The L-1A processing time runs several months under standard USCIS handling, but premium processing shortens the petition stage to 15 business days. That is the government side only. Once the petition is approved, an applicant abroad still has to obtain a visa at a U.S. embassy or consulate, and interview waits at that stage can add weeks or months depending on the post.
How Long Standard Petition Processing Takes
The clock starts when the U.S. employer files Form I-129, Petition for a Nonimmigrant Worker, with USCIS.1U.S. Citizenship and Immigration Services. I-129, Petition for a Nonimmigrant Worker USCIS does not publish a guaranteed processing window for standard L-1A petitions. Times fluctuate with the workload at whichever service center receives the case, seasonal filing surges, and internal staffing.
To get a current estimate for your case, USCIS maintains an online processing times tool where you select Form I-129 and the L-1A classification. When the petition reaches a final decision, the employer receives a Form I-797, Notice of Action, indicating approval or denial.2U.S. Citizenship and Immigration Services. Form I-797 Types and Functions That approval is what unlocks the consular stage.
Premium Processing: 15 Business Days
Employers who need a faster answer can file Form I-907, Request for Premium Processing Service, either with the initial petition or while it is already pending.3U.S. Citizenship and Immigration Services. I-907, Request for Premium Processing Service For L-1A petitions, USCIS guarantees action within 15 business days of receiving a properly completed Form I-907 with the correct fee.4U.S. Citizenship and Immigration Services. How Do I Request Premium Processing Those are business days, not calendar days, so the practical wait is around three weeks.
The premium processing fee for L-1A petitions increased to $2,965 effective March 1, 2026.5U.S. Citizenship and Immigration Services. USCIS to Increase Premium Processing Fees If USCIS fails to act within the 15-business-day window, it must refund the premium fee, though the refund often arrives only after a final decision on the underlying petition.
Read “action” carefully. It does not guarantee approval. USCIS might approve, deny, issue a notice of intent to deny, or issue a Request for Evidence. If an RFE goes out, the 15-day clock stops and only restarts once the employer responds. Premium processing controls the government’s side of the timeline; it cannot fix a thin initial filing.
The Consular Stage Runs on Its Own Clock
An approved I-129 does not, by itself, allow the transferee to enter the United States. An applicant abroad must still obtain an L-1A visa stamp from a U.S. embassy or consulate.6U.S. Department of State Foreign Affairs Manual. 9 FAM 402.12 – Intracompany Transferees – L Visas That involves Form DS-160, the Online Nonimmigrant Visa Application, and a mandatory in-person interview.
Interview wait times are post-specific. Some embassies schedule within a couple of weeks; high-demand posts have backlogs stretching several months. Staffing, seasonal travel patterns, and local conditions all factor in, and there is no way to control this from the U.S. side. The consular officer usually gives the decision at the end of the interview. If approved, expect roughly five to ten additional business days for printing and passport return, faster or slower depending on the post.
The upshot: even with premium processing cutting the petition to about three weeks, a long embassy wait can push the total time to a visa out to several months. Check the target post’s current wait times before filing.
What Causes the Biggest Delays
Requests for Evidence
When USCIS decides the initial filing does not contain enough documentation to prove eligibility, it issues a Request for Evidence detailing what is missing. The maximum response deadline is 84 days. When USCIS mails the RFE, three days of mailing time are added, for a practical total of 87 days. If the RFE goes to someone outside the United States, 14 extra days of mailing time apply.7U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part E Chapter 6 – Evidence Processing stops while the clock runs on the response, so a single RFE can add three to four months to the timeline.
RFEs on L-1A petitions commonly target vague job descriptions that do not clearly establish executive or managerial duties, thin evidence of the qualifying corporate relationship, or insufficient proof that the foreign entity will continue operating after the transfer. Over-documenting the initial filing with detailed organizational charts, corporate formation documents, tax returns, and payroll records is the best way to avoid one.
