VA disability compensation is not taxed. It is excluded from federal gross income under 26 U.S.C. 104(a)(4), and 38 U.S.C. 5301 exempts VA benefit payments from taxation more broadly.1Office of the Law Revision Counsel. 26 USC 104 – Compensation for Injuries or Sickness2Office of the Law Revision Counsel. 38 USC 5301 – Nonassignability and Exempt Status of Benefits That is true at every disability rating, from 10% to 100%, and it is true in every state. The complications that catch veterans each filing season are not about the disability check itself. They are about what happens next to military retirement pay, Social Security, tax credits, and retroactive ratings.
Nothing to Report, No Form to Expect
You will not receive a 1099 or W-2 for your VA disability payments, and you should not enter them anywhere on your federal return.3VA News. Tax Season Guidance for Veterans IRS Publication 525 states plainly that disability compensation and pension payments paid to veterans or their families are not included in income.4Internal Revenue Service. Publication 525 (2025), Taxable and Nontaxable Income
If VA disability is your only source of income, you likely do not need to file at all.5Internal Revenue Service. Veterans Tax Information and Services Filing can still be worthwhile if you qualify for a refundable credit, but there is no reporting obligation attached to the disability pay itself.
Military Retirement Pay Is the Real Tax Question
Military retirement pay is fully taxable. VA disability pay is fully tax-free. For a veteran who qualifies for both, the interaction decides how much ends up on a taxable 1099-R.
Historically, you had to waive a dollar of taxable retirement pay for every dollar of tax-free VA disability. Two programs changed that for qualifying retirees:
- Concurrent Retirement and Disability Pay (CRDP) restores the retired pay that would otherwise be offset, for retirees with a VA rating of 50% or higher. CRDP is taxable, like regular retired pay.6Military Compensation and Financial Readiness. Concurrent Retirement and Disability Payments (CRDP) and Combat-Related Special Compensation (CRSC)
- Combat-Related Special Compensation (CRSC) is for retirees whose disabilities stem from combat, hazardous duty, or similar qualifying events. CRSC is not taxable.7Defense Finance and Accounting Service. CRDP-CRSC-FAQs
You cannot collect both for the same disability. DFAS automatically pays whichever option is higher gross, but higher gross is not always higher net. A $2,000 CRSC payment arrives untaxed; a $2,200 CRDP payment can net less after federal and state tax. If you qualify for both, run the comparison before accepting the default.
Other VA Benefits That Are Also Tax-Free
The exemption in 38 U.S.C. 5301 reaches well beyond the monthly disability check. The IRS confirms that the following are not included in income:5Internal Revenue Service. Veterans Tax Information and Services

- Grants for specially adapted housing and for vehicles modified for veterans with limb loss or vision impairment.
The VA home loan guaranty is not income either. It is a guarantee to the lender, not a payment to you, so there is nothing to report.
State Income Tax Treatment
No state taxes VA disability compensation as income. Every state that has an income tax starts from federal adjusted gross income or federal taxable income, and because the disability pay is already excluded there, it never enters the state calculation. States without an income tax, including Texas, Florida, and Nevada, remove the question entirely.
State treatment diverges once you move off income tax. Property tax reductions or full exemptions on a primary residence are common for veterans with service-connected disabilities, and the benefit often scales with the rating. Dollar amounts, eligibility rules, and application deadlines vary significantly from state to state, and some states also offer breaks on vehicle registration or sales tax. For specifics, contact your county assessor or state department of veterans affairs.
Where Tax-Free VA Pay Can Still Change Your Return
Being excluded from gross income does not mean VA disability is invisible to every part of the tax code. A few credits and thresholds work differently because of it.
Earned Income Tax Credit
VA disability compensation does not count as earned income for the EITC.11Internal Revenue Service. Disability and the Earned Income Tax Credit (EITC) If disability pay is your only income, you will not qualify, because the credit requires wages or self-employment earnings. If you also received nontaxable combat pay during active duty, you can elect to include that combat pay as earned income for EITC purposes, which can increase the credit or create eligibility that would not otherwise exist.12Internal Revenue Service. Military and Clergy Rules for the Earned Income Tax Credit
Social Security Benefits
Social Security becomes partially taxable when combined income exceeds $25,000 for single filers or $32,000 for joint filers.13Internal Revenue Service. Publication 907 (2025), Tax Highlights for Persons With Disabilities VA disability pay is excluded from gross income, so it does not count toward those thresholds. A veteran living on VA disability and Social Security often sees the Social Security remain fully untaxed because the disability pay never gets added to the combined-income calculation.
Education Credits
If you claim the American Opportunity Credit or another education credit, subtract any VA education payments from the tuition and fees you use to calculate the credit. You cannot use tax-free VA money to pay a tuition bill and then claim a credit for that same bill.
Retroactive Ratings and Amended Returns
When the VA grants a disability rating retroactively, veterans often discover they paid federal tax on retirement pay that should have been offset by tax-free disability compensation. The IRS allows you to recover that money, and it extends the normal refund window to do it.
The usual rule gives you three years from filing (or two years from paying the tax, whichever is later) to claim a refund on Form 1040-X.14Internal Revenue Service. Instructions for Form 1040-X For retroactive VA disability determinations, the IRS adds one year from the date of the determination, with a hard outer limit: the extended period cannot reach any tax year that began more than five years before the determination date.15Internal Revenue Service. Frequently Asked Questions Regarding Disabled Veterans Pension Income
A retroactive rating granted in June 2026, for example, lets you amend returns back to tax year 2021, even if the normal three-year window has closed on some of them. Each amended return recalculates taxable income by excluding the VA disability pay that should never have been taxed. Refunds across multiple years can run into the thousands.
Student Loan Discharge for Total and Permanent Disability
Veterans with a total and permanent disability (TPD) rating can have federal student loans discharged. The American Rescue Plan Act made all student loan forgiveness tax-free at the federal level through 2025. That broad provision expired on January 1, 2026, and some discharges became taxable again.
TPD discharges for disabled veterans appear to keep their tax-free treatment. Federal student aid guidance states that loan balances discharged due to TPD are not considered income for federal tax purposes if the discharge occurs on or after January 1, 2018, and that you do not need to include a Form 1099-C you receive after a TPD discharge on your federal return. State tax treatment can differ, so check with your state tax department if your discharge comes through in 2026 or later.
