Is It Illegal to 3D Print a Suppressor? Form 1 and Penalties

It is not illegal to 3D print a suppressor in most of the United States, but only if you file ATF Form 1, pass the background check, and receive written approval before you start the print. Federal law treats a suppressor as a firearm no matter how it’s built, so a device coming off a desktop printer is regulated exactly like one machined from steel. Print first and file later, and you’ve committed a federal felony that carries up to ten years in prison.

A Printed Suppressor Is Still a Suppressor Under Federal Law

The Gun Control Act defines a “firearm silencer” or “firearm muffler” to include any device designed to reduce the sound of a portable firearm’s discharge, any combination of parts intended to assemble one, and any part made solely for that purpose.1Office of the Law Revision Counsel. 18 USC 921 – Definitions That last clause is important for anyone printing at home: even an unfinished stack of printed components clearly meant to become a suppressor can qualify as one.

The National Firearms Act then classifies suppressors as “firearms” alongside machine guns and short-barreled rifles.2Office of the Law Revision Counsel. 26 USC 5845 – Definitions Method of manufacture doesn’t factor in. Steel, polymer, printed plastic: same rules.

File Form 1 and Wait for Approval Before You Print

Federal law is explicit that no one may make a firearm, suppressors included, without first filing an application, submitting fingerprints and a photograph, and receiving the Secretary’s approval.3Office of the Law Revision Counsel. 26 USC 5822 – Making For personal use, that means ATF Form 1 (Application to Make and Register a Firearm). You do not need a Federal Firearms License to make one for yourself.

The steps:

  • Submit an eForm 1 through the ATF’s online portal, describing the suppressor’s caliber, length, and materials.
  • Send two FBI FD-258 fingerprint cards to the ATF’s NFA Division within ten days of filing, or upload an electronic fingerprint file.4Bureau of Alcohol, Tobacco, Firearms and Explosives. NFA Form One Submission External Guidance
  • Send a completed copy of the application to the chief law enforcement officer where you live. This is notification only; the CLEO cannot veto the application.4Bureau of Alcohol, Tobacco, Firearms and Explosives. NFA Form One Submission External Guidance
  • Wait. As of early 2026, typical processing for an electronically filed Form 1 is around 36 days.5Bureau of Alcohol, Tobacco, Firearms and Explosives. Current Processing Times
  • Print only after approval. There is no grace period.

Starting the print before the form is approved violates the NFA in two ways at once: making a firearm outside NFA provisions, and possessing an unregistered firearm.6Office of the Law Revision Counsel. 26 USC 5861 – Prohibited Acts

The $200 Tax Stamp No Longer Applies

For decades, making a suppressor required a $200 federal tax. That changed on January 1, 2026. Under the One Big Beautiful Bill Act (H.R. 1), the making and transfer tax for suppressors, short-barreled rifles, short-barreled shotguns, and “any other weapons” dropped to zero. The revised Form 1, updated in December 2025, now states that the making of “any other type of NFA firearm” incurs a $0 making tax.7Bureau of Alcohol, Tobacco, Firearms and Explosives. The tax is gone. The application, background check, fingerprints, CLEO notification, and wait for approval are not. Machine guns and destructive devices still carry the $200 making tax.

The Detectability Problem Unique to 3D Printing

Here is the trap that catches home printers. Federal law makes it illegal to make, possess, or transfer any firearm that a walk-through metal detector cannot detect, or whose major components don’t show up on an airport-style x-ray.8Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts Because a suppressor is a firearm under federal law, this rule applies to it.

A suppressor printed entirely from plastic on a consumer-grade printer will almost certainly fail. The statute requires the firearm to be “as detectable as the Security Exemplar,” a reference object containing 3.7 ounces of stainless steel.8Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts If your printed suppressor doesn’t contain enough metal to trip a detector, you’ve violated a second federal law even with an approved Form 1 in hand.

The usual fix is embedding a metal plate or sleeve into the body. That solves the detectability issue and gives you a surface to engrave.

Marking and Serializing a Printed Body

Every suppressor made on a Form 1 must be permanently marked before it’s finished. On the frame or outer tube you need a unique serial number you haven’t used on any other firearm you’ve made, your full legal name or recognized abbreviation, and the city and state where you made it.

Markings must be engraved, cast, or stamped to a minimum depth of .003 inches, with the serial number in a print size no smaller than 1/16 of an inch, placed so they can’t be readily removed or altered.9Bureau of Alcohol, Tobacco, Firearms and Explosives. 27 CFR Part 479 – Identification of Firearms

Engraving plastic to that depth is possible, but the marking may not hold up to the “not susceptible of being readily obliterated” standard. Engraving an embedded metal plate is more reliable. The ATF also accepts marking variance requests for unusual builds.10Bureau of Alcohol, Tobacco, Firearms and Explosives. Privately Made Firearms

What Skipping the Process Costs

Making a suppressor without an approved Form 1 is a federal felony under the NFA, punishable by a fine of up to $10,000, up to ten years in prison, or both.11GovInfo. 26 USC 5871 – Penalties Willful violations of the Gun Control Act carry up to five years.12Office of the Law Revision Counsel. 18 US Code 924 – Penalties Possession of an unregistered suppressor is one of the more commonly prosecuted NFA offenses. Printing it at home instead of buying it doesn’t soften the outcome.

Who Can’t File a Form 1 in the First Place

The ATF must reject any application where approval would put the maker in violation of law. The Gun Control Act bars firearm possession by, among others, anyone convicted of a crime punishable by more than a year in prison, fugitives, unlawful users of controlled substances, people adjudicated as mentally defective or committed to a mental institution, unlawful aliens, those dishonorably discharged, people who have renounced U.S. citizenship, those subject to certain domestic restraining orders, and anyone convicted of a misdemeanor crime of domestic violence. Anyone under indictment for a crime punishable by more than a year is also barred from receiving firearms.13Bureau of Alcohol, Tobacco, Firearms and Explosives. Identify Prohibited Persons Lying on a Form 1 about any of these is itself a separate federal offense.

State Law Can Override Federal Approval

Federal compliance is only half of it. Roughly eight states and the District of Columbia prohibit suppressor possession entirely, and an approved Form 1 does not override a state ban. The other 42 states permit ownership, though some add restrictions such as bans on hunting with a suppressor.

If you live in a state that bans suppressors, the ATF will typically deny your Form 1 outright, because federal law requires the agency to reject applications where “the making or possession of the firearm would place the person making the firearm in violation of law.”3Office of the Law Revision Counsel. 26 USC 5822 – Making Check your state’s current firearms statutes before you file anything.

Two Boundaries Worth Knowing

A suppressor you make on a Form 1 is registered to you personally. You cannot sell, loan, or give it away casually: the recipient must file an ATF Form 4, submit fingerprints and photographs, pass a background check, and receive ATF approval before the suppressor changes hands.14Bureau of Alcohol, Tobacco, Firearms and Explosives. Transfers of NFA Firearms As of 2026, the transfer tax is also $0, but the approval process is unchanged.7Bureau of Alcohol, Tobacco, Firearms and Explosives. And the Form 1 track only covers personal use. Printing suppressors to sell puts you in business-manufacturer territory, which requires a Type 07 Federal Firearms License and registration as a Special Occupational Taxpayer.15Bureau of Alcohol, Tobacco, Firearms and Explosives. Federal Firearms Licenses Making them for other people without that license is a separate federal offense.
