Line of Duty Determination: Findings, Benefits, and Appeals

A Line of Duty determination is the Department of Defense’s administrative finding on whether a service member’s injury, illness, or death happened during authorized military service and without the member’s own misconduct. The finding is what turns a medical event into a covered one: it controls access to military medical care, incapacitation pay, and future VA disability compensation. For Reserve and National Guard members, whose service happens in short duty periods, it is often the single document separating a covered condition from an uncovered bill.

When a Line of Duty Investigation Is Required

An LOD investigation becomes mandatory whenever a service member’s injury, illness, or disease causes permanent disability, death, or a duty interruption longer than 24 hours. For Reserve Component members, any condition that needs follow-on medical care after the duty period ends triggers the requirement too, even if the member felt fine when released.1U.S. Army Human Resources Command. Commander’s Line of Duty Smart Card

Guard and Reserve members run into the process far more often than active-duty counterparts. Their service happens in bursts: drill weekends, annual training, funeral honors duty. An injury during inactive-duty training needs immediate documentation to prove it happened in a federal duty status. Federal law entitles these members to medical and dental care for any condition incurred or aggravated in line of duty during such periods, including injuries sustained while traveling directly to or from the duty location.2Office of the Law Revision Counsel. United States Code Title 10 – 1074a Medical and Dental Care for Members on Duty Other Than Active Duty for More Than 30 Days

Commanders must open the investigation whether the injury happened on a military installation, in a civilian emergency room, or on a highway between home and the duty station. Incidents during unauthorized absence, or with suspected misconduct, get the more intensive formal review instead of the streamlined informal process.

Deadlines to Report and Request

Time matters here more than most service members realize. Under Army regulations, commands must open both informal and formal LOD investigations within five calendar days of discovering the injury, illness, or death. Waiting longer creates documentation gaps that undermine the finding.

On the member’s side, Reserve Component members generally have up to 180 days after completing a qualifying duty period to request an LOD determination. Miss that window and the request faces denial. Conditions with delayed onset get an exception, with post-traumatic stress disorder the most common example, because symptoms may not surface until well after the duty period. Those requests are reviewed on their merits even past the 180-day mark.3HQ RIO. Line of Duty Determination Frequently Asked Questions

The practical point: report every injury to your chain of command before you leave the duty location, even if it seems minor. A tweaked knee during a ruck march can become a chronic condition six months later, and by then, proving it happened on duty is much harder without a contemporaneous report.

Informal and Formal Investigations

Not every LOD gets the same level of scrutiny. The process splits into two tracks based on the complexity of the incident and whether misconduct is in play.

Informal Investigations

When the connection between the injury and military service is straightforward, such as a fall during physical training or an equipment injury during a field exercise, the immediate commander handles it informally. The commander reviews the documentation, a medical officer confirms the clinical findings match the reported circumstances, and the file moves through the administrative chain. Under current Army timelines, informal investigations must finish within 60 days of the incident, with progress updates sent to the Casualty Assistance Center every 30 days.1U.S. Army Human Resources Command. Commander’s Line of Duty Smart Card

Formal Investigations

Complex cases get a formal investigation. Motor vehicle accidents, potential self-inflicted injuries, incidents involving alcohol, and any situation where misconduct may have played a role all land here. The appointing authority selects an investigating officer who runs a detailed inquiry, interviewing additional witnesses, obtaining police reports, and compiling a full evidentiary record. The legal office reviews the file for sufficiency before the review authority renders a final determination. Formal investigations have a 180-day completion window.1U.S. Army Human Resources Command. These specific timelines come from Army Directive 2022-04. Other service branches set their own deadlines, though the general pattern of faster informal, extended formal, holds across the DoD.

The Four Possible Findings

Every completed LOD ends with one of four designations, each with different consequences.

  • In Line of Duty. The injury or illness occurred during authorized military service and was not the result of the member’s misconduct. This is the finding that opens the door to medical care, incapacitation pay, and future VA claims.4Department of Defense. DoD Instruction 1241.01 – Reserve Component Line of Duty Determination
  • Not in Line of Duty, Not Due to Own Misconduct. The condition was not connected to military duties, but the member was not at fault. This commonly applies to injuries during authorized leave or pass. It limits eligibility for certain military medical benefits without the penalty implications of a misconduct finding.
  • Not in Line of Duty, Due to Own Misconduct. The injury resulted from willful misconduct or gross negligence. This is the worst outcome. It can disqualify the member from LOD medical care and from incapacitation pay.2Office of the Law Revision Counsel. United States Code Title 10 – 1074a Medical and Dental Care for Members on Duty Other Than Active Duty for More Than 30 Days
  • Existed Prior to Service. The condition was present before entering military service. This is not the end of the road. If the investigation finds evidence that military service aggravated the preexisting condition beyond its natural progression, the finding can be changed to reflect service-connected aggravation.4Department of Defense. How Misconduct, Alcohol, and Mental Health Factor In

The line between an honest accident and misconduct is where most contested LOD findings live. Understanding the standards investigators apply helps anticipate how a case will be evaluated.

