Mexico Border Zone Tax Incentives: ISR Credit, 8% IVA, and Enrollment

Businesses operating in Mexico’s designated northern and southern border municipalities can cut their corporate income tax (ISR) from 30% to an effective 20% and their value added tax (IVA) from 16% to 8% on qualifying transactions. Both Mexico border zone tax incentives were extended through December 31, 2026, by a decree published in the Diario Oficial de la Federación on December 31, 2025.1Diario Oficial de la Federación. Decreto por el que se modifican los diversos de estímulos fiscales región fronteriza norte y sur Access is not automatic. You have to enroll with the SAT, prove that at least 90% of your income comes from activity physically performed inside the zone, and renew every year. There is no guarantee of a further extension past 2026.

Which Municipalities Are Inside the Zones

The northern zone covers 43 municipalities across Baja California, Sonora, Chihuahua, Coahuila, Nuevo León, and Tamaulipas, tracking the U.S. border and including cities such as Tijuana, Ciudad Juárez, and Reynosa.2Servicio de Administración Tributaria. The southern zone covers 22 municipalities in Chiapas, Tabasco, Campeche, and Quintana Roo, along the borders with Guatemala and Belize.1Diario Oficial de la Federación. Blanco municipality of Quintana Roo, is also designated as a free-trade zone with additional commercial advantages. The precise list of qualifying postal codes matters for invoicing, because the SAT catalogs flag which codes sit inside the incentive zones.

Who Qualifies

The stimulus is open to individuals engaged in business activities and to legal entities formed under Mexico’s General Law of Commercial Companies, provided they actually operate within a designated zone.2Servicio de Administración Tributaria. Estímulos fiscales para la región fronteriza norte y sur The program is designed for businesses with a real physical presence, not remote operations claiming a paper address in the region.

Several categories of taxpayers are barred from the ISR credit:

  • Banks, credit unions, insurance companies, bonding institutions, and general deposit warehouses.
  • Taxpayers enrolled in the Simplified Trust Regime (RESICO), who cannot stack the border credit on top of already-reduced RESICO rates.
  • Farming, ranching, forestry, and fishing operations (AGAPES).
  • Production cooperative societies and the optional regime for corporate groups.
  • Maquiladoras and companies operating under the IMMEX manufacturing and export program, which already receive separate fiscal benefits including deferred import duties and IVA.
  • Entities in liquidation or with cancelled tax IDs.

Transport companies face specific limitations so that the incentive reaches stationary businesses rooted in the border economy rather than pass-through operations. Taxpayers flagged under Article 69-B of the Federal Fiscal Code for issuing invoices tied to nonexistent transactions are permanently disqualified.3Procuraduría de la Defensa del Contribuyente. The ISR Credit and the 90% Income Rule

The income tax incentive is a credit equal to one-third of the ISR owed, applied to both annual returns and provisional monthly payments.2Servicio de Administración Tributaria. Estímulos fiscales para la región fronteriza norte y sur Against Mexico’s 30% corporate rate, the credit produces an effective 20%. If your tax on border income would be 300,000 pesos, the credit cuts it to 200,000.

The catch sits in the 90% threshold. At least 90% of your total income for the fiscal year must come from activities physically performed inside the authorized zone.2Servicio de Administración Tributaria. Estímulos fiscales para la región fronteriza norte y sur Income from intangible assets or digital commerce does not count toward that threshold unless you can tie it to a specific physical presence within the zone. You also have to show the SAT that you have the economic capacity, assets, and physical facilities to carry out your operations there.4Gobierno de México. Decreto de Estímulos Fiscales Región Fronteriza Norte Your CFDI invoices, accounting records, and asset registrations need to reflect that consistently, and separating border from non-border income in your books is essential because auditors will trace revenue line by line.

Established businesses must show a tax domicile inside the zone for at least 18 months before applying.2Servicio de Administración Tributaria. Estímulos fiscales para la región fronteriza norte y sur New operations can qualify by demonstrating asset investment in the zone instead, and should expect closer scrutiny of that investment documentation during review.

The IVA Reduction and How to Get 8% on Your Invoices

The IVA incentive is a 50% credit against the standard 16% rate, bringing the effective rate on qualifying transactions to 8%.2Servicio de Administración Tributaria. Estímulos fiscales para la región fronteriza norte y sur It covers sales of tangible goods, independent professional services, and temporary leasing of property, when the transaction physically takes place inside the northern or southern zone. It does not cover sales of intangible goods or digital content provided by foreign residents.

