W-2, and most tax software prompts you to enter Form 4852 data in place of a standard W-2.10Internal Revenue Service. Expect longer processing. The IRS verifies your reported figures against whatever the employer eventually submits, and that check can push refunds back by several weeks. Interest on any unpaid balance runs at 7% annually, compounded daily, from April 15 forward, so underestimating your withholdings gets more expensive the longer it takes to resolve.11Internal Revenue Service. File an Extension Instead
If you’d rather wait for the actual W-2 than estimate, file Form 4868 by April 15 for an automatic six-month extension. That moves your filing deadline to October 15, 2026.13Internal Revenue Service. If You Need More Time to File, Request an Extension This works well when the employer has acknowledged the error and promised a reissue.
An extension gives you more time to file, not more time to pay. Any tax owed is still due April 15, and interest starts accruing the next day.13Internal Revenue Service. If You Need More Time to File, Request an Extension Estimate your liability from your final pay stub and send a payment with the extension request. Slight overpayment followed by a refund costs less than underpaying and accruing interest and penalties.
If Your Numbers Don’t Match IRS Records
The IRS compares every return against the W-2 and 1099 data employers and banks report. When something doesn’t line up, it issues a CP2000 notice proposing adjustments.14Internal Revenue Service. Understanding Your CP2000 Series Notice A CP2000 is not a bill. You can agree, partially dispute, or contest it with documentation.
If the proposed change is correct and you underreported income, you owe the additional tax plus a 20% accuracy-related penalty on the underpayment.15Internal Revenue Service. Accuracy-Related Penalty A well-documented Form 4852 with a detailed effort narrative helps establish good faith. Ignoring the notice leads to an automatic assessment and a bill. Respond by the date printed on it; if you agree and have nothing else to change, follow the notice’s payment instructions rather than filing an amended return.14Internal Revenue Service. State Returns
Most states with an income tax want a W-2 attached to the state return, and rules for substituting vary. Some accept a copy of your federal Form 4852, some publish their own substitute wage form, and a few will take pay stub data. Check your state tax agency’s website, and use the same wage and withholding figures on the state return that you used federally. Because IRS wage transcripts carry no state or local withholding, your pay stub may be the only place those numbers appear.7Internal Revenue Service. Transcript or Copy of Form W-2