Administrative Processing Under 221(g)
Separate from anything USCIS does, a consular officer can place a visa application into administrative processing under Section 221(g) of the Immigration and Nationality Act. That means the officer needs more information or a security review before deciding. The applicant has one year from the date of refusal to submit any additional documentation the consulate requests; otherwise, they must reapply and pay the application fee again.8U.S. Department of State. Administrative Processing Information
The State Department does not provide a standard resolution timeframe and explicitly says the duration varies with the individual case.8U.S. Department of State. Administrative Processing Information Some cases clear in weeks; others drag on for months. Once administrative processing begins, there is no mechanism to bypass or accelerate it.
Free Expedite Requests
If premium processing is not available or the fee is a barrier, USCIS accepts expedite requests on a case-by-case basis at no additional charge. Approval is discretionary, and USCIS grants these sparingly. The agency considers requests under specific criteria:9U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part A Chapter 5 – Expedite Requests
- Severe financial loss to a company or person, where the urgency was not caused by the petitioner’s own failure to file on time.
- Emergency or urgent humanitarian situations, including serious illness, disability, death of a family member, or extreme conditions such as natural disasters or armed conflict.
- Nonprofits furthering U.S. cultural or social interests, with IRS nonprofit designation.
- Government interest, including public safety and national security.
- Clear USCIS error that needs correcting.
Simply needing the worker to start sooner does not qualify. Documented evidence of one of the situations above is required. For most L-1A petitions, premium processing is the more reliable path to a faster decision.
New Office Petitions Are Approved for Less Time
If a foreign company is sending an executive or manager to establish a brand-new U.S. office, the initial period of stay is capped at one year, compared to up to three years for transfers to an existing office.10U.S. Citizenship and Immigration Services. L-1A Intracompany Transferee Executive or Manager The petition itself is processed on the same USCIS timeline as any other I-129, and premium processing is available. What changes is what happens next: the employer has to file an extension within a year, showing the U.S. office is operating, generating revenue, and supporting a genuine executive or managerial role. Many new-office cases run into trouble at that extension. After a successful first extension, subsequent extensions follow the standard pattern of up to two years each.
Extensions and the Seven-Year Cap
L-1A executives and managers can remain in the United States for a cumulative maximum of seven years.11U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 2 Part L Chapter 10 – Period of Stay The initial petition grants up to three years, or one year for new office cases, and extensions come in increments of up to two years until the cap is reached.10U.S. Citizenship and Immigration Services. L-1A Intracompany Transferee Executive or Manager
One detail that catches people off guard: USCIS combines time spent in both H and L classifications when calculating the seven-year limit. Two prior years in H-1B leave only five years of L-1A time.11U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 2 Part L Chapter 10 – Period of Stay Once the cap is reached, the person cannot re-enter as an L or H nonimmigrant until they have lived outside the United States for at least one full year. Brief business or pleasure trips do not count toward that year abroad.
Extensions run through the same I-129 filing process as the initial petition, so the same processing times apply. File well before the current status expires; a late filing can create a gap in authorized stay.
Blanket L-1: The Fastest Route for Qualifying Employers
Large multinational employers with a history of L-1 transfers can file a blanket petition, which pre-approves the organization as a qualifying entity and streamlines future individual transfers. Instead of filing a separate I-129 for each transferee, the company obtains a single blanket approval, and individual employees then apply for their visas directly at a U.S. consulate abroad. Skipping the per-person USCIS petition stage can shorten the overall timeline considerably.
To qualify, the petitioner must show that the company and its related entities are engaged in commercial trade or services, that the petitioner has a U.S. office that has been operating for at least one year, and that there are at least three domestic or foreign branches, subsidiaries, or affiliates. The company must also meet one of three size thresholds: at least ten approved L-1 petitions in the previous twelve months, combined U.S. annual sales of at least $25 million, or a U.S. workforce of at least 1,000 employees.12U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 2 Part L Chapter 2 – General Eligibility The blanket petition itself takes time to obtain and must be renewed periodically, but for employers who qualify, subsequent transfers move faster than any premium-processed individual petition.
