The L-1B visa to green card timeline runs about two to four years for applicants born in most countries, but stretches well beyond a decade for those born in India and remains significantly backlogged for China-born applicants. The process moves through three separate government filings — PERM labor certification with the Department of Labor, an I-140 immigrant petition with USCIS, and adjustment of status on Form I-485 — and the total time depends far more on your country of birth than on how quickly you or your employer act.
The Three Stages and How Long Each Takes
L-1B holders don’t have a dedicated green card track the way L-1A managers do. Almost all L-1B specialized knowledge workers file through the employment-based second or third preference (EB-2 or EB-3), and both require the full labor certification process before anything else can move.
PERM Labor Certification: 18 to 24 Months
Your employer starts by requesting a prevailing wage determination from the National Prevailing Wage Center, which sets the minimum salary for the position based on occupation and geography.1Flag.dol.gov. Prevailing Wages This step alone can take several months, and recruitment cannot begin until it is complete.
Once the wage is set, the employer must advertise the position and document that no qualified U.S. worker applied.2eCFR. 20 CFR 656.17 – Basic Labor Certification Process After recruitment closes, the employer files ETA Form 9089 electronically through the Department of Labor’s FLAG system. As of February 2026, the average processing time for PERM applications is approximately 503 calendar days, roughly 16 to 17 months of adjudication after filing.3Flag.dol.gov. Processing Times Add prevailing wage and recruitment time to that, and the PERM stage commonly runs 18 to 24 months from start to finish. An audit lengthens it further.
Form I-140: 15 Business Days to Over a Year
Once the labor certification is approved, your employer files Form I-140 with USCIS.4U.S. Citizenship and Immigration Services. I-140, Immigrant Petition for Alien Workers The receipt notice establishes your priority date, which for PERM-based petitions is the date the Department of Labor accepted your labor certification application for processing.5eCFR. 8 CFR 204.5 – Petitions for Employment-Based Immigrants That priority date determines your place in line for a visa number.
Standard I-140 processing can take six months to over a year. Premium processing, which costs an additional $2,965 effective March 1, 2026, guarantees a decision or request for evidence within 15 business days.6U.S. Citizenship and Immigration Services. USCIS to Increase Premium Processing Fees7U.S. Citizenship and Immigration Services. How Do I Request Premium Processing Most L-1B applicants use it, because an approved I-140 also unlocks job portability and, in some cases, concurrent filing of the adjustment application.
Form I-485: 8 to 14 Months, When a Visa Is Available
The final filing is Form I-485, which converts your status from temporary worker to lawful permanent resident.8U.S. Citizenship and Immigration Services. I-485, Application to Register Permanent Residence or Adjust Status You can only file when a visa number is available for your priority date, preference category, and country of birth. The State Department publishes the Visa Bulletin monthly showing which priority dates are current.
Every applicant must submit a completed medical exam (Form I-693) with the I-485; USCIS may reject an application filed without it.9USCIS. I-693, Report of Immigration Medical Examination and Vaccination Record Exams completed on or after November 1, 2023 do not expire.10U.S. Citizenship and Immigration Services. USCIS Announces New Guidance on Form I-693 Validity Period After filing, USCIS schedules a biometrics appointment, and some applicants are called for an in-person interview at a field office.11U.S. Citizenship and Immigration Services. Adjustment of Status I-485 processing commonly runs eight to fourteen months from filing to card production.
Why Your Country of Birth Changes Everything
The two-to-four-year figure assumes a visa number is available when you need one. For applicants born in most countries, that assumption holds — EB-2 and EB-3 are often current, and there is no additional wait beyond the processing times above.
For applicants born in India, EB-2 and EB-3 backlogs are measured in decades. Annual per-country caps limit how many green cards are issued to nationals of any one country regardless of demand, so the line barely moves. EB-3 India is generally slower than EB-2 India, though the gap fluctuates. Applicants born in China face significant backlogs in both categories as well, though historically shorter than India’s.
