An Individual Taxpayer Identification Number and immigration status are two separate things, and getting an ITIN does not change, improve, or endanger your status in any direction. What an ITIN Actually Is
The ITIN program dates to 1996 and exists so people with a federal tax filing or reporting obligation can comply with the law even without a Social Security Number.2eCFR. 26 CFR 301.6109-1 – Identifying Numbers Typical holders include nonresident aliens with U.S.-source income, foreign nationals claimed as dependents, and spouses on joint returns. The number links your payments, withholdings, and credits to a single record inside the IRS. Why Getting an ITIN Does Not Change Your Immigration Status
The IRS issues ITINs based on whether you have a tax obligation, not on whether you are authorized to be in the country. The agency operates independently from the Department of Homeland Security and U.S. Citizenship and Immigration Services. An ITIN does not establish lawful presence, does not provide legal residency, and does not offer protection against removal.1Internal Revenue Service. The reverse is also true: having an ITIN does not make your status worse. If you already have lawful status, an ITIN neither adds to it nor subtracts from it. If you are undocumented, applying for one does not, by itself, transmit that information to immigration authorities. Congress set the program up so the IRS could focus on collecting revenue rather than screening people’s immigration paperwork, and the separation between the two systems has held.
An ITIN Is Not Work Authorization

The distinction matters because people sometimes assume the two things travel together. They don’t. The IRS issues ITINs so income already earned can be reported. Whether the underlying work was authorized is an immigration question, decided under a different body of law by a different agency.
Does Filing With an ITIN Put You on Immigration’s Radar
This is the practical fear behind most searches on this topic, and federal law addresses it directly. Internal Revenue Code Section 6103 makes tax returns and return information confidential. Exceptions exist but are narrow. Under Section 6103(i), a federal district court judge can issue an ex parte order releasing return information for a federal criminal investigation, but only after the government shows reasonable cause to believe a specific crime was committed, that the tax records are relevant, and that the information cannot reasonably be obtained elsewhere.5Office of the Law Revision Counsel. 26 USC 6103 – Confidentiality and Disclosure of Returns and Return Information A routine immigration inquiry does not clear that bar. The confidentiality rule was written this way on the theory that people would stop filing if they thought their tax information would be used against them in non-tax matters.
What an ITIN Actually Does for You
Once the immigration confusion is out of the way, the number is more useful than people expect, just not in the ways they usually think.
Banking
Major banks accept ITINs in place of Social Security Numbers when opening checking and savings accounts. Wells Fargo, for example, lists an ITIN as an acceptable identification number for opening an Everyday Checking account online or at a branch.6Wells Fargo. Credit History
All three major credit bureaus allow ITIN holders to build credit files. Because the ITIN shares the same nine-digit format as an SSN, you can use it to request your free annual credit reports through AnnualCreditReport.com; the bureaus verify identity through their own procedures.7Annual Credit Report. Mortgages
Some lenders offer mortgage products designed for ITIN holders, most often credit unions, community development financial institutions, and smaller independent banks rather than the large national lenders. These loans typically carry higher interest rates and may require larger down payments.
Starting a Business
An ITIN does not prevent you from owning a business. If you need an Employer Identification Number, the IRS online EIN application accepts an ITIN as the responsible party’s taxpayer identification number as long as the principal place of business is in the United States or a U.S. territory.8Internal Revenue Service. What an ITIN Does Not Unlock
The Earned Income Tax Credit requires a Social Security Number valid for employment. Filing with an ITIN makes you ineligible for the EITC even if you meet every other income and residency test.9Internal Revenue Service. Who Qualifies for the Earned Income Tax Credit (EITC)
The Child Tax Credit has a similar rule: a qualifying child must have an SSN issued before the return’s due date, including extensions. A child with only an ITIN does not qualify for the CTC or the Additional Child Tax Credit.10Internal Revenue Service. Federal public benefits are also largely off limits. The Personal Responsibility and Work Opportunity Reconciliation Act broadly restricts means-tested assistance, including SNAP, Supplemental Security Income, and cash assistance, to people who have an SSN.13U.S. Department of Health and Human Services. The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 ITIN holders also cannot receive Social Security retirement or disability benefits, even when they have paid into the system through payroll and self-employment taxes.
If Your Status Changes and You Get an SSN
If your immigration situation changes and you become eligible for a Social Security Number, notify the IRS so it can merge your tax records. Once you have an SSN, you must stop using the ITIN entirely; the IRS voids the ITIN and associates your prior filings with the new SSN.14Internal Revenue Service. Additional ITIN Information You can do this in person at a local IRS office or by mailing a letter with your full name, mailing address, ITIN, a copy of your Social Security card, and a copy of the CP 565 notice (the original ITIN assignment letter) if you have it. If you skip this step, records can stay split between two numbers, which can cost you credit for wages and withholdings and can create discrepancies that draw IRS scrutiny.
The through-line is simple. An ITIN is a tax number with some useful financial side effects. It has no weight in the immigration system in either direction, and treating it as anything more than a tax tool is where people get into trouble.
