Why April 15
Federal law sets the deadline for individual income tax returns at April 15 of the year after the tax year ends.3Office of the Law Revision Counsel. 26 USC 6072 – Time for Filing Income Tax Returns When that date lands on a Saturday, Sunday, or legal holiday, the deadline moves to the next business day.4Office of the Law Revision Counsel. 26 USC 7503 – Time for Performance of Acts Where Last Day Falls on Saturday, Sunday, or Legal Holiday
In 2026, April 15 is a Wednesday, so no adjustment applies. Emancipation Day, a Washington, D.C. holiday that has bumped the federal deadline in past years because IRS headquarters is in the District, falls on Thursday, April 16, 2026. It doesn’t interfere with the Wednesday cutoff.
Proving You Filed on Time
If you mail your return, the postmark date counts as your filing date, even if the IRS receives it days later.5Office of the Law Revision Counsel. 26 USC 7502 – Timely Mailing Treated as Timely Filing and Paying That rule is less reliable than it sounds. Since late 2025, the Postal Service has been consolidating mail sorting at regional facilities, and a postmark now often reflects the day mail reaches an automated facility rather than the day you dropped it in a box. The gap can run one to three days.6Taxpayer Advocate Service. New US Postal Service Rules Could Affect Whether Your Tax Filing Is Considered on Time
If you’re mailing close to the deadline, go to a post office counter and get a receipt for certified or registered mail. Pre-printed postage labels from online services don’t serve as proof of your mailing date.6Taxpayer Advocate Service. Filing electronically avoids the issue. An e-filed return gets a timestamp the moment the IRS accepts it, and there’s no ambiguity about whether you beat the deadline.
If You Need More Time to File
Filing Form 4868 by April 15 gives you an automatic six-month extension. The form is brief, the IRS grants it automatically, and you don’t need to explain why.2Internal Revenue Service. Get an Extension to File Your Tax Return For the 2025 tax year, that pushes your filing deadline to October 15, 2026.
Here’s the catch most people miss: the extension only covers paperwork. It does not extend the deadline to pay. Any unpaid tax balance still accrues interest from April 15, and you can also face a late-payment penalty.7Internal Revenue Service. Form 4868 – Application for Automatic Extension of Time to File US Individual Income Tax Return
To avoid the late-payment penalty during the extension period, pay at least 90 percent of your actual tax liability by April 15. If you hit that threshold and pay the remaining balance when you file by October 15, the IRS won’t charge a failure-to-pay penalty.8Internal Revenue Service. Avoiding Penalties and the Tax Gap A return submitted during the extension period is treated as timely as long as Form 4868 was filed by April 15 and the return itself arrives by October 15.
What Happens If You Miss the Deadline
The IRS charges two separate penalties for late returns, and one is far more expensive than the other.
The failure-to-file penalty is 5 percent of the unpaid tax for each month or partial month the return is late, up to a maximum of 25 percent.9Office of the Law Revision Counsel. 26 USC 6651 – Failure to File Tax Return or to Pay Tax If the return is more than 60 days late, the minimum penalty is $525 or 100 percent of the unpaid tax, whichever is less.10Internal Revenue Service. Failure to File Penalty Even a return with a small balance can generate a steep penalty if you wait too long.
The failure-to-pay penalty is much smaller: 0.5 percent of the unpaid tax per month, also capped at 25 percent.9Office of the Law Revision Counsel. 26 USC 6651 – Failure to File Tax Return or to Pay Tax The practical rule: if you can’t pay what you owe, file the return anyway. Filing on time and paying late costs you roughly one-tenth of what filing late costs.
Interest accrues on any unpaid balance from the original due date, on top of both penalties. The rate is the federal short-term rate plus 3 percentage points, compounded daily.11Internal Revenue Service. Topic No 653, IRS Notices and Bills, Penalties and Interest Charges For the first half of 2026, that works out to 7 percent (January through March) and 6 percent (April through June).12Internal Revenue Service. Quarterly Interest Rates Interest has no cap. It runs until the balance is paid in full.
Who Gets Automatic Extra Time
Americans Living Abroad
U.S. citizens or resident aliens living outside the country whose main place of work is abroad get an automatic two-month extension to June 15 without having to request it.13Internal Revenue Service. US Citizens and Resident Aliens Abroad – Automatic 2-Month Extension of Time to File To use it, attach a statement to your return explaining that you qualified. Interest on any unpaid balance still runs from April 15, so the extra time helps with paperwork rather than payment.
Military in Combat Zones
Service members in a designated combat zone or contingency operation get far more generous relief. The entire period of service in the combat zone, plus 180 days after leaving, is disregarded when calculating tax deadlines.14Office of the Law Revision Counsel. 26 USC 7508 – Time for Performing Certain Acts Postponed by Reason of Service in Combat Zone or Contingency Operation Any filing time that remained when the service member entered the combat zone is added back. A soldier who deployed March 1 with 45 days left before April 15 has the clock pause during the deployment, then restart with those 45 days plus 180 more after returning.
Federally Declared Disaster Areas
When the President declares a federal disaster, the IRS can postpone filing and payment deadlines for affected taxpayers by up to one year.15Office of the Law Revision Counsel. 26 USC 7508A – Authority to Postpone Certain Deadlines by Reason of Federally Declared Disaster, Significant Fire, or Terroristic or Military Actions The relief is automatic for anyone with an address in the designated area, so you don’t need to call the IRS or file anything extra.
These extensions are tied to specific FEMA disaster declarations and apply only to the affected counties or regions. The IRS publishes a running list of active disaster relief announcements with the new deadlines and the exact localities covered.16Internal Revenue Service. Tax Relief in Disaster Situations If a recent hurricane, wildfire, or flood affected you, that page is the quickest way to check whether your deadline has moved.
State Filing Deadlines Are Separate
Most states with an income tax follow the federal April 15 deadline, but not all of them. A handful set later dates, some as late as May 15. Several states have no individual income tax at all. Filing a federal extension does not automatically extend your state deadline in every state, so check with your state’s department of revenue for the exact date and its own extension rules.
