L-1A to Green Card Timeline: Steps, Delays, and Total Wait

The L-1A to green card timeline typically runs 8 to 18 months for applicants born in most countries, moving through the EB-1C multinational manager or executive category. The wait stretches considerably longer, often three or more years, for people born in India or mainland China because of Visa Bulletin backlogs. The single biggest reason the EB-1C path is faster than other employment-based options is that it skips PERM labor certification, which by itself takes 8 to 18 months before a green card petition can even be filed.1U.S. Citizenship and Immigration Services. The Three Steps and How Long Each Takes

The process has three sequential decisions: an employer petition (Form I-140), a visa number becoming available, and either an adjustment of status inside the U.S. (Form I-485) or an immigrant visa interview at a consulate abroad. When you can overlap these, the total time drops.

Step One: The I-140 Petition

Your employer files Form I-140 on your behalf.2U.S. Citizenship and Immigration Services. I-140, Immigrant Petition for Alien Workers Under standard processing, plan for roughly 6 to 12 months, with the actual estimate varying by service center. Check current times on the USCIS website before filing.

Premium processing shortens this dramatically. For EB-1C petitions, USCIS guarantees action within 45 business days, which works out to roughly nine weeks.3U.S. Citizenship and Immigration Services. How Do I Request Premium Processing “Action” means an approval, a denial, or a Request for Evidence, not a guaranteed approval. A premium processing fee increase takes effect March 1, 2026, so verify the current amount.4U.S. Citizenship and Immigration Services. I-907, Request for Premium Processing Service

The filing date on your receipt notice (Form I-797C) becomes your priority date, which locks in your place in line.5U.S. Citizenship and Immigration Services. Form I-797C, Notice of Action Filing early matters more the longer the backlog for your country.

Step Two: Waiting for a Visa Number

Before you can finalize the green card, a visa number has to be available in your category and country of birth. The Department of State publishes this monthly in the Visa Bulletin, and USCIS decides each month whether adjustment applicants may use the more generous Dates for Filing chart or the stricter Final Action Dates chart.6U.S. Citizenship and Immigration Services. Adjustment of Status Filing Charts from the Visa Bulletin

For applicants born in most countries, EB-1 is current, so there is no additional wait at this step. For India and mainland China, this is where the timeline stretches. The June 2026 Visa Bulletin shows an EB-1 final action cutoff date of December 15, 2022, for India and April 1, 2023, for mainland China; applicants with later priority dates cannot finalize their green cards until those dates advance.7U.S. Department of State. Visa Bulletin for June 2026 The State Department has warned of possible further retrogression for Indian EB-1 applicants if demand runs ahead of the annual per-country limit.

Step Three: I-485 or Consular Processing

If you are already in the U.S. on L-1A status, you file Form I-485 to adjust to permanent residence.8U.S. Citizenship and Immigration Services. I-485, Application to Register Permanent Residence or Adjust Status The median processing time for employment-based I-485 cases was 6.2 months in fiscal year 2026. Add time for biometrics, a medical exam (Form I-693), and interview scheduling. A signed I-693 is now valid only while the I-485 it was submitted with remains pending, so a denial or withdrawal means starting the medical over.9U.S. Citizenship and Immigration Services. USCIS Changes Validity Period for Any Form I-693 Signed on or after Nov 1 2023

If you are abroad, the approved I-140 goes to the National Visa Center, which collects fees and documents and schedules an interview at a U.S. embassy or consulate once a visa number is available.10U.S. Citizenship and Immigration Services. Consular Processing The interview is largely a verification exercise for EB-1C cases; the substantive legal decision was made at the I-140 stage.

Concurrent Filing: The Most Effective Way to Shorten the Wait

If a visa number is available when the I-140 is filed, you can submit the I-485 at the same time rather than waiting for I-140 approval.11U.S. Citizenship and Immigration Services. Concurrent Filing of Form I-485 The two applications then process in parallel, which is the single biggest lever for compressing the timeline.

Concurrent filing is generally available to EB-1 applicants born in most countries. For India and mainland China, check the Visa Bulletin first; when the category is backlogged, concurrent filing may not be an option. When you do file concurrently, you can also include Form I-765 and Form I-131 to request an Employment Authorization Document and Advance Parole in the same package.12U.S. Citizenship and Immigration Services. What Can Add Months

A Request for Evidence on the I-140 is the most common source of delay. USCIS gives you 84 days to respond, plus 3 days for domestic mail or 14 days for mail abroad. Send one complete response; sending evidence piecemeal is a common cause of denial. Figure two to four months added to the overall timeline when an RFE is issued. Missing the deadline results in a denial based on the record on file.

At the I-485 stage, background check delays, interview rescheduling, and additional evidence requests can add a similar stretch. Visa retrogression is another risk: a category that was current last month can suddenly develop a cutoff date. If retrogression hits after you file the I-485, the application sits pending, not abandoned, until your priority date is current again.

Realistic Total Timelines

  • Most countries with concurrent filing and premium processing: 8 to 14 months from filing to card, sometimes as long as 18 months once biometrics, medical, and interview scheduling are factored in.
  • Most countries without concurrent filing (standard I-140 processing first): meaningfully longer, because the I-485 clock only starts after the I-140 is approved.
  • India and mainland China: the I-140 takes the same time, but the I-485 waits for the priority date. Total timelines commonly reach three or more years and depend entirely on how the Visa Bulletin moves.
  • Any country, with an RFE: add roughly two to four months.

Working and Traveling During the Wait

L-1A holders can generally keep working and traveling on L-1A status while the I-485 is pending, as long as they maintain valid L-1 status and return in the same classification.13U.S. Citizenship and Immigration Services. Travel Documents Most applicants still file for a combo card (EAD and Advance Parole) as a safety net through Forms I-765 and I-131, filed with the I-485.12U.S. Citizenship and Immigration Services. Filing Form I-765 with Other Forms If you do not hold L-1 status and leave the country without approved Advance Parole, USCIS will treat the I-485 as abandoned.

After the I-485 has been pending 180 days, and if the I-140 is approved or ultimately approvable, you can change employers to a same-or-similar role without losing your place in line. Aging Out: A Timeline Risk for Families With Teenagers

Unmarried children under 21 can be included as derivative beneficiaries, but a child who turns 21 while the case is pending can lose eligibility. The Child Status Protection Act calculates a special CSPA age: the child’s age when a visa becomes available, minus the number of days the I-140 was pending.15U.S. Citizenship and Immigration Services. Child Status Protection Act (CSPA) If that number is under 21 and the child remains unmarried, eligibility is preserved. Filing early and using premium processing on the I-140 both shorten the pending time subtracted in the formula, which raises the CSPA age and reduces the risk. For families with teenagers close to the line, move quickly.

What Actually Determines Your Wait

Two factors dominate everything else. The first is country of birth: if you were born in India or mainland China, the Visa Bulletin is the bottleneck, and no filing strategy eliminates it. Filing the I-140 as early as possible locks in the earliest priority date, which matters more the longer the backlog grows. The second is whether you combine premium processing with concurrent filing. For applicants from countries where EB-1 is current, that combination turns two sequential waits into overlapping ones and typically brings the total inside a year.
