K-1 Visa Adjustment of Status: Deadline, Costs, and Timeline

Adjustment of status from a K-1 visa is how you become a lawful permanent resident after entering the United States as the fiancé of a U.S. citizen, marrying that citizen within 90 days of arrival, and then filing Form I-485 with U.S. Citizenship and Immigration Services. The filing fee for an adult applicant is $1,440,1USCIS. G-1055, Fee Schedule and because most K-1 couples have been married less than two years when the green card is approved, USCIS issues a two-year conditional card rather than a standard ten-year one.2USCIS. Who Can Adjust Status From a K-1 Visa

Three things have to be true. You entered on a valid K-1 visa and were inspected and admitted at a port of entry. You married the same U.S. citizen who filed the Form I-129F petition for you. And the wedding happened within 90 days of your arrival.3USCIS. Visas for Fiancees of U.S. Citizens

The same-petitioner rule is strict. Federal regulations bar K-1 holders from adjusting status through anyone other than the citizen who filed the fiancĂ© petition.4eCFR. 8 CFR Part 245 – Adjustment of Status to That of Person Admitted If you marry someone else, or don’t marry at all, you generally cannot apply for a green card under a different eligibility category while you remain in the United States. USCIS recognizes only narrow exceptions for people who later qualify for U status (victims of qualifying criminal activity) or T status (victims of severe trafficking).2USCIS. Green Card for Fiancee of U.S. Citizen

You also cannot be inadmissible under the grounds set out in the Immigration and Nationality Act. The main categories are communicable diseases of public health significance, missing required vaccinations, certain criminal convictions (crimes involving moral turpitude, controlled substance violations, drug trafficking, and others), fraud or misrepresentation, and prior removals.5USCIS. Inadmissibility and Waivers USCIS also evaluates whether you are likely to become a public charge based on the totality of your circumstances, including age, health, income, education, and skills. A properly filed Affidavit of Support goes a long way toward answering that question.6USCIS. USCIS Policy Manual Volume 8 Part G Chapter 9 – Adjudicating Public Charge Inadmissibility

The 90-Day Marriage Deadline Is Absolute

If the 90 days close without a marriage, your K-1 status expires immediately. Federal law requires you to depart, and if you don’t, you can be placed in removal proceedings.7Office of the Law Revision Counsel. 8 USC 1184 – Admission of Nonimmigrants There is no automatic grace period and no extension available.

Staying past 90 days without marrying also starts the clock on unlawful presence. More than 180 days followed by departure triggers a three-year bar on reentry; more than one year triggers a ten-year bar. Those bars can derail future visa applications, so treat the deadline as firm.

What Goes in the Application Package

The core of the application is Form I-485, which asks for your biographic details, addresses, employment history, and immigration encounters.8USCIS. I-485, Application to Register Permanent Residence or Adjust Status Around it you build a supporting package:

  • A certified marriage certificate showing a ceremony date within the 90-day window after your arrival.
  • Birth certificates for both you and your U.S. citizen spouse.
  • Your passport with the K-1 visa page and the entry stamp.
  • Passport-style photographs meeting the dimensions and background specifications on the USCIS website.
  • Your Form I-94 arrival record.

Make sure names match exactly across every document and the original I-129F petition. Even minor discrepancies, like a middle name appearing on some documents but not others, can produce delays or requests for evidence.

The Affidavit of Support

Your spouse files Form I-864, promising to maintain you at an income of at least 125 percent of the federal poverty guidelines for the household size.9USCIS. I-864P, HHS Poverty Guidelines for Affidavit of Support It is a legally enforceable contract. The obligation lasts until you become a citizen, earn 40 qualifying quarters of work, permanently leave the country, or die.

Supporting documents include federal tax returns for the most recent tax year, W-2s or 1099s, and recent pay stubs. If your spouse’s income falls short once household size is counted, a joint sponsor who independently meets the income threshold can file a separate I-864 backed by their own records.10USCIS. The Medical Exam

Form I-693 documents your immigration medical examination and vaccination record. Only a USCIS-designated civil surgeon can perform it, and you can find one through the locator tool on the USCIS website.11USCIS. I-693, Report of Immigration Medical Examination and Vaccination Record The surgeon checks for communicable diseases and confirms you have received the vaccinations required for immigration purposes.12USCIS. Vaccination Requirements Bring any vaccination records you already have; missing doses can be given at the appointment. Expect roughly $200 to $400 depending on location and which shots you need.

