The Legion of Merit is one of the highest peacetime decorations awarded by the United States military, ranking just below the Defense Superior Service Medal. Congress established it on July 20, 1942 to recognize exceptionally meritorious conduct in outstanding service, and it remains the only U.S. military decoration issued in more than one degree.1Air Force’s Personnel Center. Who Can Receive It
Under 10 U.S.C. § 1121, the President may award the Legion of Merit to any member of the U.S. armed forces or of a friendly foreign nation who has distinguished themselves through exceptionally meritorious conduct since September 8, 1939, the date President Roosevelt declared a national emergency before U.S. entry into World War II.2Office of the Law Revision Counsel. 10 USC 1121 – Legion of Merit Award
The statute’s reference to “armed forces” covers all six U.S. branches: Army, Navy, Air Force, Marine Corps, Space Force, and Coast Guard.1Air Force’s Personnel Center. Legion of Merit It was also the first American decoration created with foreign recipients specifically in mind, which is why the degree system exists.
What Kind of Service Qualifies
The conduct being recognized has to clearly surpass what someone at the nominee’s rank would normally be expected to deliver. Doing a demanding job competently is not enough, no matter how senior the position. Reviewers look for sustained excellence over a significant period, or a singular achievement reflecting extraordinary dedication and skill.1Air Force’s Personnel Center. Legion of Merit
Most recipients hold positions of substantial responsibility where their decisions directly affect operations, policy, or readiness. Recommendation packages must include a written narrative tying the individual’s leadership or expertise to a specific mission or organizational result. General praise about professionalism, without documented outcomes, is the fastest way to get a packet returned.
One boundary worth flagging: the Legion of Merit is not a combat award. The “V” device denoting valor cannot be worn on it. Since January 2016, only four decorations authorize the “V” device — the Distinguished Flying Cross, Bronze Star Medal, Air Medal, and Air Force Commendation Medal.3Air Reserve Personnel Center. The Four Degrees for Foreign Recipients
When the Legion of Merit goes to a foreign national, the degree reflects the recipient’s level of responsibility rather than the nature of the service performed. The four degrees, from highest to lowest, are:4GovInfo. 32 CFR 578.8 – Legion of Merit
- Chief Commander, reserved for foreign heads of state or heads of government.
- Commander, awarded to individuals at the level of a U.S. military chief of staff or higher who are not heads of state.
- Officer, covering foreign general or flag officers, colonels serving in positions normally held by generals, and military attachés.
- Legionnaire, for all other eligible foreign military personnel.
These distinctions never apply to U.S. service members. An American four-star general and an American staff sergeant both receive the same Legionnaire-grade medal. The tiered system is a diplomatic protocol for recognizing foreign partners at a level appropriate to their standing.
How the Award Moves Through Channels
Executive Order 9260 gives the President authority to bestow the Legion of Merit, and that authority is delegated to senior military leaders for U.S. personnel.5The American Presidency Project. A recommendation originates with an officer who has personal knowledge of the nominee’s service and then travels up the chain with endorsements at each level.
A recommendation must enter military channels within two years of the act or period of service being recognized. Entering channels means the recommendation has been signed by the initiating official and endorsed by a higher official in the chain of command. If that window has closed, a path remains. Under 10 U.S.C. § 1130, a Member of Congress can ask the relevant military Secretary to review the proposal. Foreign award packets take a longer route. They require vetting through the Defense Intelligence Agency and concurrence from both the Under Secretary of Defense and the Department of State before reaching the Secretary of Defense for final approval.8U.S. Army Human Resources Command. The presentation itself usually happens at a formal military event such as a change of command or a retirement ceremony. A presiding officer reads the citation and pins the medal, which finalizes the official record.
Revocation and Posthumous Awards
A Legion of Merit can be revoked, but only under narrow circumstances. The awarding authority may rescind it if facts come to light that would have prevented approval had they been known at the time. The decision to revoke cannot be delegated. The recipient must be notified and has 10 working days to submit a statement of concurrence or objection. If the original awarding authority has moved on, the revocation request goes to U.S. Army Human Resources Command. Posthumous awards are permitted. In those cases, the medal is presented to a representative of the deceased as determined by the Secretary of Defense, or by the Secretary of Transportation for Coast Guard personnel not then operating under the Navy.10GovInfo. 10 USC Chapter 57 – Decorations and Awards The statute does not prescribe a next-of-kin priority list, leaving that call to the Secretary.
What the Medal Looks Like
The standard medal, which is the Legionnaire grade worn by all American recipients, is a five-pointed white enamel star bordered in purplish-red. A blue disc at the center holds thirteen white stars ringed by a laurel wreath, with crossed arrows between the arms of the star. The reverse is inscribed with “ANNUIT COEPTIS MDCCLXXXII” and “United States of America.” The ribbon is predominantly purplish-red with thin white edge stripes.4GovInfo. 32 CFR 578.8 – Legion of Merit
The physical form changes with each foreign degree.
