Land Transaction Tax in Wales is the tax you pay when you buy property or land in Wales, collected by the Welsh Revenue Authority (WRA). It replaced Stamp Duty Land Tax (SDLT) on 1 April 2018, so if you’re buying in Wales, the SDLT rates quoted in most UK property guides don’t apply to you.1Welsh Government. Land Transaction Tax: Overview Rates for a main home start at 0% on the first £225,000 and climb in bands from there. Rates for anyone buying an additional residential property are considerably steeper and start biting at £180,000.
Rates for a Main Home
LTT works in slices, like income tax. You don’t pay one rate on the whole price; each portion of the price that falls into a band is taxed at that band’s rate, and your bill is the sum. The current main residential bands are:2Welsh Government. Land Transaction Tax Rates and Bands
- Up to £225,000: 0%
- £225,001 to £400,000: 6%
- £400,001 to £750,000: 7.5%
- £750,001 to £1,500,000: 10%
- Over £1,500,000: 12%
On a £300,000 home, the first £225,000 attracts no tax, and the remaining £75,000 is taxed at 6%. Total LTT: £4,500.
Higher Rates for an Additional Property
If you already own one or more residential properties when you buy another, a different set of bands applies. These rates target second homes, holiday lets, and buy-to-let purchases. Since 11 December 2024, they are:2Welsh Government. Land Transaction Tax Rates and Bands
- Up to £180,000: 5%
- £180,001 to £250,000: 8.5%
- £250,001 to £400,000: 10%
- £400,001 to £750,000: 12.5%
- £750,001 to £1,500,000: 15%
- Over £1,500,000: 17%
These aren’t a surcharge added onto the main rates. They are an entirely separate table with a lower starting threshold and higher percentages all the way up. The same £300,000 house that would cost £4,500 at main rates generates a bill of £25,200 at higher rates.
Married couples and civil partners are treated as a single unit for this test. If one partner owns a property, the other partner’s purchase is pushed into the higher-rate category. The couple counts as living together unless there’s a court order, a deed of separation, or circumstances showing the separation is permanent.3Welsh Government. Refund When Your Old Home Sells
The higher rates frequently catch people who are simply moving house and haven’t yet sold the old one on the day they complete on the new one. You pay the higher rates upfront, then claim a refund once the previous main residence sells, as long as that sale completes within three years of the new purchase.4Welsh Government. Claim a Refund of Land Transaction Tax Higher Rates The refund is the difference between the higher-rate bill and what you would have paid at main rates.
You claim through an online form to the WRA, with evidence of the sale (a signed TR1 for property in England or Wales) and the 12-digit Unique Transaction Reference Number from the original return. Processing usually takes 15 to 20 working days. Miss the three-year window and the higher-rate bill generally stands, although the WRA’s technical guidance allows a longer period in limited circumstances.
No First-Time Buyer Relief
If you’re moving from England and expecting a first-time buyer discount, there isn’t one. Wales offers no first-time buyer relief under LTT.1Welsh Government. Land Transaction Tax: Overview A first-time buyer in Wales pays exactly the same rates as anyone else buying a main home. The 0% band up to £225,000 is the relief, and it applies equally to everyone.
Non-Residential and Mixed-Use Rates
Commercial buildings, agricultural land, bare land, and mixed-use properties use their own table:2Welsh Government. Land Transaction Tax Rates and Bands
- Up to £225,000: 0%
- £225,001 to £250,000: 1%
- £250,001 to £1,000,000: 5%
- Over £1,000,000: 6%
A property that combines residential and non-residential elements — a shop with a flat above, or a farmhouse with commercially farmed land — is mixed-use and taxed at these rates.5Welsh Government. Land Transaction Tax for Non-Residential and Mixed Use Property The deciding question for land attached to a dwelling is whether it has been commercially exploited. A cottage with paddocks used for personal enjoyment is residential; the same cottage with paddocks farmed for profit may qualify as mixed-use.
Leases
New leases are taxed on two things: any upfront premium and the ongoing rent. The two are calculated separately and added together.6Welsh Government. Land Transaction Tax Leases: Technical Guidance The premium uses the standard residential or non-residential bands. One trap worth knowing: if the annual rent is £13,500 or more, the 0% band for the premium disappears, meaning tax applies from the first pound of premium.
