L-2 Visa Work Authorization: EAD Rules After October 2025

If your spouse holds an L-1 visa, your L-2 visa work authorization is automatic. One boundary to name up front: only spouses get this. L-2 dependent children can live in the United States and attend school, but they cannot work in any capacity, and they lose L-2 eligibility entirely at age 21.2U.S. Citizenship and Immigration Services. What “Authorized Incident to Status” Means

Your right to work exists as soon as you’re admitted in L-2S status. You don’t have to file anything, and you don’t have to wait for a card. The authorization carries no restriction on the kind of work. You can take a salaried job, work part-time, freelance, or run your own business. There’s no requirement that your work relate to your spouse’s field or employer.

Proving It to an Employer on Form I-9

Every U.S. employer has to verify a new hire’s identity and work eligibility on Form I-9. For an L-2 spouse, the key document is the I-94 Arrival-Departure Record showing the class-of-admission code L-2S. That record counts as a “List C” employment authorization document. Retrieve your electronic I-94 at i94.cbp.dhs.gov, print it, and hand it to your employer.4U.S. Customs and Border Protection. I-94/I-95 Website An employer cannot legally insist on an EAD card when you present a valid I-94 with the L-2S code. Refusing to accept it can amount to document abuse under anti-discrimination rules.

If Your I-94 Was Issued Before January 30, 2022

CBP didn’t start using the L-2S code until early 2022. Older I-94s show a generic “L-2” that doesn’t distinguish spouses from children. If yours is one of those, present the I-94 together with the Form I-797A Notice of Action from USCIS identifying you as an L-2 dependent spouse. If Your I-94 Is Missing the “S”

If you were admitted after January 2022 but the I-94 still reads “L-2” without the “S,” that’s an error you need to fix, because it will block your ability to prove authorization. Remote Employers

If your employer is based in another state and can’t meet you in person, they can complete document verification remotely only if they’re enrolled in E-Verify. Do You Still Need an EAD?

No, not to work. Some L-2 spouses apply for one anyway because the plastic EAD card is a photo ID that doubles as standalone proof of identity and work authorization (a “List A” document on the I-9). It can smooth things over with employers unfamiliar with the L-2S rules, and it works as a secondary government-issued ID for banks and other institutions.3U.S. Citizenship and Immigration Services. 7.9.2 L Nonimmigrant Status

To apply, file Form I-765 online or by mail, and select eligibility category (a)(18), the spouse of an L nonimmigrant.7U.S. Citizenship and Immigration Services. USCIS will send a Form I-797C receipt notice with a case number.10U.S. Citizenship and Immigration Services. What Changed on October 30, 2025

DHS eliminated the automatic 540-day extension that used to keep an expiring EAD valid while a renewal was pending. For EAD renewals filed on or after October 30, 2025, the old card expires on its face date with no automatic bridge.12Federal Register. For L-2 spouses specifically, this is less alarming than it sounds. Your authorization comes from your status, not from the card. You can keep working after the EAD expires as long as your L-2 status remains valid; you just switch to using your unexpired I-94 with the L-2S code for I-9 purposes. Getting a Social Security Number

You need an SSN before you can appear on a payroll, file taxes, or open certain financial accounts. Two paths get you there.

If you’re applying for an EAD anyway, check the data-sharing boxes on Form I-765. If the application is approved, SSA will issue your number and mail the card automatically, no separate trip needed.13U.S. Citizenship and Immigration Services. Application for Employment Authorization

If you’re skipping the EAD, apply directly with SSA. Start the application at ssa.gov and schedule an in-person appointment at a local Social Security office. Bring your unexpired passport and your I-94 showing the L-2S class of admission; together those documents establish your identity, age, and work-authorized status.14Social Security Administration. Electronic verification is usually fast, but manual review can add several weeks.

How Long Your Authorization Lasts

Your work authorization is tied directly to your L-2 status, which mirrors your spouse’s L-1. When the L-1 expires, so does the L-2, and with it your right to work.2U.S. Citizenship and Immigration Services. USCIS Policy Manual – Volume 2 – Part L – Chapter 2 L-1A visas (managers and executives) can be extended up to a total of seven years. L-1B visas (specialized knowledge workers) top out at five.

If your spouse’s employer files an extension, your L-2 extends with it. The same is true of a new I-94 issued after international travel. If your spouse changes jobs or the employer withdraws the petition, matters get harder: once the L-1 terminates, your L-2 status and work authorization end too. There’s no independent grace period for L-2 work authorization that survives the loss of the underlying L-1.12Federal Register. That dependency is the single biggest structural risk for an L-2 worker. If you’re building a career, taking on clients, or paying for a professional license, keep close tabs on your spouse’s petition dates.

Taxes on Your L-2 Earnings

Earning income in the United States triggers federal tax obligations regardless of visa type. Your employer will withhold federal income tax, Social Security tax (6.2%), and Medicare tax (1.45%) from each paycheck, the same as for any other worker.15Internal Revenue Service. Whether you file as a resident or nonresident alien depends on how long you’ve been in the country, usually determined by the substantial presence test. Resident aliens face the same self-employment tax rules as U.S. citizens, so freelance or business income carries a 15.3% self-employment tax. Nonresident aliens are not subject to self-employment tax but still owe income tax on U.S.-sourced earnings.15Internal Revenue Service. If your home country has a totalization agreement with the United States, you may be exempt from being taxed on Social Security twice. The IRS recognizes agreements with roughly 30 countries. Check whether your country of citizenship is covered before assuming both nations will tax the same earnings.
