If USCIS is taking longer than expected on your case, you have a defined escalation path: confirm you’ve crossed the agency’s formal inquiry date, submit an e-Request, then work up through expedite requests, premium processing (if your form qualifies), the CIS Ombudsman, a congressional inquiry, and ultimately a federal mandamus lawsuit. Each step has its own trigger and its own realistic chance of moving your case, and none of them help if you let your address or work permit lapse in the meantime.
Confirm Your Case Is Actually Delayed
Start with the USCIS Case Status Online tool at egov.uscis.gov. Enter the 13-character receipt number from your Form I-797 Notice of Action (three letters followed by ten digits).1U.S. Citizenship and Immigration Services. Case Status Online – Case Status Search The tool shows the last recorded action on your file. A status that hasn’t changed in months doesn’t necessarily mean anything is wrong, but it tells you nothing has moved.
The number that matters more is your case inquiry date. On the USCIS processing times page, select your form type, category, and the office handling your case, and enter your receipt date.2U.S. Citizenship and Immigration Services. Processing Times – Case Status Online The tool calculates a specific date. If today is past that date, you’re eligible to file a formal inquiry. If not, USCIS won’t accept one yet, even if you’re already past the general posted estimate.
Here’s the wrinkle. The posted estimate reflects the time it took to finish 80% of cases at that office over the past six months.3U.S. Citizenship and Immigration Services. Why Cases Get Stuck
Volume is the main driver. I-485 (adjustment of status), I-765 (employment authorization), and I-130 (family-based) petitions consistently generate large backlogs, and staffing at service centers and field offices doesn’t always keep pace.
Background and security checks are the other common source of delay. Every applicant is screened across federal agencies, and for naturalization USCIS collects fingerprints and requests an FBI name check that has to clear before an interview can be scheduled.5U.S. Citizenship and Immigration Services. Keep Your Address Current Before You Do Anything Else
A missed notice can end your case. If USCIS mails a request for evidence or an interview notice to an old address, the case can be denied or treated as abandoned. Federal law requires most noncitizens to report an address change within 10 days of moving; A and G visa holders and visa waiver visitors are exempt.6U.S. Citizenship and Immigration Services. Update through your USCIS online account, using the Enterprise Change of Address tool under “My Account.” Enter the receipt number for each pending case so the update applies to all of them.7U.S. Citizenship and Immigration Services. Contact USCIS and File an e-Request
The USCIS Contact Center is 800-375-5283 (TTY 800-767-1833), with live agents Monday through Friday, 8 a.m. to 8 p.m. Eastern. Callers outside the United States use 212-620-3418.8U.S. Citizenship and Immigration Services. For a case past the inquiry date, the formal channel is the e-Request portal at egov.uscis.gov/e-request.9U.S. Citizenship and Immigration Services. e-Request – Self Service Tools Submitting there creates a service request with a tracking number, which becomes your paper trail for later escalation. You’ll need your receipt number, form type, and the office processing your case. If USCIS doesn’t respond substantively within about 30 days, you have what you need to move to the next step.
Request an Expedite
An expedite request asks USCIS to jump your case ahead of others. It’s free, but approval is discretionary and generally requires documented proof of one of the following:10U.S. Citizenship and Immigration Services. Expedite Requests
- Severe financial loss to a person or company, such as risk of business failure, loss of a critical contract, or layoffs. Simply needing work authorization is not enough on its own.
- A humanitarian emergency involving serious illness, disability, death of a close family member, or extreme conditions from natural disaster or armed conflict.
- An IRS-designated nonprofit’s urgent need tied to a specific beneficiary’s cultural or social role.
- A government interest identified by a federal, state, tribal, or local agency for public safety, national security, or other pressing reason, submitted by someone with authority to speak for that agency.
- A clear USCIS error with an urgent need to correct it.
Submit the request by calling the Contact Center, using Emma, or sending a secure message through your USCIS online account with “expedite” selected as the reason. Have your receipt number and supporting documents ready. Any document not in English needs a certified translation.
Pay for Premium Processing If Your Form Qualifies
Premium processing is a different mechanism. Rather than asking for hardship-based prioritization, you pay a fee and USCIS commits to taking action within a set number of business days or refund the fee.11U.S. Citizenship and Immigration Services. It does not guarantee a favorable outcome, and it isn’t available for every form.

- Most I-129 (nonimmigrant worker) and I-140 (immigrant worker) petitions: 15 business days, $2,965.
- I-765 (employment authorization): 30 business days, $1,780.
- I-539 (change of status to F, J, or M): 30 business days, $2,075.
- I-140 for multinational executives/managers and national interest waivers: 45 business days, $2,965.
File Form I-907 with the appropriate fee. The clock starts when USCIS receives a properly completed I-907. If USCIS issues a request for evidence, the clock stops and a full new countdown begins only after USCIS receives your response.
Escalate to the Ombudsman or Your Member of Congress
If e-Requests and direct inquiries produce nothing, the Office of the Citizenship and Immigration Services Ombudsman is the next step. This independent office within the Department of Homeland Security can intervene on individual cases. File DHS Form 7001, Request for Case Assistance, and include your USCIS service request tracking numbers, since the Ombudsman expects you to have tried USCIS first.13U.S. Department of Homeland Security. Your U.S. Representative or Senator has caseworkers who handle immigration inquiries and communicate with USCIS liaison units. Contact the local office, explain the situation, and provide your receipt number and a signed privacy release the office will give you. A response from the USCIS Congressional Liaison Office generally comes within roughly 30 business days, though some cases take longer and some don’t resolve through this channel alone.
File a Mandamus Lawsuit
When administrative options are exhausted and the case still hasn’t moved, the last option is federal court. A writ of mandamus under 28 U.S.C. ยง 1361 asks a federal judge to order USCIS to adjudicate your pending application.14Office of the Law Revision Counsel. 28 U.S. Code 1361 – Action to Compel an Officer of the United States to Perform His Duty You aren’t asking the court to approve your case. You’re asking the court to force a decision, whatever it turns out to be.
Courts weigh six factors known as the TRAC factors, which look at whether the delay follows a rule of reason, whether a statutory timeline applies, whether health and welfare are at stake, whether expediting would disrupt higher-priority work, and how badly the applicant has been prejudiced. Bad faith by the agency is not required. Filing fees for a civil action in federal court run around $405. Immigration attorneys generally report that the government adjudicates the underlying case within 60 to 90 days of being served rather than litigate, though that outcome is not guaranteed.
This step requires an attorney comfortable with federal litigation. Initial consultation fees typically run $150 to $400, with hourly rates from $150 to $700 depending on location and complexity. The strongest mandamus cases involve wait times far past the processing estimate, documented prior attempts through administrative channels, and clear prejudice to the applicant.
Protect Your Work Authorization While You Wait
If your employment authorization document (EAD) will expire during the wait, your first priority is the renewal itself, not any inquiry about processing times. A timely-filed renewal under an eligible category code, submitted before October 30, 2025, can qualify for an automatic extension of work authorization of up to 540 days from the expiration date printed on your current EAD.15U.S. Citizenship and Immigration Services. The word that carries the weight is “timely.” If your EAD expires before you file the renewal, you lose the automatic extension, and no expedite request, congressional inquiry, or lawsuit will fix a work-authorization gap retroactively.
