The Lumbee Tribe of North Carolina achieved full federal recognition in December 2025, when the Lumbee Fairness Act was signed into law as part of the National Defense Authorization Act for Fiscal Year 2026.1Thom Tillis, U.S. Senator for North Carolina. Lumbee Recognition Legislation Signed into Law Recognition makes the tribe’s more than 55,000 enrolled members eligible for the federal programs and protections that come with tribal status, and it establishes a government-to-government relationship between the Lumbee and the United States for the first time.2The White House. Federal Recognition of the Lumbee Tribe of North Carolina The Lumbee are the largest tribe east of the Mississippi and the ninth-largest in the country.
The 1956 Law the New Act Undid
To understand what recognition means for the Lumbee, it helps to know what they had before. Congress passed Public Law 84-570 in 1956, formally naming the group the “Lumbee Indians of North Carolina.”3govinfo. 70 Stat. 254 – An Act Relating to the Lumbee Indians of North Carolina In the same statute, Congress added that nothing in the law made the tribe eligible for services the United States provides to Indians and that no federal Indian statutes would apply to them.4Congress.gov. Public Law 84-570 – An Act Relating to the Lumbee Indians of North Carolina
That sentence created a legal box that lasted 69 years. The Lumbee were Indians by act of Congress but were locked out of Indian Health Service care, Bureau of Indian Affairs programs, trust land protections, and the government-to-government relationship other recognized tribes hold. The 2025 law strikes that exclusion and extends full recognition.5Congress.gov. S.107 – Lumbee Fairness Act
What the Tribe and Its Members Get
Recognition changes the Lumbee’s status across three main areas.
Federal Services and Health Care
Lumbee members are now eligible for the same federal services available to citizens of other recognized tribes, including Indian Health Service care and Bureau of Indian Affairs programs.5Congress.gov. S.107 – Lumbee Fairness Act IHS access is the largest tangible benefit for individual members. A 2009 Congressional Budget Office estimate assumed roughly 31,000 Lumbee members would use IHS at about $4,000 per person; the current numbers will run higher because of population growth and healthcare cost inflation.6Congressional Budget Office. S. 1735 Lumbee Recognition Act The Lumbee already qualified for certain federal programs through the Departments of Education, Housing and Urban Development, and Agriculture based on state recognition, so those are not new.
Land Into Trust
The Secretary of the Interior is authorized to take land into trust for the tribe’s benefit. Land within Robeson County is treated as an on-reservation acquisition, which is a lighter procedural path than an off-reservation trust application.5Congress.gov. S.107 – Lumbee Fairness Act When land is taken into trust, the United States holds legal title while the tribe holds beneficial use, and the land is exempt from state and local taxation.7Office of the Law Revision Counsel. 25 USC 5108
Government-to-Government Relationship
Federal recognition triggers a trust responsibility, meaning the United States takes on a legally enforceable duty to protect tribal lands, assets, and resources.8Indian Affairs. What Is the Federal Indian Trust Responsibility? It also triggers consultation. Federal agencies must consult with tribal leaders before actions that could affect tribal territory or cultural resources.9Indian Affairs. What Is Tribal Consultation Federal projects and policy decisions affecting Robeson, Hoke, Cumberland, and Scotland Counties will require Lumbee input going forward.
The Jurisdictional Carve-Out
The Lumbee Fairness Act contains an unusual provision worth understanding. North Carolina retains criminal and civil jurisdiction over trust land held for the Lumbee.5Congress.gov. S.107 – Lumbee Fairness Act That is a departure from the default framework, where federal and tribal authority generally displaces state jurisdiction on trust land. The practical consequence is that the Lumbee’s relationship with state and local governments, on questions like land use, law enforcement coordination, and taxation of non-trust property, will look different from tribes where tribal and federal courts hold primary authority.
What the Law Does Not Address
The statute contains no explicit provisions on gaming. Whether the Indian Gaming Regulatory Act applies to the Lumbee on the same terms as other tribes will depend on how the trust-land and jurisdictional provisions interact with existing gaming law. If you are looking at recognition as a signal about a Lumbee casino, the law itself does not answer that question.
What Happens Next
Recognition is now law, but standing up services takes time. The Interior Department must work with the tribe to process land-into-trust applications, set up BIA service delivery, and coordinate IHS healthcare access for tens of thousands of newly eligible members. Earlier versions of the recognition bill contemplated a tribal roll verification period of at least a year after enactment before budgets and services would be submitted to Congress.10U.S. Government Publishing Office. Senate Report 109-334 – Lumbee Recognition Act Individual members should expect an implementation window before IHS enrollment and other programs are fully operational.
Recognition also arrived over objection from within Indian Country. The Eastern Band of Cherokee Indians opposed the bill, with its principal chief arguing that congressional recognition bypasses the BIA’s Office of Federal Acknowledgment, which handles the genealogical and historical review that petitioning tribes normally undergo under 25 C.F.R. Part 83.11eCFR. 25 CFR Part 83 – Procedures for Federal Acknowledgment of Indian Tribes Congress has plenary authority over tribal affairs under the Indian Commerce Clause and can recognize a tribe by statute regardless of the administrative process,12Congress.gov. Scope of Commerce Clause Authority and Indian Tribes and that is the authority it used here. The recognition itself is settled; how it functions in practice will be worked out over the next several years.
