Is Excise Tax Deductible for Individuals and Businesses?

Is excise tax deductible? For individuals, almost never. The one meaningful exception is a state or local personal property tax that is based on your property’s value, such as the value-based portion of an annual vehicle registration fee, and only if you itemize. For businesses, the answer flips: excise taxes paid in the course of a trade or business are generally deductible as ordinary and necessary operating expenses, and some fuel excise taxes can even come back as a credit.

The One Personal Deduction: Value-Based Property Tax

Individuals who itemize can deduct a state or local personal property tax, but the tax has to clear three tests. It must be based on the property’s assessed value (ad valorem), it must be imposed annually, and it must apply to personal property rather than real estate or services.1Office of the Law Revision Counsel. 26 USC 164 – Taxes

Vehicle registration is where this usually shows up. Many states calculate part of the annual registration fee from the car’s current market value, and that value-based portion qualifies. The rest does not. If your state charges a flat $75 registration fee plus a $120 charge computed from the vehicle’s depreciated value, only the $120 is deductible. Flat fees, title transfer charges, and one-time assessments never qualify no matter what the state calls them. Your registration notice generally breaks this out on its own line, and that line-item amount is what belongs on the return.2Internal Revenue Service. Instructions for Schedule A (Form 1040) (2025)

Why the SALT Cap Often Erases the Benefit

Even a qualifying personal property tax gets pooled with your other state and local taxes for deduction purposes. The combined deduction for state and local income taxes (or general sales taxes, if you elect that instead), real estate taxes, and personal property taxes is capped at $40,400 for the 2026 tax year, or $20,200 if married filing separately. The cap begins phasing down when modified adjusted gross income exceeds $505,000, but it cannot fall below $10,000.1Office of the Law Revision Counsel. 26 USC 164 – Taxes

If your state income and real estate taxes already fill the cap, the value-based portion of your vehicle registration adds nothing. And if your total itemized deductions don’t clear the standard deduction ($16,100 single, $32,200 married filing jointly, or $24,150 head of household in 2026), itemizing gives you no benefit at all.3Internal Revenue Service. You can elect to deduct state and local general sales taxes instead of state income taxes, but not both. That election is separate from the personal property tax line, which stands on its own regardless of which option you pick.4Internal Revenue Service. Topic No. 503, Deductible Taxes

The Excise Taxes Individuals Cannot Deduct

The taxes most people picture when they hear the phrase are the ones that don’t qualify. Federal excise taxes on gasoline, tobacco, alcohol, airline tickets, and indoor tanning are treated as personal consumption costs on an individual return. Even when the tax is broken out on a receipt, it isn’t based on the assessed value of something you own and isn’t imposed annually on your property, so it fails the personal property tax tests.5Internal Revenue Service. Publication 17 (2025), Your Federal Income Tax – Section: Taxes and Fees You Cannot Deduct

The 10% federal indoor tanning tax is a clean example.6Office of the Law Revision Counsel. 26 USC 5000B – Imposition of Tax on Indoor Tanning Services It’s an excise tax by name, but it’s a federal consumption tax rather than a value-based state or local property tax, so no deduction. The same logic applies to the 7.5% federal tax embedded in airline ticket prices and the per-gallon fuel taxes built into pump prices. For individuals, these are simply part of the price of the product.

How Businesses Deduct Excise Taxes

Businesses operate under a different rule. Excise taxes paid in the course of running a trade or business are generally deductible as ordinary and necessary business expenses. The tax doesn’t need to be ad valorem or annual. If the excise tax is tied to something the business uses or sells, it reduces taxable income.7Office of the Law Revision Counsel. 26 USC 162 – Trade or Business Expenses

That covers a wide range: federal environmental and Superfund taxes, the 3% communications tax on local telephone service, fuel taxes on diesel and gasoline used for business, manufacturers taxes on tires and other goods, and air transportation taxes paid on business travel.8Internal Revenue Service. Publication 510 (12/2025), Excise Taxes The same gasoline excise tax that isn’t deductible when you fill up for a weekend road trip becomes a deductible business expense when your delivery driver fills up the company van.