The rent portion is taxed on the Net Present Value of the total rent across the lease term. For non-residential leases, the NPV bands are 0% up to £225,000, 1% between £225,001 and £2,000,000, and 2% above that. Most solicitors handling commercial leases will run the figures; the WRA’s online calculator will do it too.
When You Need to File a Return
The default is simple and strict: you must file an LTT return with the WRA for any land transaction, even when the tax due is zero.1Welsh Government. Land Transaction Tax: Overview A short list of transactions is fully exempt and needs no return at all:
- Property inherited under a will where you pay nothing for the transfer.
- Property transferred as part of a divorce or civil partnership dissolution.
- Freehold purchases below £40,000.
- A new or assigned lease of fewer than seven years, where the amount paid is below the relevant zero-rate threshold.
- A new or assigned lease of seven years or more, where the premium is under £40,000 and the annual rent is under £1,000.
Anything outside those categories needs a return filed, even if no tax is owed.
Deadline, Payment, and Your UTRN
You must file the return and pay the tax within 30 days of the day after the effective date of the transaction, which is normally your completion date.1Welsh Government. Land Transaction Tax: Overview In practice, your solicitor or conveyancer files through the WRA’s online portal. Individuals acting without a legal representative can file manually, though the online route is faster.
You’ll need the effective date, the property address, the full price (including any non-monetary consideration), and personal and tax details for all buyers and sellers. Pay by electronic transfer, CHAPS, or BACS; BACS payments need to be sent at least four working days before the deadline to arrive in time.7Welsh Revenue Authority. Pay Land Transaction Tax Once the return is processed, the WRA issues a 12-digit Unique Transaction Reference Number. Hold onto it. The Land Registry won’t register your title without it.
Penalties for Filing or Paying Late
Miss the 30-day deadline and a £100 fixed penalty hits straight away.8Welsh Government. Tax Penalties: Filing or Paying Late The costs climb from there:
- Six months late: another £300 or 5% of the unpaid tax, whichever is greater.
- Twelve months late: a further £300 or 5% of the unpaid tax, whichever is greater.
If the WRA concludes that information was deliberately withheld, penalties can reach up to 95% of the tax that should have been paid.9Welsh Government. Tax Collection and Management (Wales) Act 2016 Penalties: Technical Guidance Interest also accrues on unpaid tax at the Bank of England base rate plus 2.5%, running from the day the tax was due until the day it’s paid.10Welsh Government. Reliefs You May Be Able to Claim
Several reliefs reduce or remove LTT on qualifying transactions, but none is automatic. Each must be claimed on the return.
Charities buying property can claim full relief when they intend to use the property entirely for charitable purposes, or as an investment whose profits fund their charitable work. Partial relief is available where only part of the property qualifies, or where buyers include both a charity and a non-charity. A three-year clawback applies: if the property stops being used for charitable purposes within three years, the relief is withdrawn and a further return is due within 30 days of the disqualifying event.11Welsh Government. Land Transaction Tax Charities Relief: Technical Guidance
Group relief covers transfers of property between companies in the same corporate group, meaning one company is a 75% subsidiary of the other or both are 75% subsidiaries of a common parent. Relief is withdrawn if the buyer company leaves the group within three years while still holding the property, and arrangements already in place at the time of the transfer to move the buyer out of the group will block the relief entirely.12Welsh Government. Land Transaction Tax Group Relief: Technical Guidance
Keep Your Records for Six Years
Hold onto everything that supports your return — contracts, completion statements, correspondence about the price, and evidence for any relief claimed. Keep records for six years from the filing date of the return, or six years from the date of any amendment you made to it, whichever is later.13Welsh Government. Tax Collection and Management (Wales) Act 2016: Tax Returns, Enquiries and Assessments Technical Guidance If no return was required because the transaction was exempt, keep records for six years from the transaction date to prove the exemption applied. The WRA can open an enquiry within 12 months of the filing deadline, and in cases of careless or deliberate error can go back years further, so the six-year file is your protection if questions arrive later.