Retrogression can make things worse. When demand for visa numbers exceeds supply in a given month, the State Department moves cutoff dates backward. If you have already filed your I-485, retrogression will not undo the filing, but it delays the final decision. If you have not filed, retrogression can push your eligibility to file months or years into the future.
The Five-Year L-1B Limit Is the Real Deadline
L-1B status has a hard maximum of five years, with no extensions beyond that limit.12U.S. Citizenship and Immigration Services. L-1B Intracompany Transferee Specialized Knowledge Once you hit five years, you cannot be readmitted in L-1B status unless you have spent at least one full year physically outside the United States.13USCIS. USCIS Policy Manual Volume 2 Part L Chapter 10 – Period of Stay
Unlike H-1B holders, L-1B holders have no statutory extension provision tied to a pending labor certification or I-140. That is the planning problem. PERM alone can eat 18 to 24 months, and I-140 processing adds more. An applicant who waits a year or two after arriving to start the process can burn through most of the five years before ever reaching the I-485 stage.
The workable strategies are to start PERM as early as possible after arriving on L-1B, pay for premium I-140 processing, and file the I-485 concurrently if a visa number is available. Some applicants change to H-1B before the L-1B expires to gain access to the longer H-1B runway and its extension provisions. If your I-485 is already pending when your L-1B expires, you can remain in the United States on the basis of the pending adjustment application and continue working on your Employment Authorization Document.
For Indian and Chinese nationals, the five-year cap and the backlog collide directly. A visa number will not become available within five years, so a bridge to another status is not optional. Plan for it from day one of the L-1B assignment.
Concurrent Filing: When You Can Skip One Wait
If a visa number is available at the time your employer files the I-140, USCIS lets you submit the I-485 at the same time rather than waiting for the I-140 to be approved first.14U.S. Citizenship and Immigration Services. Concurrent Filing of Form I-485 Both applications move through the system in parallel, and filing the I-485 immediately gives you access to interim benefits much sooner. Concurrent filing is only available to applicants physically present in the United States, and visa availability changes month to month.
For most-country applicants, concurrent filing can compress the total timeline meaningfully. For India- and China-born applicants, it is generally not an option, because a number is not available in the first place.
Work Authorization and Travel While the I-485 Is Pending
Once the I-485 is pending, you can file Form I-765 for an Employment Authorization Document.15U.S. Citizenship and Immigration Services. Employment Authorization Document Even while working on your L-1B, the EAD is a safety net if your L-1B expires or you need to switch employers.
Travel needs planning. If you leave the United States with a pending I-485 and no advance parole document, USCIS generally treats the application as abandoned.16U.S. Citizenship and Immigration Services. While Your Green Card Application Is Pending with USCIS L-1B holders have an advantage: you can travel on a valid L-1B visa and re-enter in L-1B status without abandoning the I-485. Once your L-1B expires, you need advance parole. Filing Form I-131 alongside I-765 often produces a combination card that serves as both EAD and advance parole.
Changing Jobs Without Restarting
Under the portability provision of AC21, you can change employers without restarting the process if your I-485 has been pending for at least 180 days and your I-140 was approved before the switch. The new position must involve the same or a similar occupational classification as the one on your original labor certification; USCIS looks at actual job duties rather than titles. The 180-day clock runs from the date USCIS actually received your I-485, not the date on the receipt notice. After 180 days, the I-140 remains valid for portability purposes even if your former employer requests withdrawal.
Family Members and the Age-Out Risk
Your spouse and unmarried children under 21 can be included as derivative beneficiaries. If they are already in the United States on L-2 status, they share the same dual intent protection.12U.S. Citizenship and Immigration Services. L-1B Intracompany Transferee Specialized Knowledge Each family member files a separate I-485, medical exam, and biometrics.
A child who turns 21 or gets married during the process loses derivative eligibility. The Child Status Protection Act provides some relief by adjusting the child’s calculated age to account for time the I-140 was pending, but it does not fully solve the problem when a country backlog stretches for years. If you have a teenager and you are facing a backlog, raise this with an immigration attorney well before the child turns 20.
