Is There Government Help With Credit Card Debt?

Government help with credit card debt is real, but it does not come as a check. Washington does not pay off private balances, and no federal agency hands out grants to clear what you owe a card issuer. What the government does offer is a set of tools: approved nonprofit credit counseling, a complaint and refund system at the Consumer Financial Protection Bureau, legal limits on what debt collectors can do, an interest rate cap for active-duty service members, and the federal bankruptcy courts, which can legally discharge credit card debt. Used well, these can lower your rate, stop harassment, or wipe the balance out entirely.

Government Grants for Credit Card Debt Do Not Exist

Credit card accounts are private contracts between you and a lender, and the federal government does not use tax dollars to satisfy them. The Treasury does not issue checks for personal debt consolidation, and no federal program pays off consumer credit cards. Any website or caller promising a “government grant” to clear your balances is almost certainly a scam.

With that boundary set, the help that actually exists is substantial.

Federally Approved Credit Counseling

The U.S. Trustee Program, part of the Department of Justice, approves and publishes a list of nonprofit credit counseling agencies that meet federal standards for consumer education and protection. You can verify any agency on the Department of Justice website for your judicial district. Approved agencies must charge reasonable fees and must provide services regardless of your ability to pay.1Office of the Law Revision Counsel. 11 USC 111 – Nonprofit Budget and Credit Counseling Agencies; Financial Management Instructional Courses

Beyond one-time advice, these agencies can enroll you in a debt management plan. You make one monthly payment to the agency, which distributes it to your creditors on a negotiated schedule. In practice, this usually means a reduced interest rate on each card, often down to single digits compared with the 20% or higher rates many cards carry, along with waived late and over-limit fees. Most plans run three to five years, and you generally cannot open new credit accounts while enrolled.

The counseling agencies themselves are private nonprofits, not a government program. The federal approval process is what gives you a reliable way to find legitimate help instead of a scam.

Filing a Complaint With the CFPB

If a card issuer is charging incorrect fees, miscalculating interest, or acting unfairly, you can submit a formal complaint through the Consumer Financial Protection Bureau’s online portal. The bureau forwards your complaint to the company, which typically responds within 15 days, with up to 60 days allowed in more complex cases.2Consumer Financial Protection Bureau. Submit a Complaint About a Financial Product or Service A complaint will not erase your balance, but it can resolve billing errors, unauthorized charges, and unfair collection tactics.

The CFPB also brings enforcement actions against card companies that break consumer protection laws. When it prevails, affected consumers can receive refunds through the company, through the bureau, or through distributions from its Civil Penalty Fund.3Consumer Financial Protection Bureau. Payments to Harmed Consumers by Case You can receive a check from one of these cases without ever filing your own complaint, if you were among the affected customers.

Protections Against Debt Collectors

Once a credit card debt is turned over to a third-party collector, the federal Fair Debt Collection Practices Act limits what that collector can do.4Office of the Law Revision Counsel. 15 USC 1692 – Congressional Findings and Declaration of Purpose The law covers companies that buy or are hired to collect debts originally owed to someone else. It does not apply to the original card issuer collecting its own debt, though some states extend similar rules to original creditors.

Collectors cannot contact you before 8 a.m. or after 9 p.m. local time, and cannot call at times or places they know are inconvenient for you.5Office of the Law Revision Counsel. 15 USC 1692c – Communication in Connection with Debt Collection They cannot use obscene or abusive language.6Office of the Law Revision Counsel. 15 US Code 1692d – Harassment or Abuse They cannot misrepresent the amount you owe or threaten actions they are not legally allowed to take, such as arrest or wage garnishment without a court order.

Demanding Verification of the Debt

Within five days of first contacting you, a collector must send a written notice listing the amount owed and the name of the creditor. You then have 30 days from receiving that notice to dispute the debt in writing. If you dispute it in that window, the collector must stop collection activity on the disputed amount until it sends you verification that the debt is real and the amount is correct.7Office of the Law Revision Counsel. 15 USC 1692g – Validation of Debts

Stopping Contact and Suing for Violations

You can also write to tell the collector to stop contacting you. Once it receives that letter, further communication is limited to confirming it will stop or notifying you of a specific legal action.5Office of the Law Revision Counsel. 15 USC 1692c – Communication in Connection with Debt Collection This stops the calls. It does not eliminate the debt, and the collector or creditor can still sue you.

If a collector violates the law, you can sue in federal or state court. A successful claim can recover your actual damages, up to $1,000 in additional statutory damages per case, plus attorney’s fees and costs.8Office of the Law Revision Counsel. 15 US Code 1692k – Civil Liability

Active-Duty Military: The 6% Interest Cap

Active-duty service members get a specific form of relief under the Servicemembers Civil Relief Act. If you took on credit card debt before entering active duty, the SCRA caps the interest rate on that debt at 6% per year during your service. The interest above 6% is forgiven, not deferred, and your monthly payment must be reduced by the forgiven amount. The cap applies to joint debts with a spouse. Under the SCRA, “interest” is defined broadly to include service charges, renewal charges, and fees.9Office of the Law Revision Counsel. 50 US Code 3937 – Maximum Rate of Interest on Debts Incurred Before Military Service

To activate the cap, send your card company a written request with a copy of your military orders or a letter from your commanding officer showing when active duty began. You can submit the request while on active duty or within 180 days after release.10Consumer Financial Protection Bureau. Servicemembers Civil Relief Act (SCRA) The protection only covers debts incurred before active duty. Charges made after you enter service are not covered.