Sole proprietors and single-member LLCs get a bonus effect on Schedule C. Deducting these costs lowers net earnings from self-employment, which reduces self-employment tax. Self-employment tax applies to 92.35% of net earnings, so each dollar of excise tax you deduct trims roughly 14 cents in self-employment tax on top of the income tax savings.9Internal Revenue Service. Topic No. 554, Self-Employment Tax

When a Business Must Capitalize the Tax Instead

Not every business excise tax is deducted in the year paid. When you buy equipment, vehicles, or other long-term assets, any excise taxes paid at purchase get added to the asset’s cost basis rather than expensed. The IRS lists excise taxes alongside sales tax, freight, and installation as costs that must be capitalized into basis.10Internal Revenue Service. Publication 551 (12/2025), Basis of Assets – Section: Cost Basis

You still recover the cost, just more slowly through depreciation. If you buy a heavy truck chassis subject to the 12% federal retail excise tax, that tax becomes part of the truck’s depreciable basis. Bonus depreciation or Section 179 expensing can accelerate that recovery if you qualify, potentially producing the same result as an immediate deduction.

Fuel Tax Credits for Off-Highway Use

Federal fuel excise taxes are built into the price of gasoline, diesel, and kerosene at the pump, and they fund highway infrastructure. When a business burns fuel for purposes unrelated to public roads, it can claim a credit for the excise taxes already paid. That includes fuel used in farm equipment, construction machinery, forklifts, generators, and other off-highway applications.11Internal Revenue Service. Instructions for Form 4136 and Schedule A (2025)

The credit is claimed on Form 4136 and reduces income tax dollar for dollar. Only the business or person that actually purchased the fuel is eligible. Track gallons used for off-highway purposes separately from road use, and keep those records for at least three years from the date you file the return claiming the credit.

Heavy Vehicle Use Tax

Businesses operating highway vehicles with a taxable gross weight of 55,000 pounds or more owe an annual federal heavy vehicle use tax, reported on Form 2290. The tax is deductible as a business expense in the year you pay it, since it’s an ordinary cost of operating heavy commercial vehicles.12Internal Revenue Service. When Form 2290 Taxes Are Due Note that the deduction belongs in the tax year you actually pay, not the tax period the Form 2290 covers.

Where the Deduction Goes on Your Return

Individuals who itemize enter the qualifying personal property tax amount on Schedule A, line 5c. That total joins state and local income (or sales) taxes on line 5a and real estate taxes on line 5b. The combined figure on line 5d is subject to the SALT cap, and the smaller of the total or the cap flows to line 5e.13Internal Revenue Service. 2025 Schedule A (Form 1040) – Itemized Deductions

Sole proprietors deduct business excise taxes on Schedule C. Farmers use Schedule F, and rental property owners use Schedule E. Whichever schedule applies, the excise tax reduces net business income, which then lowers both income tax and, where relevant, self-employment tax.

One catch for businesses that later get money back: if you previously deducted an excise tax and then receive a credit or refund through Form 720’s Schedule C, that refund is included in gross income the year you receive it.14Internal Revenue Service. Instructions for Form 720

Records to Keep

For a personal property tax deduction, your vehicle registration renewal notice is the key document. Find the line item that shows the portion of the fee calculated from the vehicle’s assessed value. States label this differently, so if you can’t identify the qualifying amount, ask your motor vehicle agency for a breakdown. Keep the notice, the billing statement, and proof of payment.

Business filers should keep receipts, invoices, and fuel logs that tie each excise tax payment to a specific business activity. For fuel tax credits, track off-highway gallons separately. For heavy vehicle use tax, retain the stamped Form 2290 Schedule 1.

The IRS generally requires records supporting a deduction or credit to be kept for three years from the date you file the return, or two years from the date you paid the tax, whichever is later.15Internal Revenue Service. How Long Should I Keep Records? For capitalized excise taxes on equipment, keep purchase records for as long as you own the asset plus three years after filing the return that includes the final year of depreciation.