A signed Form I-693 is valid only while the adjustment application it was submitted with is pending. If your application is denied or withdrawn, that medical result is no longer usable.13USCIS. USCIS Changes Validity Period for Any Form I-693 Signed on or After Nov 1, 2023

What It Costs

The Form I-485 filing fee for an applicant over age 14 is $1,440, which includes biometrics.1USCIS. G-1055, Fee Schedule USCIS accepts personal checks, cashier’s checks, and money orders payable to the U.S. Department of Homeland Security. To pay by credit, debit, or prepaid card when filing by mail, place Form G-1450 on top of the package.14USCIS. G-1450, Authorization for Credit Card Transactions An incorrect amount or an unapproved payment method will get the whole package returned.

Budget separately for the civil surgeon exam, any vaccinations, certified copies of vital records, and, if you hire one, an attorney. Attorney fees for a full K-1 adjustment package typically run $1,500 to $4,500. You can file Forms I-765 (work authorization) and I-131 (travel document) at the same time as the I-485 at no additional filing fee.

Timeline and What Happens After You File

You mail the package to a USCIS lockbox. The correct address depends on your state and whether you use the postal service or a private courier, so check the USCIS website for current addresses before sending.

Once USCIS accepts the package, you receive a Form I-797C receipt notice with a case number.15USCIS. Form I-797C, Notice of Action Keep it. It proves you have a pending application and lets you track your case online. It is not an approval.

Next comes a biometric services appointment at a local Application Support Center, where USCIS collects fingerprints, a photograph, and your signature for background checks.16USCIS. Preparing for Your Biometric Services Appointment Missing it without rescheduling can stall the case.

Many cases also require an in-person interview at a USCIS field office. Both spouses attend. The officer asks about how you met, your daily life together, whether you share finances and a home, and may ask for more documents. If satisfied, the officer adjudicates the application on the spot or shortly afterward.

As of fiscal year 2026, the median processing time for family-based adjustment applications is about 5.5 months, though individual cases vary with local office workload and any requests for evidence.17USCIS. Historic Processing Times

Working and Traveling While the Case Is Pending

A K-1 visa on its own does not authorize employment. Filing Form I-765 with your I-485 requests an Employment Authorization Document, which lets you work for any employer while the green card is pending.18USCIS. Application for Employment Authorization

If you need to travel internationally, file Form I-131 for Advance Parole before you leave.19USCIS. I-131, Application for Travel Documents, Parole Documents, and Arrival/Departure Records Leaving the United States without approved Advance Parole while adjustment is pending is treated as abandoning the application. USCIS will consider it withdrawn, and you may not be able to reenter.20U.S. Customs and Border Protection. Advance Parole, Reentry Permit, and Refugee Travel Documentation for Returning Aliens Residing in the U.S. This is one of the most costly mistakes K-1 applicants make. USCIS often issues the EAD and Advance Parole as a single combo card, and both authorizations remain valid until the adjustment application is decided.

K-2 Children

Unmarried children under 21 who entered on K-2 visas can adjust alongside you after you marry the petitioner within 90 days. Each child files a separate Form I-485.21USCIS. Adjustment of Status for K-2 Aliens Immigration law defines “child” as an unmarried person under 21, so eligibility runs past age 18.22USCIS. Child Status Protection Act (CSPA) If a child marries or turns 21 before approval, they age out. The Child Status Protection Act can sometimes freeze a child’s age to account for processing delays, but it cannot override the unmarried requirement. K-2 children do not need to prove a step-parent/step-child relationship with the U.S. citizen petitioner.

The Green Card Will Be Conditional

Because K-1 couples have almost always been married less than two years by the time the adjustment is approved, USCIS issues conditional permanent residence rather than a full ten-year card. The conditional green card is valid for two years.2USCIS. Green Card for Fiancee of U.S. Citizen

To remove the conditions, you and your spouse jointly file Form I-751 during the 90-day window immediately before your conditional residence expires. Filing too early gets the petition rejected; filing late puts your status at risk.23USCIS. I-751, Petition to Remove Conditions on Residence The I-751 requires evidence that your marriage is genuine, such as joint bank accounts and tax returns, insurance policies naming the other spouse as beneficiary, a lease or mortgage in both names, birth certificates of any children born during the marriage, and sworn affidavits from at least two people who know both of you.24USCIS. Form I-751, Instructions for Petition to Remove Conditions on Residence Start collecting this evidence from the day you marry. Couples who wait until the filing window opens tend to scramble.

If Your Spouse Dies While the Case Is Pending

You are not automatically disqualified. Under INA section 204(l), USCIS may still approve the adjustment application if you were residing in the United States when your spouse died and continue to reside here at the time of the decision.25USCIS. USCIS Policy Manual Volume 7 Part A Chapter 9 – Death of Petitioner or Principal Beneficiary This provision removes the need for a living petitioner but does not waive other eligibility requirements or inadmissibility grounds. If you were temporarily abroad when your spouse died, you do not need to separately prove ongoing U.S. residence; USCIS recognizes that a brief absence does not destroy it.
