Mailing a delta-8 product is legal under federal law right now if the product is derived from hemp, tests at no more than 0.3% delta-9 THC on a dry weight basis, is not a vape, and is going to a state that allows delta-8. So the short answer to whether it is legal to mail delta-8 is: usually yes today, often no in specific situations, and mostly no starting November 12, 2026, when a new federal hemp definition takes effect.
Why Delta-8 Is Currently Mailable
The 2018 Farm Bill defined hemp as cannabis containing no more than 0.3% delta-9 THC on a dry weight basis and removed hemp from the Controlled Substances Act.1Office of the Law Revision Counsel. 7 USC 1639o – Definitions Federal drug schedules still list tetrahydrocannabinols as Schedule I but carve out an exception for tetrahydrocannabinols found in hemp.2Office of the Law Revision Counsel. 21 USC 812 – Schedules of Controlled Substances Delta-8 is a tetrahydrocannabinol that can be derived from hemp, so it slips through that gap.
That gap is narrower than sellers often admit. Hemp plants produce almost no delta-8 naturally, and virtually all commercial delta-8 is made by chemically converting CBD in a lab, a process the FDA has described as “synthetic conversion.”3U.S. Food and Drug Administration. 5 Things to Know About Delta-8 Tetrahydrocannabinol – Delta-8 THC Whether that manufacturing method still counts as “hemp-derived” is the question the November 2026 law resolves against the industry.
USPS Rules
The Postal Service accepts hemp-based products when they comply with all applicable federal, state, and local laws and the THC concentration does not exceed 0.3%. USPS adopted this policy in June 2019 after updating Publication 52.4United States Postal Service. Publication 52 Revision – New Mailability Policy for Cannabis and Hemp-Related Products Mailers must keep lab test results, licenses, and compliance records for at least three years after the mailing date.5United States Postal Service. Publication 52 – Hazardous, Restricted, and Perishable Mail You don’t have to hand those over at the counter, but USPS can request them at any time.
Vapes Are Not Mailable Through USPS
Delta-8 vape cartridges, pens, and e-liquids cannot go through the mail regardless of THC content. Congress amended the PACT Act in 2020 to classify electronic nicotine delivery systems as nonmailable, and the definition is broad enough to cover hemp vape products.6Office of the Law Revision Counsel. 18 USC 1716E – Tobacco Products as Nonmailable USPS has confirmed that hemp products under 0.3% THC remain mailable so long as they are not in vape form.7Bureau of Alcohol, Tobacco, Firearms and Explosives. Vapes and E-Cigarettes A narrow business-to-business exception exists for shipments between parties registered with the ATF and state tax authorities, but it is not available to ordinary online retailers or consumers.
What Private Carriers Accept
Federal legality sets the floor. Each carrier sets its own ceiling.
UPS
UPS accepts hemp derivatives that comply with all applicable laws. It will not accept shipments from any location that also sells marijuana products, and every domestic hemp shipment must use UPS Adult Signature Required service.8UPS. Shipping Marijuana, Hemp, and CBD For raw hemp, external packaging cannot identify the contents. Documentation showing the product contains less than 0.3% delta-9 THC on a dry weight basis must be available.
FedEx
FedEx is the most restrictive of the major carriers. Its prohibited items list bans all electronic cigarettes and vaporization devices, marijuana and marijuana-derived CBD, and any product containing THC alongside synthetic cannabinoids. FedEx also prohibits raw or unrefined hemp plants except as allowed under federal regulation.9FedEx. Prohibited Items for Shipment Hemp-derived CBD products are allowed if they contain 0.3% THC or less.10FedEx. Be Proactive About Prohibited Items Products marketed as delta-8 face rejection, account warnings, or permanent shipping bans even with compliant lab results. If you are shipping delta-8 specifically, FedEx is not a reliable option.
DHL
DHL eCommerce prohibits hemp products that contain more than 0.3% THC on a dry weight basis or that fail to comply with any applicable law. DHL also bans all hemp and hemp-based products on its international network entirely, so cross-border delta-8 shipments are off the table regardless of compliance.11DHL eCommerce. State Law Can Still Make It Illegal
Federal legality does not guarantee you can ship delta-8 to any address in the country. Roughly two dozen states ban or heavily restrict it. Some ban it outright, some limit it to licensed marijuana dispensaries, and some cap the THC content in a finished product so low that most commercial delta-8 will not qualify. Some states apply the 0.3% threshold to all THC variants rather than just delta-9, and others specifically ban cannabinoids produced through chemical conversion.12Rice University’s Baker Institute for Public Policy. Mapping Hemp Products Legal Status Across US States
Both the origin state and the destination state matter. Sending a legal product from a permissive state to a state that bans delta-8 is still illegal, and the package has to travel through the destination state’s legal framework to reach the recipient. Confiscation is the mildest consequence. Criminal charges for distribution of a controlled substance are possible depending on how the destination state classifies delta-8. Check current law in both states before every shipment.
Documentation to Keep
The core document is a Certificate of Analysis from an independent, accredited laboratory confirming that the product’s delta-9 THC concentration falls below 0.3% on a dry weight basis.8UPS. Shipping Marijuana, Hemp, and CBD A useful COA also carries the lab’s accreditation credentials, a batch number that matches your product, and a recent test date.
USPS requires mailers to retain the COA, along with any applicable licenses and compliance reports, for at least three years after mailing.13United States Postal Service. Publication 52 Revision – Hemp-based Products Update If a package is intercepted or an audit lands months later, those records are your only defense. Businesses shipping regularly should file records by batch and shipment date rather than reconstruct them after the fact.
Penalties for Shipping Non-Compliant Products
If a product doesn’t qualify as hemp under federal law, it’s a controlled substance, and mailing it through USPS becomes a federal offense. Federal drug distribution penalties scale with the substance and quantity. For smaller amounts without aggravating factors, a conviction can bring up to five years in federal prison and fines up to $250,000 for an individual.14Office of the Law Revision Counsel. 21 USC 841 – Prohibited Acts A Larger quantities or repeat offenses trigger mandatory minimums of five to ten years and fines that can reach into the millions. Prosecutors can also add mail fraud charges when USPS is involved.
Simply having a package addressed to you does not automatically create criminal liability on the recipient’s end. A prosecutor must prove knowing possession. That is a defense you raise after being charged, though, not a shield that prevents investigation, and in states that classify delta-8 as a controlled substance, possession charges can attach to the recipient too.
What Changes on November 12, 2026
Congress signed P.L. 119-37 in November 2025, and the amended federal definition of hemp takes effect on November 12, 2026.15Congressional Research Service. Change to Federal Definition of Hemp and Implications for Federal Controls Three changes will effectively end the current delta-8 mailing market:
- The 0.3% threshold will apply to total THC, including delta-8, delta-10, and other variants, not just delta-9.
- Finished hemp-derived products cannot contain more than 0.4 milligrams of THC per container. A standard delta-8 gummy contains many times that.
- Cannabinoids not naturally produced by the cannabis plant, or synthesized or manufactured outside the plant, no longer count as hemp. That excludes the CBD-to-delta-8 conversion process behind most commercial products.
Until that date, the current definition still applies at the federal level. Carriers may update their policies before the deadline, and states that haven’t already restricted delta-8 may move sooner. If you are shipping now, confirm the product’s compliance under current law, verify the destination state permits delta-8, choose a carrier that accepts the specific product type, and keep every receipt and lab report on file. After November 12, 2026, mailing most delta-8 products becomes the same as mailing any other Schedule I substance.
