You can claim a dependent who has an Individual Taxpayer Identification Number, but doing so almost always means a $500 Credit for Other Dependents rather than the much larger Child Tax Credit or Earned Income Tax Credit. The dependent still has to pass every standard IRS dependency test, plus a residency rule that limits eligible dependents to U.S. citizens, U.S. resident aliens, and residents of Canada or Mexico.1Internal Revenue Service. Topic No. 857, Individual Taxpayer Identification Number (ITIN) The ITIN itself only satisfies the identification requirement on your return; it does not substitute for a Social Security Number when a credit’s statute demands one.
Who Qualifies as an ITIN Dependent
Before anything else, confirm the residency rule. A relative living entirely outside the United States, Canada, or Mexico cannot be claimed no matter how much you support them. That single rule disqualifies more claims than any other issue with ITIN dependents.
From there, the person has to fit one of two categories.
Qualifying Child
A qualifying child must be your child, stepchild, foster child, sibling, stepsibling, or a descendant of any of those. They must be under 19 at year-end, under 24 if a full-time student, or permanently and totally disabled at any age.2Internal Revenue Service. Understanding Taxes – Dependents They must have lived with you more than half the year (residency in Canada or Mexico satisfies this test), they cannot have provided more than half their own support, and they must be younger than you unless permanently disabled.
Qualifying Relative
If the person is not a qualifying child, they may still be claimed as a qualifying relative. That category covers parents, siblings, aunts, uncles, certain in-laws, or anyone who lived in your home as a household member for the entire year. Their gross income for the year must fall below the IRS threshold, most recently published at $5,050 and adjusted annually for inflation.3Internal Revenue Service. Dependents You must have provided more than half of their total support.
Failing any single test disqualifies the claim. Keep records of living arrangements, school enrollment, and financial support; the IRS can ask for proof of each element.
What You Can and Can’t Claim With an ITIN Dependent
This is where the ITIN costs real money. Federal credits with statutory Social Security Number requirements are off the table, and those happen to be the biggest ones.
Credit for Other Dependents: Available
An ITIN dependent who passes the dependency tests qualifies you for the Credit for Other Dependents, worth up to $500.4Internal Revenue Service. Understanding the Credit for Other Dependents The ODC is non-refundable. It reduces the tax you owe dollar for dollar, but once your liability reaches zero any remaining credit is lost. The ITIN must be assigned by the due date of your return, including extensions, or the credit is denied for that year.5Internal Revenue Service. Individual Taxpayer Identification Number (ITIN)
Child Tax Credit and Additional Child Tax Credit: Not Available
Federal law requires a qualifying child to have a valid Social Security Number issued before the return’s due date for the taxpayer to receive the Child Tax Credit.6Office of the Law Revision Counsel. 26 USC 24 – Child Tax Credit An ITIN does not count. The same restriction applies to the refundable Additional Child Tax Credit. A child with an ITIN instead of an SSN drops you from the CTC entirely down to the $500 ODC.
The taxpayer claiming the CTC must also have a valid SSN (or, for joint filers, at least one spouse must). If both parent and child lack SSNs, neither the CTC nor the ODC is available.
Earned Income Tax Credit: Not Available for That Child
The EITC has its own strict SSN rule. Both the taxpayer and every qualifying child claimed for the credit must have Social Security Numbers issued on or before the return’s due date.7Internal Revenue Service. Who Qualifies for the Earned Income Tax Credit A dependent with an ITIN cannot count as a qualifying child for EITC purposes.8Office of the Law Revision Counsel. 26 USC 32 – Earned Income
If you have a valid SSN and otherwise qualify for the childless EITC, you can still claim that smaller amount. Listing an ITIN dependent on your return does nothing to increase it. For 2026, the maximum EITC for taxpayers with qualifying children is $8,231.9Internal Revenue Service. IRS Releases Tax Inflation Adjustments for Tax Year 2026, Including Amendments From the One, Big, Beautiful Bill If your dependent later gets an SSN, you may be able to amend prior returns to claim the CTC and EITC retroactively for open tax years.
Head of Household: Available
Filing status is not blocked by the ITIN. You can file as head of household if your ITIN dependent is a qualifying child or a related qualifying relative.5Internal Revenue Service. Individual Taxpayer Identification Number (ITIN) Head of household gives you a larger standard deduction and wider brackets than single filing, so claim it when you qualify.
Getting the ITIN in Place Before You File
The dependent needs an ITIN (or SSN) on the return. If they do not have one yet, you apply for it at the same time you file.
How the Application Works
The ITIN application is IRS Form W-7, and it must be submitted with a completed federal tax return that claims the dependent.10Internal Revenue Service. About Form W-7, Application for IRS Individual Taxpayer Identification Number On the W-7, check box “d” for “Dependent of U.S. citizen/resident alien.”11Internal Revenue Service. Form W-7 (Rev. December 2024)
You need proof of identity and foreign status. An unexpired passport is the simplest option because it covers both in one document.5Internal Revenue Service. Individual Taxpayer Identification Number (ITIN) For a dependent using a passport as the standalone document, it must include a date-of-entry stamp into the United States. Without that stamp, or without a passport, you supply a combination of civil birth certificate, national ID, visa, school records, or medical records, with age-based rules on what counts as residency proof.12Internal Revenue Service. Instructions for Form W-7
Documents must be originals or copies certified by the issuing agency. Notarized copies of foreign documents are not accepted. Current processing takes about 11 weeks, and the IRS holds your originals during that time.13Internal Revenue Service. ITIN Documentation Frequently Asked Questions Two alternatives let you keep the originals: a Certified Acceptance Agent can verify them and send certified copies to the IRS, or you can bring them to an IRS Taxpayer Assistance Center appointment for on-site verification.
If April Is Close and the ITIN Isn’t Ready
File Form 4868 by the April deadline and write “ITIN TO BE REQUESTED” in the SSN/ITIN field.5Internal Revenue Service. Individual Taxpayer Identification Number (ITIN) That gives you until October 15 to file without late-filing penalties. Do not attach Form W-7 to the extension.
The extension covers filing, not payment. If you expect to owe, pay as much as you can by April to keep interest from accruing. You can make estimated payments without an ITIN.
Watch for Expiration
An ITIN not used on a federal return for three consecutive years expires on December 31 after the third year of non-use. Filing with an expired ITIN can delay processing, disqualify credits, and reduce your refund.14Internal Revenue Service. How to Renew an ITIN Renewal uses the same Form W-7 and the same documentation. Start renewal well before tax season; waiting until March forces a choice between filing with an expired ITIN and losing months to an extension.
Avoiding a Rejection
The most preventable cause of ITIN rejection is a mismatch between Form W-7 and the supporting documents. Names must be spelled identically across the W-7, the tax return, and every identity document. Dates of birth must match. If a foreign document lists the surname first, the W-7 has to follow the same order.
If the IRS needs more information, it sends a CP566 notice. Respond promptly with exactly what the notice asks for. Ignoring it leads to a CP567 rejection, and then you start over. Resubmitting the same documents that triggered the problem changes nothing. Running the package past a Certified Acceptance Agent before it goes to the IRS is the cheapest way to catch these errors before they cost you a filing season.
