K-1 Visa After Marriage: I-485 Filing, Interview, and Conditions

After you marry on a K-1 visa, the foreign spouse becomes eligible — and required — to file for adjustment of status to get a green card. That means submitting Form I-485 with supporting documents, attending a biometrics appointment and an interview with both spouses present, and receiving either a two-year conditional green card or a 10-year permanent green card depending on how long you have been married when USCIS decides the case. The K-1 itself expires the moment the marriage happens, and adjustment through that specific marriage is the only immigration path left open to the foreign spouse.1Office of the Law Revision Counsel. 8 U.S.C. 1255 – Adjustment of Status of Nonimmigrant to That of Person Admitted for Permanent Residence

Marry Within 90 Days, and Only the Petitioner

Two rules govern everything that follows. The marriage has to happen within 90 days of the K-1 holder’s arrival in the United States, and it has to be to the U.S. citizen who filed the original fiancé petition.2U.S. Citizenship and Immigration Services. Visas for Fiancees of U.S. Citizens There is no extension. Once day 91 arrives without a wedding, the authorized stay ends.

The petitioner requirement is stricter than many couples realize. Federal law bars USCIS from adjusting a K-1 holder based on marriage to anyone else, employment, or any other immigration category.1Office of the Law Revision Counsel. 8 U.S.C. 1255 – Adjustment of Status of Nonimmigrant to That of Person Admitted for Permanent Residence A K-1 holder cannot switch to a student or work visa either. If the engagement ends before the wedding, leaving the country is the only clean option. Staying past 90 days without marrying the petitioner puts the foreign spouse out of status and can create bars to future re-entry.

What Goes in the I-485 Packet

Once the marriage is legally recorded, the foreign spouse files Form I-485, the application to register permanent residence.3U.S. Citizenship and Immigration Services. I-485, Application to Register Permanent Residence or Adjust Status The packet needs to include:

  • The marriage certificate issued by the local government where the ceremony took place, showing the wedding fell inside the 90-day window.4U.S. Citizenship and Immigration Services. Green Card for Fiancee of U.S. Citizen
  • The I-94 arrival record confirming lawful entry on the K-1.
  • Form I-693, the medical examination and vaccination record completed by a USCIS-designated civil surgeon. Doctors set their own prices; expect roughly $150 to $350.5U.S. Citizenship and Immigration Services. I-693, Report of Immigration Medical Examination and Vaccination Record
  • Passport-style photographs and copies of government-issued identification.
  • Every residential address and every employer for the last five years.

Any document in another language needs a certified English translation. The translator signs a statement affirming their competence in both languages and the accuracy of the translation, and includes their name, address, and date. A professional service is not required, but the certification statement is.

The Affidavit of Support

The U.S. citizen spouse has to file Form I-864, a legally binding promise to financially support the immigrant spouse.6U.S. Citizenship and Immigration Services. Affidavit of Support Household income must sit at or above 125% of the federal poverty guidelines. For 2026 that means at least $27,050 per year for a household of two in the 48 contiguous states, with higher thresholds in Alaska and Hawaii and for larger households.7U.S. Citizenship and Immigration Services. I-864P, HHS Poverty Guidelines for Affidavit of Support

Recent federal tax returns, W-2s, and proof of current income back up the affidavit. If the sponsor’s income falls short, a joint sponsor — any U.S. citizen or lawful permanent resident meeting the income requirement — can file a separate I-864 to close the gap. This is a real obligation, not a formality: it survives divorce and only ends when the immigrant spouse naturalizes, earns 40 qualifying quarters of Social Security work credits, permanently leaves the country, or dies.

Filing, Fees, and Your Receipt

The completed packet goes to the USCIS Lockbox facility that serves your state. The Form I-485 filing fee is $1,440 for most adults and includes biometrics. If you file Form I-765 (work authorization) and Form I-131 (travel document) at the same time as the I-485, those forms carry no additional fee. USCIS updates its fees periodically, so confirm the current amount on the USCIS fee calculator before writing the check. Payment methods include personal check, cashier’s check, money order payable to the U.S. Department of Homeland Security, or credit card using Form G-1450.8U.S. Citizenship and Immigration Services. Authorization for Credit Card Transactions

After intake, USCIS mails Form I-797C, Notice of Action, which serves as your receipt and case number.9U.S. Citizenship and Immigration Services. Form I-797C, Notice of Action Check every detail against what you submitted; misspelled names or wrong dates here cause problems later. The receipt also documents authorized presence while your case is pending.

Working and Traveling While You Wait

Filing the I-485 by itself does not let the foreign spouse work or travel abroad. Form I-765 covers employment authorization and Form I-131 covers Advance Parole, a travel permit. Filing both alongside the I-485 is standard and, as noted, adds no fee.10U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization USCIS usually issues a single combo card containing both.