Willful Misconduct

The VA defines willful misconduct as deliberate wrongdoing with knowledge of, or reckless disregard for, the likely consequences. A minor traffic violation alone does not automatically amount to misconduct; a technical violation of a traffic law without more is not enough.5eCFR. Title 38 CFR 3.1 – Definitions Combine speeding with alcohol, distracted driving, or running a red light, and the combination can support a misconduct finding.

Alcohol and BAC Thresholds

In motor vehicle cases, the VA’s adjudication manual establishes three tiers for evaluating blood alcohol content:

  • 0.08 or higher: a presumption of intoxication is established.
  • 0.05 to 0.08: no presumption either way; the BAC is weighed alongside other evidence like driving behavior and witness accounts.
  • Below 0.05: the member is presumed not intoxicated.

A BAC above 0.08 does not automatically produce a misconduct finding, but it creates a strong presumption the member must overcome. Physical evidence such as skid marks, vehicle damage, and the position of vehicles after impact carries significant weight, especially when direct testimony is incomplete or conflicting.6Department of Veterans Affairs. M21-1 Part X Subpart iv Chapter 1 Section C – Willful Misconduct and Line of Duty

Self-Inflicted Injuries and Mental Unsoundness

Self-inflicted injuries are generally treated as misconduct, with an important exception. If the member was mentally unsound at the time, meaning unable to understand the consequences of the act or unable to resist the impulse, the injury is not classified as willful misconduct. A suicide attempt itself is considered evidence of mental unsoundness. When no other reasonable motive for the act can be established through the evidence, the determination defaults to mental unsoundness rather than misconduct. For the finding to support benefits eligibility, the underlying mental condition must itself connect to the member’s military service. Each case is evaluated individually using all available medical and lay evidence, and any reasonable doubt is resolved in favor of service connection.7eCFR. Title 38 CFR 3.302 – Service Connection for Mental Unsoundness in Suicide

What a Favorable Finding Unlocks

An LOD designation is not just paperwork. It is the gateway to concrete medical and financial benefits, and an adverse finding can close those doors, sometimes permanently.

TRICARE LOD Care

Reserve and Guard members with a favorable LOD finding receive TRICARE coverage for the specific injury, illness, or disease identified in the determination. Coverage lasts up to one year from the date of diagnosis and is limited to the documented condition. An LOD approved for a shoulder injury does not cover treatment for an unrelated knee problem.8TRICARE. Line of Duty Care for Service Members LOD care is not a lifetime benefit. If the condition needs treatment beyond one year, referral into the Disability Evaluation System may be necessary.

Incapacitation Pay

Reserve Component members who cannot perform military duties because of an LOD condition are entitled to the same pay and allowances as a regular-component member of the same grade and length of service, minus any civilian income earned during the same period. Members who can still perform military duties but lose civilian income because of the condition can receive partial incapacitation pay covering the demonstrated loss.9Office of the Law Revision Counsel. United States Code Title 37 – 204 Pay and Allowances Incapacitation pay is initially limited to six months but can be extended if the Secretary of the Military Department finds an extension is warranted.10Warrior Care. Wounded, Ill, or Injured Compensation and Benefits Handbook FY 2026

VA Disability Compensation

Federal law ties VA disability compensation directly to injuries or diseases “contracted in line of duty” during active military service. No compensation is paid if the disability resulted from the veteran’s own willful misconduct or abuse of alcohol or drugs.11Office of the Law Revision Counsel. United States Code Title 38 – 1110 Basic Entitlement for Wartime Disability Compensation A military LOD finding of “in line of duty” is binding on the VA unless it is patently inconsistent with VA regulations.5eCFR. Title 38 CFR 3.1 – Definitions An adverse military finding does not automatically bar a VA claim, because the VA conducts its own review and can reach a different conclusion, but it creates a significantly steeper burden of proof.

One Benefit a Misconduct Finding Does Not Affect

Servicemembers’ Group Life Insurance pays out regardless of the cause of death, including suicide. Benefits are only forfeited in narrow circumstances such as desertion, being absent without leave for more than 30 days, or a death inflicted as a lawful punishment.

Appealing an Adverse Determination

If an LOD comes back unfavorable, there are options, but the clock starts running immediately.

Rebuttal Through the Chain of Command

The first step is a formal rebuttal through the chain of command. In the Air Force Reserve, members have 30 days from the date they are notified of the adverse finding to submit a written appeal to their LOD Program Manager explaining why the determination should be changed.3HQ RIO. Line of Duty Determination Frequently Asked Questions Other branches have similar timelines. The rebuttal should include any new evidence: additional witness statements, updated medical records, or documentation that was missing from the original file. A military legal assistance attorney can be consulted at any point in the LOD process and matters most here, because a well-constructed rebuttal grounded in the regulation’s own standards is far more effective than a general narrative disagreement.

Board for Correction of Military Records

If the internal appeal is denied, each service branch maintains a Board for Correction of Military Records that can correct errors or remove injustices from a military record, including adverse LOD findings. A BCMR application must be filed within three years of discovering the error, though the board has authority to waive that deadline when justice requires it.12Office of the Law Revision Counsel. United States Code Title 10 – 1552 Correction of Military Records The BCMR is a civilian board within each military department, and its decisions carry the authority of the Secretary. For many service members, this is the last realistic avenue for overturning an adverse LOD before pursuing federal court review.
