Lawsuit funding companies advance cash to plaintiffs with pending legal claims and get repaid out of the eventual settlement or judgment. The defining feature is that the advance is non-recourse: if the case loses, the plaintiff keeps the money and owes nothing. More than 200 firms now operate in the United States, and since 2018 over $2.7 billion in capital has flowed into consumer pre-settlement funding through securitized investment vehicles alone.1Legal Funding Journal. Consumer Pre-Settlement Litigation Funding: An Emerging Asset Class The trade-off for that no-repayment-if-you-lose guarantee is price. Rates commonly run 1 to 6 percent a month, and in most states these advances are not classified as loans, which keeps them outside usury caps and traditional consumer lending rules.2U.S. Government Accountability Office. How the Advance Works
The transaction is simple on its face. A plaintiff with an active lawsuit applies to a funding company, which then contacts the plaintiff’s attorney to evaluate the strength of the claim, its likely settlement value, and the expected timeline. No credit check, income verification, or collateral is required. If underwriting approves the case, the company sends money to the plaintiff, and repayment comes out of the eventual settlement or judgment.3USClaims. Pre-Settlement Funding
Approval is quick because the case file does the underwriting, not the borrower. After the plaintiff submits basic case details, the funder’s underwriters review documentation from the lawyer: police or incident reports, medical records, insurance claim details, and a case summary.4High Rise Legal Funding. Lawsuit Funding Eligibility Criteria Decisions can come within 24 to 48 hours, and funds are typically disbursed by direct deposit or check shortly after the agreement is signed.5Oasis Financial. Pre-Settlement Funding
Advance amounts stay conservative relative to the claim’s expected value. Plaintiffs generally receive between 10 and 20 percent of the estimated settlement, with individual advances usually ranging from $1,000 to $50,000.6Annuity.org. Pre-Settlement Funding1Legal Funding Journal. Consumer Pre-Settlement Litigation Funding: An Emerging Asset Class A Government Accountability Office report found that some funders advance closer to 7 percent of estimated case value to leave a comfortable cushion.2U.S. Government Accountability Office. Attorney cooperation is not optional. The lawyer must provide case documentation for underwriting, and in most arrangements the attorney signs the funding agreement and handles repayment directly from settlement proceeds. Without the attorney’s participation, the application cannot move forward.7Fair Rate Funding. Guaranteed Approval Lawsuit Loans
What It Costs
The non-recourse structure is the reason this money is expensive. Because the funder absorbs the total loss on cases that fail, it charges rates that would be extraordinary in ordinary lending. Annual rates can exceed 200 percent at the high end. More commonly, well-known companies charge between 1 and 6 percent per month, which annualizes to roughly 12 to 72 percent.8Enjuris. Lawsuit Loan Actual Cost9Tribeca Lawsuit Loans. Top Lawsuit Funding Companies in the US
Whether interest is simple or compounding matters enormously over the life of a case. With simple interest, charges accrue only on the original advance. With compounding, each period’s charges are added to the balance and the next period’s interest is calculated on the larger figure. On a $10,000 advance at 3 percent monthly, the total owed after two years is $17,200 under simple interest but $20,328 under compounding.8Enjuris. Lawsuit Loan Actual Cost Plaintiffs who sign compounding agreements on cases that drag on for years can find the funder’s share consuming most of their settlement.
Fees compound the problem. Origination, underwriting, processing, and administrative charges are common, and they are often rolled into the principal so that interest accrues on the fees themselves.10USClaims. How Does Interest Work on a Pre-Settlement Advance8Enjuris. Lawsuit Loan Actual Cost Some companies apply caps. USClaims uses a 2x cap, meaning a borrower will never owe more than double the original advance.3USClaims. Which Cases Qualify
Personal injury claims dominate consumer pre-settlement funding. Auto accidents, slip-and-fall cases, medical malpractice, and workplace injuries are the industry’s core business.2U.S. Government Accountability Office. Criminal cases and family law matters typically do not qualify. Workers’ compensation claims are funded by only a handful of companies and only in select states.5Oasis Financial. Pre-Settlement Funding Each application gets evaluated on its own, but the underwriting factors are consistent: clear evidence of the opposing party’s liability, documented damages, and an expected settlement large enough to cover the advance plus costs while still leaving meaningful money for the plaintiff.4High Rise Legal Funding. Risks Before You Sign
The central risk is arithmetic. Between the advance amount, accumulated interest, and fees, funders typically take 20 to 40 percent or more of the gross recovery, and they get paid before the plaintiff receives anything.16Institute for Legal Reform. What You Need to Know About Third-Party Litigation Funding When the settlement comes in smaller than projected, or the case drags on longer than expected, the plaintiff can walk away with little or nothing after the funder and the attorney are paid.