Once your IVA notice is filed, you can start issuing invoices at 8% approximately 72 hours later.5Servicio de Administración Tributaria. Estímulo Fiscal Región Fronteriza Norte 8% IVA Factura Electrónica Three CFDI fields have to be configured correctly:

  • The rate field (TasaOCuota) must use the catalog value “IVA Crédito aplicado del 50%,” which corresponds to a rate of 0.080000.6Servicio de Administración Tributaria. Estímulos fiscales para la región fronteriza norte – IVA – Que necesito para facturar
  • The product or service code (c_ClaveProdServ) must carry the “Estímulo Franja Fronteriza” marker in the SAT catalog. The generic code 01010101 will not work, except on global invoices issued to the general public.
  • The postal code (c_CodigoPostal) registered as the place of issuance must also carry the border-zone marker.

Your Authorized Certification Provider (PAC) validates these fields automatically and checks whether your RFC has been enabled for the stimulus in the SAT’s taxpayer registry. If your enrollment is not in order, the invoice is rejected with a capture error rather than passing an unauthorized 8% rate through.

How to Enroll

Four prerequisites need to be in place before you start:

  • An active e.firma, the encrypted electronic signature valid for four years used to authenticate submissions to the SAT.7Servicio de Administración Tributaria. Firma Electrónica Avanzada (e.firma)
  • An active Tax Mailbox (Buzón Tributario), the SAT’s official channel for delivering notices and resolutions.
  • A positive Opinion of Compliance under Article 32-D of the Federal Fiscal Code, confirming no outstanding tax debts.8Servicio de Administración Tributaria. Obtén tu Opinión del cumplimiento de obligaciones fiscales
  • An active Digital Seal Certificate for issuing CFDIs, not restricted or cancelled.

For the IVA reduction, file the “Aviso para aplicar el estímulo fiscal del IVA” through the SAT portal, logging in with your e.firma and linking your domicile branch to the request with precise location data that the SAT matches against the federal taxpayer registry.9Servicio de Administración Tributaria. Estímulos fiscales para la región fronteriza norte – IVA – Inscripción The system processes IVA notices in about 72 hours.

The ISR credit is separate. It requires enrollment in the “Padrón de beneficiarios del estímulo para la región fronteriza.”4Gobierno de México. Decreto de Estímulos Fiscales Región Fronteriza Norte Review is more thorough, because SAT officials verify the 90% income threshold, your physical presence, and your economic capacity in the zone. The portal auto-populates representative information from your e.firma, but every field has to match your tax ID certificate exactly or the application is rejected automatically.

Final resolutions for both applications land in your Tax Mailbox. Failure to respond to clarification requests within the allotted time results in automatic rejection.

Renewing Every Year

Enrollment is not a one-time event. To keep the incentive, you have to file a renewal notice by March 31 of each fiscal year.4Gobierno de México. Decreto de Estímulos Fiscales Región Fronteriza Norte Miss it and you lose the benefit for the entire year. There is no grace period.

Beyond the renewal filing, the SAT runs a real-time verification program. Beneficiaries were previously required to provide information every six months; the current rule is annual verification.4Gobierno de México. Decreto de Estímulos Fiscales Región Fronteriza Norte The SAT checks that you still maintain the economic capacity, assets, and facilities to operate in the border zone, and that income continues to meet the 90% threshold.

What Costs You the Incentive

Removal from the Registry of Beneficiaries is not merely administrative. If the SAT strikes you off, the incentive is lost retroactively for the entire fiscal year.3Procuraduría de la Defensa del Contribuyente. Estímulo Fiscal en la Región Fronteriza Norte y Sur Within the following month you must file amended returns without the stimulus, pay the full tax you would have owed, and pay it updated for inflation plus surcharges calculated from the date you originally filed each return. A business that has been paying an effective 20% all year suddenly owes the difference back to 30%, with adjustments on top.

The most common triggers for revocation are:

  • Failing real-time verification, when the SAT detects irregularities during its annual review and you cannot resolve them within the 10-day response window.3Procuraduría de la Defensa del Contribuyente. Estímulo Fiscal en la Región Fronteriza Norte y Sur
  • Being listed under Article 69-B for transactions with companies presumed to issue invoices for nonexistent operations.
  • A restricted or cancelled Digital Seal Certificate that prevents you from issuing valid CFDIs.
  • Missing the March 31 renewal deadline.
  • Losing physical presence, meaning the economic capacity, assets, and facilities needed to operate within the zone.
  • Any outstanding tax debt or unfiled return.

The 10-day verification response window is the tightest deadline in the program. If SAT correspondence sits in a Tax Mailbox that only gets checked weekly, that deadline can pass before anyone notices. Given that the penalty is retroactive loss of the entire year’s benefit, daily monitoring of the mailbox is the practical baseline for anyone using these incentives.
