Living Quarters Allowance: Eligibility, Calculation, and Tax Rules

The Living Quarters Allowance is a reimbursement paid to eligible U.S. federal civilian employees assigned overseas, covering rent, utilities, and certain other residential costs up to a ceiling set for each post. Federal law authorizes the allowance only when the government does not provide quarters free of charge at your post.1Office of the Law Revision Counsel. 5 USC 5923 Quarters Allowances The detailed rules governing how it is granted, calculated, and reconciled sit in the Department of State Standardized Regulations (DSSR), which every federal agency follows. What you actually receive depends on where you serve, your pay grade, and your family size.

Who Qualifies

Eligibility turns almost entirely on where and how you were recruited. The DSSR draws a sharp line between people recruited inside the United States and people recruited overseas.

If your agency hired you in the United States, Puerto Rico, the Northern Mariana Islands, or another U.S. possession and then sent you abroad, you generally qualify.2U.S. Department of State. Department of State Standardized Regulations (DSSR) – Section 031.11 The relevant fact is the place of recruitment, not necessarily where you were living at the time.

Employees recruited while already overseas face stricter conditions. Your residence at the foreign post must be directly attributable to your federal employment, and before that appointment you must have been recruited in the U.S. by the federal government, a U.S. firm, an international organization with U.S. participation, or a foreign government under conditions that included return transportation to the United States.3U.S. Department of State. Department of State Standardized Regulations (DSSR) – Section 031.12 The agency head can also authorize eligibility if the job required you to relocate. People who moved abroad on their own and then found federal work rarely clear these hurdles.

One boundary matters even for otherwise eligible employees: if the government provides quarters at no charge, LQA is unavailable. The authorizing statute limits the allowance to situations where government-owned or government-rented quarters are not provided free.1Office of the Law Revision Counsel. 5 USC 5923 Quarters Allowances Declining assigned government housing to lease your own place can cost you the allowance, so confirm the consequences with your HR office before turning quarters down.

Switching agencies while stationed overseas is another point where people get tripped up. The DSSR defines a transfer as a move within the same agency, so a move to a different federal agency starts fresh.4U.S. Department of State. Department of State Standardized Regulations (DSSR) – Section 040q The new agency runs its own eligibility determination rather than inheriting the prior grant.

What the Allowance Covers

LQA reimburses specific residential costs. It is not a lump-sum stipend you can spend as you like, and it cannot exceed the maximum rate published for your post.

Concierge and maid services, private security, furniture rental, parking or garage rental, and property renovation costs do not qualify. Telephone and internet service stay your personal responsibility. Refundable security deposits are also excluded from any advance payment on your allowance, so budget separately for the deposit even if you are approved for an advance.7U.S. Department of State. Department of State Standardized Regulations (DSSR) – Section 113.3c

How the Amount Is Calculated

Your payment is the lesser of your actual allowable costs or the published maximum rate for your post. Three variables set that maximum: post location, quarters group, and family status.6U.S. Department of State. Department of State Standardized Regulations (DSSR) – Section 134

Every overseas post has its own ceiling, published in the DSSR Section 920 table and updated periodically as local rental markets and exchange rates shift.8U.S. Department of State. Allowances by Location DSSR 920 Your federal pay grade determines your quarters group, and each group carries a different maximum rate at each post; higher-graded employees are assigned to lower-numbered groups with higher ceilings.9General Services Administration. HRM 9592.1B Allowance and Differentials Payable in Foreign Areas The 920 table also publishes separate rates for employees serving with and without family, and additional dependents beyond a spouse can generate incremental increases.

When Both Spouses Work for the Federal Government

Two federal civilian employees who are married or in a domestic partnership cannot both claim the full family rate. One partner receives the with-family rate and the other receives the without-family rate. If the couple has no other family members, each simply receives the without-family rate.10U.S. Department of State. Department of State Standardized Regulations (DSSR) – Section 134.13 When one spouse is active-duty military drawing a quarters allowance, the civilian employee receives only the without-family rate. If the military spouse draws no housing allowance and is not in government quarters, the civilian may receive the with-family rate plus applicable increments.

Subletting any part of your quarters triggers a reduction. The agency head is required to reduce or withhold LQA when an employee sublets or contracts out any portion of the residence, and agencies may inspect quarters to verify.11U.S. Department of State. Department of State Standardized Regulations (DSSR) – Section 134.2

If You Own Your Home Overseas

Buying a home at post does not disqualify you, but the calculation changes. The rental portion is capped at 10 percent of the original purchase price, converted to U.S. dollars at the exchange rate on the purchase date, and claimable annually for a maximum of ten years.12U.S. Department of State. Department of State Standardized Regulations (DSSR) – Section 130 After the ten-year window closes, the rental portion stops, though you remain eligible for the utility portion covering heat, electricity, water, garbage disposal, and land rent. Agency heads may extend the rental portion beyond ten years in unusual circumstances, but approvals are rare.