Bankruptcy: The Government’s Discharge Tool

The most powerful federal tool for eliminating credit card debt is bankruptcy under Title 11 of the United States Code.11Office of the Law Revision Counsel. Title 11 – Bankruptcy A bankruptcy discharge is a court order that legally wipes out qualifying debts. For most individuals, two chapters matter.

Chapter 7 Liquidation

Chapter 7 is the faster path. A court-appointed trustee reviews your assets and can sell nonexempt property to repay creditors. In exchange, most unsecured debts, including credit card balances, are discharged, typically within three to five months. The filing fee is $338.

Not everyone qualifies. You must pass a means test comparing your income to the median for a household of your size in your state. Income below the median generally qualifies you. Income above it triggers a closer look at your expenses to see whether you have enough disposable income to repay a meaningful share of your debts. If the court finds you do, it may require you to file under Chapter 13 instead.12Office of the Law Revision Counsel. 11 US Code 707 – Dismissal of a Case or Conversion to a Case Under Chapter 11 or 13

Chapter 13 Repayment Plan

Chapter 13 lets you keep your property but requires a court-approved repayment plan lasting three to five years. You pay a trustee each month, and the trustee pays your creditors. Any unsecured credit card debt not fully repaid at the end of the plan is discharged. The filing fee is $313. People often use Chapter 13 when they have steady income but need time to catch up on secured debts like a mortgage, or when they do not pass the Chapter 7 means test.

The Automatic Stay

The moment you file, under either chapter, an automatic stay takes effect. It halts collection calls, lawsuits, wage garnishments, and other creditor action while the case is pending.11Office of the Law Revision Counsel. Title 11 – Bankruptcy That protection kicks in before any debt is actually discharged.

What Bankruptcy Costs You

A bankruptcy filing appears on your credit report for seven years for Chapter 13 and ten years for Chapter 7. Not every debt is dischargeable: student loans, most tax debts, and child support typically survive. Before filing, you must complete credit counseling from an approved agency within 180 days of your petition.1Office of the Law Revision Counsel. 11 USC 111 – Nonprofit Budget and Credit Counseling Agencies; Financial Management Instructional Courses

Taxes on Forgiven or Settled Credit Card Debt

If a creditor cancels $600 or more of your credit card debt, whether through a settlement, a debt management plan, or any other arrangement, it must report the forgiven amount to the IRS on Form 1099-C.13Internal Revenue Service. About Form 1099-C, Cancellation of Debt The forgiven amount generally counts as taxable income on your federal return. Two exclusions can wipe out or shrink that tax hit.

  • Debt discharged in a Title 11 bankruptcy case is excluded from gross income entirely, and this exclusion takes priority over the others.14Office of the Law Revision Counsel. 26 USC 108 – Income from Discharge of Indebtedness
  • If your total liabilities exceeded the fair market value of all your assets right before the debt was canceled, you were insolvent. You can exclude the canceled amount up to the extent of your insolvency. If you were insolvent by $8,000 and the creditor forgave $10,000, you owe tax on $2,000.14Office of the Law Revision Counsel. 26 USC 108 – Income from Discharge of Indebtedness

Claim the insolvency exclusion by filing Form 982 with your return. When calculating insolvency, include everything you own, retirement accounts and pension interests included, against all your liabilities.15Internal Revenue Service. Publication 4681 (2025), Canceled Debts, Foreclosures, Repossessions, and Abandonments People carrying heavy card debt are often insolvent without realizing it.

Spotting Debt Relief Scams

Scammers fill the gap left by the fact that no bailout exists. Federal law gives you a clear tripwire. Under the FTC’s Telemarketing Sales Rule, a for-profit debt relief company that contacts you by phone cannot collect any fee before it has actually settled or reduced at least one of your debts, you have agreed to that settlement, and you have made at least one payment under it.16eCFR. 16 CFR Part 310 – Telemarketing Sales Rule A company asking for money upfront is breaking federal rules.

Other warning signs: a guarantee that a specific percentage of your debt will be eliminated, a claim of government affiliation, or pressure to stop talking to your creditors. Report these companies to the FTC or your state attorney general.

Statute of Limitations on Credit Card Debt

Every state limits how long a creditor or collector can sue you to collect an unpaid card balance. After that window closes, the debt is time-barred and a court should dismiss any lawsuit to collect it. Limits range from about three years in some states to ten in others, with most falling between four and six years.

A time-barred debt does not vanish. A collector can still ask you to pay, and the balance can stay on your credit report for up to seven years from the first missed payment. The collector just cannot use the courts to force payment. Be careful with partial payments on old debt: in some states, a single payment restarts the clock and reopens the door to a lawsuit. If a collector contacts you about an old balance, knowing your state’s limit is one of the most important defenses you have.
