A passport name change after marriage is not required to keep the passport valid, but most people update it to avoid friction at airline counters and border crossings. U.S. Customs and Border Protection confirms that citizens can still travel internationally on a passport in their prior name as long as they carry proof of the name change, such as a marriage certificate, divorce decree, or court order.1U.S. Customs and Border Protection. US Citizens and Lawful Permanent Residents Name Does Not Match Documents Updating the passport itself costs nothing if you act within a year of issuance, and it stays a straightforward mail-in process after that.
You Can Still Travel on the Old Passport
A legal name change does not void your passport. CBP’s guidance is explicit: U.S. citizens may travel using a passport in their prior name, provided they carry documentation showing how the name changed.1U.S. Customs and Border Protection. US Citizens and Lawful Permanent Residents Name Does Not Match Documents
The friction point is airline ticketing. TSA requires the name on your boarding pass to match the government ID you show at the checkpoint. Book under your new legal name with an old-name passport and you’ll need to produce the marriage certificate every time. Book under your old name and it clashes with your driver’s license once that’s updated. For anyone flying more than occasionally, updating the passport is the cleaner fix.
Which Form to Use
The State Department uses three forms for passport name changes, and eligibility turns on timing more than anything else.2U.S. Department of State. Name Change for U.S. Passport or Correct a Printing or Data Error
Form DS-5504: Free Update Within One Year
Use DS-5504 if both of these are true: your passport was issued less than a year ago, and your name changed less than a year after it was issued. Both conditions have to be met. A three-month-old passport plus a recent marriage qualifies. A two-year-old passport plus a recent marriage does not. DS-5504 is submitted by mail, and there is no application fee.2U.S. Department of State. Name Change for U.S. Passport or Correct a Printing or Data Error
Form DS-82: Renewal by Mail
If more than a year has passed, most people use DS-82 to renew by mail. You’re eligible if your most recent passport is undamaged, was issued when you were 16 or older, was issued within the last 15 years, and hasn’t been reported lost or stolen. You have to send in the passport itself along with a certified name-change document.3U.S. Department of State. U.S. Passport Renewal Application for Eligible Individuals
Form DS-11: Apply in Person
DS-11 is for anyone who doesn’t qualify for mail-in renewal. That usually means the passport is more than 15 years old, was issued before you turned 16, or has been lost, stolen, or damaged. You apply in person at a passport acceptance facility, which is typically a post office, clerk of court, or public library that offers the service.4U.S. Department of State. Documents to Include
Every name-change application needs your current passport, a new color passport photo, and an original or certified copy of the document proving the name change. That document has to show both your old and new names, which a marriage certificate, divorce decree, or court order will.2U.S. Department of State. Name Change for U.S. Passport or Correct a Printing or Data Error The originals come back to you by mail, usually in a separate envelope from the new passport.
DS-11 applicants have more to gather: separate evidence of U.S. citizenship, such as a birth certificate or naturalization certificate, along with a photocopy, plus a valid government-issued ID and a photocopy of it. If you’ve used a new name for years without formal paperwork, the State Department may accept Form DS-60, an affidavit signed by two people who have known you by both names, supported by three certified or original public records showing five years of use.2U.S. Department of State. If the Name Change Is Part of a Gender Transition
Current State Department policy issues passports with the sex marker matching the holder’s sex assigned at birth. If your existing passport has a marker that reflects your gender identity, submitting a name-change application could prompt the State Department to update the marker to match birth records as well.10Lambda Legal.