The clock does not reset. Selling and rebuying, gifting the property to a family member, or swapping for a different home within commuting distance of the same post will not restart the ten years. LQA is also not authorized for building a new home or for a property acquired through inheritance or marriage.13U.S. Department of Defense. Army in Europe Regulation 690-500.592 Civilian Personnel Overseas Allowances Expect your agency to require the original purchase date, the exchange rate at purchase, the number of years already claimed, and disclosure of any prior LQA payments you or your spouse received for owned property overseas.

How to Apply

The application centers on Standard Form SF-1190, the Foreign Allowances Application, Grant, and Report.14U.S. Department of State Foreign Affairs Manual. 3 FAH-1 H-3210 Allowances You will use the same form later to revise the grant, report actual expenses, and terminate the allowance when you leave.15General Services Administration. SF-1190 Foreign Allowances Application, Grant and Report

Submit with the form:

  • A signed lease showing exact start and end dates and the monthly rent.
  • Utility cost estimates broken out by category, typically based on landlord or prior-tenant figures.
  • Certified translations of any documents in a foreign language.

Every figure on the SF-1190 must match the lease and supporting documents exactly. Discrepancies are the most common reason applications come back for revision, so line up each entry against its source before submitting.

Most employees arriving at a new post first receive a Temporary Quarters Subsistence Allowance (TQSA) for hotel and meal costs while they search for housing. TQSA and LQA cannot run at the same time. TQSA ends the day you move into permanent quarters, and LQA starts the following day. The agency head can authorize a three-day overlap when you need time to receive and arrange household goods after moving in.16U.S. Department of State. Department of State Standardized Regulations (DSSR) – Section 132.11d Outside that scenario, plan your move-in date to avoid either a gap or an unauthorized overlap.

Annual Reconciliation and Overpayments

Initial LQA payments are based on your estimated costs. The DSSR requires reconciliation at the end of each annual reporting period, or at termination of the grant, whichever comes first.17U.S. Department of State. Department of State Standardized Regulations (DSSR) – Section 134.16 At reconciliation, you submit actual receipts and paid invoices, and the agency compares what you spent to what it paid you.

If actual costs were lower, the agency collects the difference. If they ran higher but stayed within the post maximum, you may receive a supplemental payment. You must also produce receipts or other satisfactory proof of expenses whenever the granting officer asks.18U.S. Department of State. Department of State Standardized Regulations (DSSR) – Section 132.5 Keeping utility records organized through the year is the simplest way to avoid trouble.

Overpayments become federal debts. Once reconciliation shows the government paid you more than your actual costs justified, you will receive a notice of indebtedness, which triggers your right to request an administrative review, negotiate a repayment plan, or apply for a waiver.19U.S. Department of State Foreign Affairs Manual. 4 FAM 490 Debt Collection Repayment plans generally aim to resolve the debt within 36 months. Ignoring the notice lets the government offset the debt against your salary, tax refunds, retirement payments, and travel reimbursements, and interest and penalties begin accruing after 30 days.

If you believe the overpayment resulted from an agency error rather than your own misreporting, you can request a waiver under the federal statutes covering erroneous payments of pay and allowances. Collection activity, including interest, pauses while a waiver request is under review. Employees who separate while a dispute is pending should expect the agency to withhold the full debt from final salary and leave payouts, refunding it later if the waiver is approved.

When LQA Ends

The grant terminates on the earliest applicable date:

Once the grant ends, the agency runs a final reconciliation. Any overpayment identified at that point becomes a debt on the terms described above.

Tax Treatment

LQA is excluded from federal income tax. Internal Revenue Code Section 912 exempts foreign areas allowances received by civilian government employees under the Overseas Differentials and Allowances Act, the statute authorizing LQA.23Office of the Law Revision Counsel. 26 U.S. Code 912 – Exemption for Certain Allowances The exclusion applies to allowances, not to post differentials, which remain taxable.24Internal Revenue Service. Allowances, Differentials, and Other Special Pay In practice, LQA does not appear as taxable wages on your W-2, and you take no special election to claim the exclusion. If you receive both LQA and a post differential, only the LQA portion is tax-free.
