No, BAH is not taxed. The Basic Allowance for Housing is excluded from gross income under federal law, so no federal income tax, Social Security tax, or Medicare tax is withheld from it. Nearly every state follows the federal treatment, and the Servicemembers Civil Relief Act blocks states where you are merely stationed from taxing your military pay at all. The allowance still shows up in your bank account in full, and it never appears in the taxable wages box on your W-2.
The Federal Exclusion
BAH is a “qualified military benefit” under 26 U.S.C. § 134, which excludes from gross income any allowance a member of the uniformed services receives because of that service.1Office of the Law Revision Counsel. 26 U.S. Code 134 – Certain Military Benefits BAH is authorized under 37 U.S.C. § 403 and paid to offset the cost of housing when government quarters are not available, which places it inside that definition.2Office of the Law Revision Counsel. 37 U.S. Code 403 – Basic Allowance for Housing
The IRS confirms this in Publication 3, the Armed Forces’ Tax Guide, which lists BAH among the pay items excluded from gross income.3Internal Revenue Service. Publication 3 (2025), Armed Forces Tax Guide The exclusion applies whether you receive the benefit as cash or as in-kind housing. The Overseas Housing Allowance and the Basic Allowance for Subsistence get the same treatment.
Deployment does not change the answer. BAH is already tax-free everywhere, so the combat zone tax exclusion adds nothing to it. What the combat zone rules do is shield your otherwise-taxable basic pay for every month you spend in a designated zone.4Internal Revenue Service. Tax Exclusion for Combat Service A deployed service member can end up with almost no taxable military income, because basic pay is excluded under the combat zone rules while BAH and BAS remain excluded under § 134.
State Income Tax
Nearly every state mirrors the federal exclusion. Most states calculate state income tax starting from federal adjusted gross income, and because BAH never enters that figure, it never enters the state calculation either. States with no income tax at all take the question off the table entirely.
The Servicemembers Civil Relief Act adds a second layer. Under the SCRA, a state where you are stationed cannot tax your military pay unless it is also your state of legal residence. Orders to a new duty station do not change your legal domicile, so you only owe state income tax to your home of record, and that state applies the same federal exclusion to BAH. If your spouse also earns income, separate rules under the Military Spouses Residency Relief Act may apply to their situation.
How the Exclusion Shows Up on Your W-2 and LES
Your military W-2 will not include BAH in Box 1, which reports only taxable wages.5Internal Revenue Service. 2026 General Instructions for Forms W-2 and W-3 If your total bank deposits for the year run noticeably higher than the Box 1 number, that gap is almost certainly your tax-free allowances. Some W-2 forms list non-taxable allowances in Box 14 for informational purposes, but those figures never add to your tax liability.
Your Leave and Earnings Statement lists BAH and BAS separately from taxable basic pay, and the year-to-date totals on your December LES should line up with your W-2.6Military OneSource. Military Housing Allowance and Your Taxes Tax preparation software that imports your W-2 will handle the exclusion automatically. If you enter numbers by hand, use only the Box 1 amount and do not add BAH on top of it.
The Downstream Tax Benefits
Because BAH stays out of your adjusted gross income, your AGI is lower than your actual take-home pay, sometimes by a wide margin. That can keep you in a lower tax bracket than your total compensation would suggest, and it can preserve eligibility for deductions and credits that phase out at higher income levels.
If you use BAH to pay a mortgage, you get a second benefit on top of the first. The allowance is tax-free, and you can still deduct the mortgage interest and property taxes you pay with those tax-free dollars, provided you itemize on Schedule A. The IRS explicitly permits this.7Internal Revenue Service. Publication 936, Home Mortgage Interest Deduction Nothing in the rules requires deductible expenses to be paid with after-tax income when it comes to military housing allowances.
Where BAH Still Counts as Income
“Tax-free” does not mean “invisible everywhere.” Several programs and calculations treat BAH as income even though the IRS does not.
Social Security and TSP
Because BAH is not subject to Social Security or Medicare taxes, it does not count toward your Social Security earnings record.6Military OneSource. Military Housing Allowance and Your Taxes Only your taxable basic pay generates Social Security credits and feeds into your future benefit calculation. Thrift Savings Plan agency matching works the same way, keyed to basic pay rather than total compensation. Over a career, this can leave your Social Security benefit lower than a civilian earning the same total dollars would receive.8Social Security Administration. SNAP
The Supplemental Nutrition Assistance Program counts BAH as income when determining eligibility. Combat pay, hostile fire pay, and imminent danger pay are excluded, but all other military pay and allowances, including BAH and BAS, are included.9Food and Nutrition Service. Military and Veteran Families That can push some junior enlisted families over the income limit even when their tax return shows a much lower AGI.
Child Support and Alimony
Family courts in most jurisdictions count BAH as income when calculating child support and alimony. Courts look at total financial resources rather than taxable pay alone, and BAH represents too much of military compensation to leave out. Service members who live in government housing and pay child support may qualify for BAH-Differential, a smaller allowance tied specifically to the support obligation, provided the monthly payment meets the BAH-Diff rate.10Defense Travel Management Office. Basic Allowance for Housing The specifics vary by state, so a visit to the military legal assistance office before any court proceeding is worth the time.
Financial Aid
Federal student aid moved the other direction. Starting with the 2024–2025 award year, the FAFSA no longer requires military families to report BAH or BAS as untaxed income, so the allowance no longer inflates your apparent income when your children apply for college aid.
