Joint Financial Statement: Forms, Liabilities, and Penalties

To prepare a joint financial statement, combine every asset, debt, income source, and recurring expense belonging to both people onto a single document, back each figure with current source paperwork, and have both parties sign only after reviewing every line. If a standardized form applies to your situation, use it exactly as designed; if not, structure the document as a balance sheet with a summary of total assets, total liabilities, and net worth on the first page. Accuracy is not optional: a false statement submitted to a federally insured lender can carry up to 30 years in prison and a fine of up to $1,000,000 under 18 U.S.C. § 1014.{1Office of the Law Revision Counsel. United States Code Title 18 – 1014}

Confirm Which Form You Need

The form you use is dictated by why you’re preparing the statement.

For a joint residential mortgage, almost every lender uses the Uniform Residential Loan Application (Fannie Mae Form 1003), which has dedicated sections for borrower information, assets, liabilities, real estate, and income, and both applicants sign under penalty of law.{2Fannie Mae. Uniform Residential Loan Application}{3Fannie Mae. Uniform Residential Loan Application}

For SBA-backed financing (7(a), 504, disaster loans, and surety bond guarantees), the required form is SBA Form 413. When a business has multiple owners or a spouse guarantees the debt, each person generally completes a separate Form 413, and the lender evaluates them together.{4U.S. Small Business Administration. Personal Financial Statement}

Divorce and legal separation cases typically require the mandatory financial disclosure form used by your court, which varies by jurisdiction. Estate planning attorneys usually don’t require a specific form but need a complete snapshot to structure trusts and calculate potential estate tax exposure.

If none of these applies, build the statement yourself as a balance sheet. Either way, the categories below need to be filled the same careful way.

Gather Asset Documentation

Start with cash accounts. List every checking, savings, money market, and certificate of deposit account held by either party at its current balance. For a mortgage, Fannie Mae’s selling guide requires two consecutive monthly statements covering 60 days of activity, dated within 45 days of the loan application.{5Fannie Mae. Requirements for Certain Assets in DU} Even outside a mortgage context, keeping your documentation within that window is a sensible baseline.

Move next to investment accounts: brokerage accounts, mutual funds, retirement accounts like 401(k)s and IRAs, and stock options. Use the most recent statement and report current market value, not what you originally paid.

Real estate requires a current estimated fair market value. Mortgage lenders will order their own appraisal, but for court filings or SBA applications a comparative market analysis from a broker or a formal appraisal report supplies the number.

Vehicles, boats, and other high-value personal property should be listed using widely accepted valuation guides or insurance declarations. For closely held businesses, you need a formal business valuation or a recent profit and loss statement to establish the equity each party holds. This is often the most contested line in divorce and the most scrutinized by commercial lenders.

List Every Liability

Every outstanding debt gets its own line, with the creditor name, current principal balance, and minimum monthly payment. Use the most recent statement for each debt as your source document.

  • Mortgage notes and HELOCs, with property address, outstanding balance, and monthly payment for each.
  • Auto loans and student loans, with current balances and required monthly payments.
  • Revolving credit cards, with the balance and the minimum payment (not what you usually pay).
  • Tax obligations owed to the IRS or state authorities, supported by official notices or installment agreements.

Lenders scrutinize total minimum monthly payments because they drive the debt-to-income ratio. Conventional mortgage lenders generally look for a back-end ratio (total monthly debt payments divided by gross monthly income) below 50%; FHA thresholds differ by credit score. Leaving debts off to improve that ratio is the kind of misrepresentation that triggers federal penalties.

Don’t Skip Contingent Liabilities

Most financial statement forms include a section for contingent liabilities, and it’s the section people most often underreport. These are potential obligations that haven’t fully materialized: loans where you’re a cosigner or guarantor, pending lawsuits or legal claims, and disputed or anticipated tax liabilities (including tax owed on a pending asset sale). SBA Form 413 specifically breaks contingent liabilities into endorsements and co-maker obligations, legal claims and judgments, and provisions for federal income tax.{4U.S. Small Business Administration. Personal Financial Statement}

If a lender later discovers you guaranteed a $200,000 business loan you didn’t disclose, that’s a material omission capable of unwinding the entire transaction.

Aggregate Income and Recurring Expenses

Combine all sources of gross income for both parties. W-2 wages are straightforward; self-employment, rental, and investment income need more documentation. IRS Form 1040 is the standard income document, and most lenders want the previous two years of returns.{6Internal Revenue Service. About Form 1040, U.S. Individual Income Tax Return}

Assume verification. Lenders cross-check reported income by submitting IRS Form 4506-C, which authorizes the IRS to release your tax transcripts to the lender. Each borrower whose income is used to qualify must complete and sign a separate Form 4506-C, and the transcripts must match the application.{7Fannie Mae. Tax Return and Transcript Documentation Requirements} The IRS Income Verification Express Service (IVES) handles this exchange with the taxpayer’s consent.{8Internal Revenue Service. Income Verification Express Service} Inflating income on your statement while your returns say otherwise is one of the fastest ways to have an application denied or referred for fraud review.

