Is BAS Taxable? LES Reporting, EITC, and Loan Qualifying

No, the Basic Allowance for Subsistence is not taxable. BAS is excluded from federal income tax, state income tax, Social Security tax, and Medicare tax. For 2026, enlisted members receive $476.95 per month and officers receive $328.48 per month, and every dollar of it lands in your account without withholding.1Defense Finance and Accounting Service. Basic Allowance for Subsistence (BAS) The catch worth knowing up front: “not taxable” is not the same as “doesn’t count.” Mortgage lenders, family courts, and federal nutrition programs all treat BAS as income even though the IRS does not.

What the Tax Exemption Actually Covers

Internal Revenue Code Section 134 excludes qualified military benefits from gross income, and BAS fits the definition because it is an allowance tied to military status that was already excludable before the statute’s 1986 benchmark date.2Office of the Law Revision Counsel. 26 USC 134 – Certain Military Benefits IRS Publication 3, the Armed Forces’ Tax Guide, lists BAS among the pay items excluded from gross income.3Internal Revenue Service. Publication 3, Armed Forces Tax Guide

The exemption reaches further than income tax. The 6.2% Social Security tax and 1.45% Medicare tax apply only to basic pay and CONUS COLA, not to allowances.4Social Security Administration. POMS SI 00830.540 – Uniformed Services Pay and Allowances The Department of Defense confirms that BAS and BAH are excluded from Social Security taxes as well as from federal and state income taxes.5Military Compensation and Financial Readiness. Tax Exempt Allowances One consequence to keep in mind: because no FICA is withheld, BAS does not build your Social Security earnings record. Over a full career the gap between total compensation and Social Security-credited wages can be significant.

State income tax follows automatically in most places. Most states start their calculation from federal adjusted gross income, and since BAS was never in that figure, it flows through as nontaxable at the state level without any action on your part.

BAS II, the doubled rate for enlisted members assigned to single government quarters without adequate food facilities, gets the same treatment. At $953.90 per month in 2026, it is entirely tax-free when the Secretary of the relevant military department authorizes it.6Office of the Law Revision Counsel. 37 USC 402 – Basic Allowance for Subsistence

How BAS Shows Up on Your LES and W-2

Your Leave and Earnings Statement lists BAS as a line item under Entitlements, separate from basic pay and other taxable entries.7Defense Finance and Accounting Service. How to Read an Active Duty Army Leave and Earning Statement The year-to-date taxable wage totals on the LES do not include it.

On the W-2 that DFAS issues after year end, BAS is omitted from Box 1 (wages), Box 3 (Social Security wages), and Box 5 (Medicare wages). You do not report BAS anywhere on your federal income tax return. Keep your own record of monthly payments anyway. You will want the number when a lender, court, or benefits office asks about your income.

BAS and the Earned Income Tax Credit

BAS does not count as earned income for the Earned Income Tax Credit, and you cannot elect to include it. The IRS lists BAS among the nontaxable military pay items excluded from the EITC earned income calculation.8Internal Revenue Service. Publication 596, Earned Income Credit (EIC)

Nontaxable combat pay is the exception people sometimes confuse with BAS. You can choose to include combat pay in your earned income figure, which may improve your EITC.8Internal Revenue Service. Publication 596, Earned Income Credit (EIC) That election is limited to combat pay. It does not extend to BAS or other nontaxable allowances, so check that any tax software you use handles the two categories separately.

When You Receive Less Than the Full BAS

Junior enlisted members living in barracks are often placed on Essential Station Messing, which assigns them to eat at a government dining facility. Under ESM, most of the BAS entitlement is deducted to cover the meal plan, and roughly $65 per month is paid to the member. Both the deduction and the remaining cash payment appear on the LES.

The tax treatment does not change. The full entitlement is nontaxable, including the portion withheld for meals. The meal deduction is an offset for food the government is already providing, not a tax.

Where BAS Still Counts as Income

The tax exemption is narrow in one important sense: it stops at the IRS. Several other systems that ask about your income include BAS in the calculation.

Mortgage and Loan Qualifying

Lenders count BAS as real income, and its tax-free status can work in your favor through a process called grossing up. Because a dollar of tax-free income has more purchasing power than a taxable dollar, underwriters add a percentage to your nontaxable income before running your debt-to-income ratio.

HUD guidelines allow FHA lenders to gross up nontaxable income, including military allowances, by the borrower’s prior-year tax rate; if you were not required to file, the default rate is 25%.9HUD.gov. HUD 4155.1 Section E – Non-Employment Related Borrower Income VA loan underwriting similarly permits grossing up of subsistence and clothing allowances, with 15% commonly used for veterans whose income is entirely nontaxable.10Veterans Benefits Administration. Grossing Up Non-Taxable Income Include your LES with your application so the lender picks up the BAS entitlement.

Child Support and Alimony

Family courts do not use IRS rules to define income. State child support guidelines nearly universally count all military compensation, including BAS, BAH, and special pay, as part of a service member’s gross income for support purposes. The federal tax exemption does not remove BAS from that calculation, because courts treat it as money available to support dependents.

SNAP and WIC

Federal nutrition programs also count BAS. For SNAP, the regulations exclude only military pay received as a result of deployment to a federally designated combat zone that was not received before deployment.11eCFR. 7 CFR 273.9 – Income and Deductions BAS is not covered by that narrow exclusion. The USDA Food and Nutrition Service states that all other pay and allowances are counted as income for SNAP.12Food and Nutrition Service. Military and Veteran Families

For WIC, eligibility is based on gross income. Federal guidance lets state agencies exclude certain housing-related allowances such as BAH and overseas housing allowance, but that option does not extend to BAS.13Food and Nutrition Service. Family Size and Income Determinations for Military Families Expect BAS to count toward the WIC income threshold.