There is also an incentive problem baked into the structure. As interest accrues, the total owed to the funder grows, which can make it harder to accept a reasonable settlement offer and can pressure the plaintiff toward holding out for more, extending the financial stress the advance was meant to relieve.17Judicial Hellholes. Third-Party Litigation Funding
A few practical checks before signing help. Ask whether interest is simple or compounding. Ask whether the contract has a hard cap on total repayment. Ask whether fees are added to principal or charged separately. Ask whether the company is a direct funder or a broker. And have the attorney review the agreement before it goes back signed; the funder will already be talking to the lawyer, and the lawyer’s read on the terms is the closest thing to independent review the plaintiff will get.11Rockpoint Legal Funding. State Rules That May Affect Your Deal
For years the industry operated with minimal oversight. That has been changing since 2023, and where the plaintiff lives now genuinely matters.
New York’s Consumer Litigation Funding Act, signed by Governor Kathy Hochul in December 2025, is among the most protective. It requires funders to register with the state, caps total charges at 25 percent of the plaintiff’s gross recovery, gives consumers a 10-business-day right to cancel without penalty, and prohibits funders from influencing litigation strategy or paying referral fees to attorneys or medical providers. Contracts exceeding the rate cap are deemed usurious, and willful violations can trigger forfeiture of the funder’s right to collect plus civil penalties of up to $5,000 per violation.18New York State Senate. Other states have moved differently:
- Montana (2023). Requires disclosure of funding agreements to the court and all parties, mandates registration with the Secretary of State, caps funder recovery at 25 percent of the award or settlement, and prohibits rates above usury levels for consumer advances.17Judicial Hellholes. Third-Party Litigation Funding
- West Virginia (2024). Requires automatic disclosure of funding agreements to opposing parties and caps annual fees for consumer lawsuit lenders at 18 percent.17Judicial Hellholes. Third-Party Litigation Funding
- Indiana. Has regulated consumer legal funding since 2016, requiring state registration and imposing caps on interest rates and fees.17Judicial Hellholes. Third-Party Litigation Funding
- Louisiana (2024). Makes funding agreements subject to discovery, requires foreign funders to report to the Attorney General, and prohibits all funders from influencing litigation or settlement decisions.20Verisk. Louisiana Enacts New Third-Party Litigation Funding Law
According to the American Legal Finance Association, Oklahoma, Vermont, Nevada, Utah, Tennessee, and Indiana have all enacted consumer-focused licensing laws that include character-and-fitness reviews, mandatory bond posting, cancellation windows of at least five days, and requirements for annual public reporting of transactions and interest rates.21American Legal Finance Association. Court decisions have carved out further variation. Courts in Colorado, Kentucky, and North Carolina have ruled that litigation financing is a loan subject to state usury laws. Pennsylvania courts have struck down agreements under common-law champerty rules. Alabama courts have voided such agreements as a form of gambling against public policy.22Florida Senate. SB 1276 Bill Analysis Georgia went the other way. In Ruth v. Cherokee Funding (2018), the Georgia Supreme Court held that because repayment was contingent on the lawsuit’s success, the transactions were not loans and the state’s usury and payday lending laws did not apply.23FindLaw. Related Products That Are Not the Same Thing
Pre-settlement funding often gets confused with two adjacent products, and the differences matter. Post-settlement funding serves plaintiffs who have already won but face delays in receiving the money; the funder advances a portion of the known settlement and collects when payment arrives.24JG Wentworth. What Is Post-Settlement Funding Structured settlement transactions are different again: when a settlement pays out in periodic installments over years, a factoring company can purchase some or all of those future payments for an immediate lump sum. That is technically a sale, not a loan, and any company marketing it as a “structured settlement loan” is misrepresenting the transaction.25Annuity.org. Settlement Loans JG Wentworth is one of the better-known names in structured settlement purchasing, and it does not offer pre-settlement funding directly, brokering those leads to third parties instead.
