A less than honorable discharge, formally called an Other Than Honorable (OTH) discharge, is the most serious administrative separation the military can issue without a court-martial. It is not a criminal conviction and will not appear on your criminal record, but it cuts off most veterans’ benefits and follows you onto background checks. If you have one or are facing one, you have procedural rights before it is finalized and, after the fact, two separate boards that can review it for an upgrade.
Where an OTH Sits Among Discharge Types
Military separations divide into administrative discharges, which commanders and separation boards decide, and punitive discharges, which only a court-martial can impose. An OTH is the lowest administrative characterization, below honorable and general (under honorable conditions). It is distinct from the two punitive characterizations, a Bad Conduct Discharge and a Dishonorable Discharge, both of which require a court-martial conviction.1eCFR. 38 CFR 3.12 – Benefit Eligibility Based on Character of Discharge
That distinction matters in one specific place: federal firearms law prohibits possession only for those discharged under dishonorable conditions, so an OTH does not trigger the federal firearms bar.2Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts State law may impose its own restrictions based on the underlying conduct.
What Leads to an OTH
Department of Defense policy authorizes an OTH characterization when the reason for separation involves a pattern of behavior or specific acts constituting a “significant departure” from the conduct expected of service members.3Department of Defense. DoDI 1332.14 – Enlisted Administrative Separations Common triggers include drug use, assault, abuse of a position of trust, security violations, arrest or conviction by civilian authorities, disobeying orders, and endangering other service members.
A single serious incident can be enough. Many OTH discharges, though, come from an accumulating record: repeated nonjudicial punishment (Article 15 actions) for minor infractions eventually becomes the pattern that justifies the more serious characterization.4The Judge Advocate General’s Legal Center and School. Criminal Law Deskbook – Nonjudicial Punishment
Your Rights Before an OTH Is Finalized
If your command is pursuing an OTH characterization, you have the right to have your case heard by an administrative separation board regardless of your length of service.3Department of Defense. DoDI 1332.14 – Enlisted Administrative Separations This protection does not apply to lesser characterizations for service members with under six years of service, so the OTH itself is what triggers your right to a hearing.
At the hearing, you can be represented by a military attorney at no cost or hire a civilian attorney. You can review the documents your command is relying on, obtain copies of your military records, and submit statements on your own behalf. The board decides both whether to separate you and what characterization to assign, and this is the best opportunity to argue for a general or honorable characterization instead of an OTH.
One important exception: if you accept a discharge in lieu of trial by general court-martial, you may receive an OTH without the standard board process. That trade avoids the risk of confinement and a punitive discharge, but the VA treats a discharge accepted in lieu of court-martial as a regulatory bar to benefits.1eCFR. 38 CFR 3.12 – Benefit Eligibility Based on Character of Discharge
What You Lose With an OTH
The VA does not automatically deny every benefit to every OTH veteran. It makes a “character of discharge” determination case by case. Most OTH recipients, though, lose access to the benefits that matter most.
GI Bill and Education
The Post-9/11 GI Bill statute limits eligibility to service characterized as honorable, or characterized as honorable by the branch when separation was for medical, hardship, or other qualifying reasons.5Office of the Law Revision Counsel. 38 USC 3311 – Educational Assistance for Service in the Armed Forces Commencing On or After September 11, 2001 An OTH does not qualify.
Disability Compensation and Pension
VA compensation, pension, and dependency benefits are payable only for service ending “under conditions other than dishonorable.” An OTH does not automatically meet that standard. Some circumstances create absolute statutory bars: desertion, 180 or more continuous days of unauthorized absence, and separation in lieu of a general court-martial all block benefits regardless of other factors. The VA can also apply regulatory bars for conduct involving moral turpitude, which generally includes felony convictions, or for “willful and persistent misconduct.” An insanity exception applies: if the VA finds you were insane at the time of the conduct that led to the discharge, none of these bars apply.1eCFR. 38 CFR 3.12 – Benefit Eligibility Based on Character of Discharge
VA Home Loans
The VA states that veterans with an OTH “may not be eligible” but can apply and have their records reviewed for a Certificate of Eligibility.6Department of Veterans Affairs. Eligibility for VA Home Loan Programs Approval turns on the VA’s individual review of the reasons for the discharge.