Self-employed individuals should include a year-to-date profit and loss statement alongside the prior year’s return. Rental income and expenses come from Schedule E of Form 1040, which produces a net income figure for each property after operating expenses, insurance, maintenance, taxes, and mortgage interest.{9Internal Revenue Service. Schedule E (Form 1040) – Supplemental Income and Loss}

Round out the picture with recurring expenses that reduce available cash flow: child support, alimony, insurance premiums, and property taxes. Form 1003 captures alimony, child support, and separate maintenance as specific liability line items.{3Fannie Mae. Uniform Residential Loan Application}

Understand What You’re Signing

Signing a joint loan creates joint and several liability: each borrower is individually responsible for the entire debt, not half. If one person stops paying, the lender can pursue the other for the full balance. That stays true even when the loan primarily benefited one party, like a business loan guaranteed by a spouse with no involvement in the business. Internal agreements about who pays what carry no weight with the creditor.{1Office of the Law Revision Counsel. United States Code Title 18 – 1014}

A joint account affects both parties’ credit. The Consumer Financial Protection Bureau confirms that joint accounts influence both credit scores, so late payments, defaults, and positive payment history all flow through to both credit reports.{10Consumer Financial Protection Bureau. Do Joint Credit Card Accounts With My Spouse Affect My Credit Score} Note that card issuers aren’t required to report to all three bureaus and may choose which receive information, so reporting isn’t always synchronized.

One thing the financial statement does not do: change legal ownership. Listing your spouse’s car or your partner’s investment account on a joint statement is an accounting exercise, not a transfer of title. Ownership changes only through a separate instrument like a deed, title transfer, or court order.

Community Property States

If you live in one of the nine community property states, the statement gets more complicated. Most debts incurred during the marriage are considered community obligations regardless of whose name is on the account, so debts you might consider “yours” or “theirs” may need to appear on the joint statement because both spouses are legally liable. Confirm with an attorney before finalizing if you’re unsure whether your state follows those rules.

Federal Penalties for Misrepresentation

Under 18 U.S.C. § 1014, anyone who knowingly makes a false statement to influence the action of a federally insured financial institution faces up to 30 years in prison and a fine of up to $1,000,000.{1Office of the Law Revision Counsel. United States Code Title 18 – 1014} The statute reaches an enormous range of institutions, including any bank insured by the FDIC, the FHA, credit unions, the SBA, and any entity that makes federally related mortgage loans.

Even outside lending, false statements in a matter within federal jurisdiction can carry up to five years under 18 U.S.C. § 1001.{11Office of the Law Revision Counsel. United States Code Title 18 – 1001} In divorce cases, misrepresenting your financial position typically constitutes perjury under state law and can lead to sanctions, contempt findings, or an unfavorable redistribution of assets.

The practical risk is real. Underwriters are trained to spot inconsistencies between stated assets and documented balances, transcripts are pulled directly from the IRS, and courts can compel full financial disclosure and appoint forensic accountants. The penalty for omitting a $50,000 account dwarfs any short-term advantage.

Format, Sign, and Submit

When a standardized form is provided, use it exactly as designed. Form 1003 for mortgages is submitted through the lender’s secure electronic portal.{2Fannie Mae. Uniform Residential Loan Application} SBA Form 413 is the required format for SBA loans.{4U.S. Small Business Administration. Personal Financial Statement} Courts in divorce proceedings have their own mandatory forms.

Where no form applies, structure the document as a balance sheet: assets on one side, liabilities and net worth on the other. Put a summary of total assets, total liabilities, and net worth on the first page. Back each line item with a detailed schedule and label every supporting document in an organized appendix so a reviewer can trace any number to its source.

Both parties must sign, and that signature typically carries the legal weight of an affidavit. Many institutions and courts require notarization to verify identity and voluntary signing. Do not sign until both people have reviewed every line item. Once you sign, you’ve attested that everything is accurate, and “I didn’t read it carefully” is not a defense.

Deliver the package the way the recipient requires. Secure electronic upload is standard for loan applications; court filings may require physical delivery or an e-filing system. Whatever the method, avoid unencrypted email for documents containing Social Security numbers, account numbers, or financial details. Keep a complete, signed, dated copy of everything you submit, and if a loan application is denied or withdrawn, ask the institution to confirm your documents have been destroyed or securely archived.