The travel piece deserves attention. Leaving the country while the I-485 is pending without an approved Advance Parole document causes USCIS to treat the application as abandoned.11U.S. Citizenship and Immigration Services. While Your Green Card Application Is Pending with USCIS That means starting the process over, possibly from outside the United States. Even a short trip across the border can wipe out months of work. Wait for the combo card before booking anything.

Once the work permit is in hand, the foreign spouse can accept a job anywhere in the country and request a Social Security number, either by checking the appropriate box on the I-485 or by visiting a local Social Security Administration office with passport, I-94, and EAD.

Address Changes During the Case

Federal law requires notifying USCIS within 10 days of any move.12U.S. Citizenship and Immigration Services. AR-11, Alien’s Change of Address Card Updating through a USCIS online account is fastest and hits case systems almost immediately. A paper Form AR-11 works but is slower. Missing this step can send interview notices and approval letters to an old address, and it violates immigration law.

Biometrics and the Interview

A few weeks after acceptance, a notice arrives scheduling biometrics at a local Application Support Center. Fingerprints and a photograph for background checks — a short visit. Skipping it without rescheduling can lead to a denial for abandonment.

The adjustment interview at a local USCIS field office is the bigger event, and both spouses have to attend. The officer will ask how you met, what daily life together looks like, and what your plans are. The goal is to confirm the marriage is genuine rather than a device to obtain immigration benefits. Bring evidence of a shared life: joint bank statements, a shared lease or mortgage, utility bills in both names, insurance policies naming each other, photographs across the relationship, and correspondence that shows the history. Thin evidence invites harder questions; a thick, well-organized folder tends to shorten the interview.

Conditional or 10-Year Green Card

Which green card you receive depends on how long you have been married on the day USCIS approves the case. Less than two years of marriage at approval means a conditional green card valid for two years.13U.S. Citizenship and Immigration Services. Removing Conditions on Permanent Residence Based on Marriage More than two years means a standard 10-year green card with no conditions.14Office of the Law Revision Counsel. 8 U.S.C. 1186a – Conditional Permanent Resident Status for Certain Alien Spouses and Sons and Daughters Because K-1 couples typically file for adjustment within months of arrival, most receive conditional status.

Removing the Conditions Two Years Later

Conditional residents must file Form I-751, Petition to Remove Conditions on Residence, in the 90-day window immediately before the two-year card expires.15U.S. Citizenship and Immigration Services. Petition to Remove Conditions on Residence Filing early gets it rejected; filing late means losing status. Put the date on the calendar the day the conditional card arrives.

The I-751 is normally filed jointly, with updated proof that the marriage is real: continued joint finances, shared property, children of the marriage. Approval lifts the conditions and produces a 10-year green card.

If the marriage has broken down by the time the filing window arrives, a waiver of the joint filing requirement is available on several grounds:16U.S. Citizenship and Immigration Services. Chapter 5 – Waiver of Joint Filing Requirement

  • The marriage was entered in good faith but ended in divorce or annulment.
  • The U.S. citizen spouse subjected the conditional resident or their child to battery or extreme cruelty during the marriage.
  • Removal from the United States would cause the conditional resident extreme hardship.

A waiver-based I-751 can be filed alone, without the petitioning spouse’s cooperation, at any time before conditional status expires.

Taxes in the First Year of Marriage

Marriage to a U.S. citizen changes the foreign spouse’s tax picture right away. For the year of the wedding, the couple can file jointly even if the foreign spouse was a nonresident alien for part of the year, by making a joint election under Section 6013(g) of the Internal Revenue Code. The election treats the nonresident spouse as a U.S. resident for tax purposes for the whole year and every year going forward until revoked, and is made by attaching a signed statement to the joint return.17eCFR. 26 CFR 1.6013-6 – Election to Treat Nonresident Alien Individual as Resident of the United States Filing jointly usually beats married-filing-separately on total tax.

The foreign spouse needs a taxpayer identification number to file. A Social Security number works. Without one, IRS Form W-7 applies for an Individual Taxpayer Identification Number and can be submitted with the return.18Internal Revenue Service. About Form W-7, Application for IRS Individual Taxpayer Identification Number One consequence of the 6013(g) election: the foreign spouse’s worldwide income becomes subject to U.S. tax, so couples with significant foreign income or assets should think through the trade-off carefully.

Health Coverage in the Meantime

An applicant with a pending I-485 qualifies to buy coverage through the Affordable Care Act marketplace, and an approved Employment Authorization Document independently qualifies as well.19HealthCare.gov. Immigration Status to Qualify for the Marketplace Depending on household income, premium subsidies may be available. The faster route in many cases is the citizen spouse’s employer plan, which usually treats marriage as a qualifying life event that allows adding a new spouse within 30 days.