Unemployment Compensation
The federal Unemployment Compensation for Ex-Servicemembers (UCX) program requires separation under honorable conditions, so an OTH makes you ineligible.7U.S. Department of Labor. Unemployment Compensation for Ex-servicemembers Many veterans do not learn this until they file, creating a financial gap right at separation.
Reenlistment and Civilian Work
An OTH blocks reenlistment in most circumstances; waivers exist but are rarely granted without a successful upgrade first. In civilian employment, an OTH is not a criminal conviction and does not create a legal barrier to private-sector work, but it appears on background checks and carries weight with government contractors, law enforcement, and security employers. Time and a stable post-service record generally reduce that weight.
VA Healthcare You May Still Receive
Even with an OTH, certain VA healthcare remains available without standard VA enrollment:8Department of Veterans Affairs. What Benefits Can I Get If I Have an Other Than Honorable Discharge
- Treatment for service-connected conditions the VA has rated.
- Care for conditions related to military sexual trauma.
- Mental and behavioral health care if you served at least 100 days in a combat theater or piloted drones in one.
- Emergency mental health services during a crisis.
- Readjustment counseling at community-based Vet Centers.
These pathways exist because the conduct behind many OTH discharges has roots in the same conditions the services treat. If you have not tested what you qualify for, contact your nearest VA medical center or a Vet Center.
Applying for a Discharge Upgrade
Two boards handle upgrade requests, and which one you use depends on how long ago you separated.
Discharge Review Board
If your discharge was issued within the last 15 years, apply to your branch’s Discharge Review Board (DRB) using DD Form 293.9Office of the Law Revision Counsel. 10 USC 1553 – Review of Discharge or Dismissal The DRB reviews your case for propriety (whether the discharge was handled correctly under the rules at the time), equity (whether it was fair given all the circumstances), and clemency (whether post-service conduct warrants a different characterization).10Department of the Navy. Council of Review Boards – Naval Discharge Review Board
You can request a records-only review or a personal appearance. If you request a hearing and fail to appear without prior notice, you forfeit the appearance and the board decides on your file alone.11Department of Defense. DD Form 293 – Application for the Review of Discharge DRBs cannot review discharges resulting from a general court-martial sentence; those go to the corrections board.
Board for Correction of Military Records
If more than 15 years have passed, or you need relief the DRB cannot grant, apply to your branch’s Board for Correction of Military/Naval Records (BCMR or BCNR) using DD Form 149. These boards can correct any military record when the Secretary of the branch considers it necessary to fix an error or remove an injustice.12Office of the Law Revision Counsel. 10 USC 1552 – Correction of Military Records The statute sets a three-year filing window from discovery of the error, but the board can and regularly does waive that deadline when justice requires it.
Liberal Consideration for PTSD, TBI, and Military Sexual Trauma
If your misconduct was connected to PTSD, traumatic brain injury, or military sexual trauma, DoD “liberal consideration” guidance directs review boards to apply greater leniency.13Military Review Boards Agency. Kurta Memo – Clarifying Guidance Boards acknowledge that these conditions were less understood in earlier decades, that they affect behavior and decision-making, and that holding old cases to modern proof standards is unreasonable. You do not need a diagnosis from your time in service. A current diagnosis, evidence suggesting an undiagnosed condition at the time, or evidence of sexual assault or harassment that affected your behavior can all support the claim, so long as you connect the condition to the conduct that led to your discharge.14U.S. Army. DoD Offers New Policy Guidance for Veterans Discharge Upgrade Requests
Liberal consideration does not guarantee an upgrade. Boards still weigh the severity of the original misconduct.
Building the Application
Documentation is what moves these cases. Gather employment history, education records, community involvement, and character statements from people who know you well. If mental health played a role, obtain current medical records and a provider’s statement tying your condition to your service and the conduct at issue. Request your complete military personnel and medical records before filing; the DD Form 293 instructions recommend this to avoid processing delays.11Department of Defense. DD Form 293 – Application for the Review of Discharge DRB decisions typically take six to twelve months, and BCMR cases often longer. Free legal help is available through veterans legal clinics, legal aid organizations, and some veterans service organizations that focus on discharge upgrades.
