Is Aflac Pre-Tax or Post-Tax? How to Tell and What It Means

Whether Aflac is pre-tax or post-tax depends on how your employer sets up the benefit. If Aflac is offered through a Section 125 cafeteria plan at work, your premiums are deducted before federal income tax, Social Security, and Medicare are calculated. If it isn’t, or if you bought the policy on your own outside of work, premiums come out after taxes. The arrangement isn’t something you pick at enrollment. It’s a function of your employer’s plan structure, and it carries consequences well beyond your paycheck.

How to Tell Which One Applies to You

Your W-2 is the clearest record. Pre-tax premiums reduce three boxes: Box 1 (federal taxable wages), Box 3 (Social Security wages), and Box 5 (Medicare wages). Add up your gross pay for the year and compare it to Box 1. If Box 1 is lower by roughly the amount of your annual Aflac premium, the deduction was taken pre-tax.1Internal Revenue Service. General Instructions for Forms W-2 and W-3

Some employers also note the Aflac deduction separately in Box 14 under “Other,” but that entry is optional and varies by payroll system. The real evidence is in the reduced wage figures. If Boxes 1, 3, and 5 all match your full gross wages, the premiums were deducted after tax.

Cross-check your final pay stub of the year against the W-2 to make sure the figures line up. Mistakes in this area can quietly push your federal withholding off by a meaningful amount.

What Pre-Tax Treatment Means

Pre-tax deduction is only legal when the employer has established a written Section 125 plan. The simplest version is a Premium Only Plan, which lets employees pay insurance premiums through a salary reduction agreement with no flexible spending account attached.2Internal Revenue Service. FAQs for Government Entities Regarding Cafeteria Plans Aflac’s supplemental products — accident, critical illness, hospital indemnity — qualify as accident and health benefits under Section 125.3Office of the Law Revision Counsel. 26 USC 125 – Cafeteria Plans

The paycheck benefit is immediate. Your taxable income drops by the premium amount, and so does the wage base used for Social Security and Medicare. Federal law specifically excludes qualifying cafeteria plan contributions from FICA wages.4Office of the Law Revision Counsel. 26 USC 3121 – Definitions

The trade-off shows up when you file a claim. Because the premium dollars were never taxed, the IRS treats the resulting benefits as taxable income. Amounts received through an accident or health plan that are attributable to contributions excluded from your gross income are themselves included in gross income.5Office of the Law Revision Counsel. 26 USC 105 – Amounts Received Under Accident and Health Plans A $5,000 payout after an accident becomes $5,000 of taxable income, typically reported on a W-2 if paid through your employer or on a 1099 if paid directly by the carrier.6Internal Revenue Service. What Post-Tax Treatment Means

Post-tax premiums offer no immediate paycheck relief. The money is already taxed before Aflac takes its cut. The payoff comes later: because you paid with after-tax dollars, benefit payments from a claim are generally excluded from gross income.5Office of the Law Revision Counsel. 26 USC 105 – Amounts Received Under Accident and Health Plans A $5,000 benefit stays $5,000. The carrier typically won’t issue a 1099 because there’s nothing taxable to report.

Keep your enrollment paperwork and pay stubs showing the after-tax deduction. If the IRS ever questions why a benefit payment wasn’t reported as income, those documents are your proof.

Post-tax premiums can also factor into your Schedule A if you itemize. Accident and health premiums count as medical expenses, but only the portion of total medical costs exceeding 7.5% of adjusted gross income is deductible. Premiums already paid pre-tax through a cafeteria plan don’t qualify, since you can’t deduct the same expense twice.7Internal Revenue Service. Topic No. 502, Medical and Dental Expenses

You Can’t Easily Cancel a Pre-Tax Election Mid-Year

One rule catches people off guard. If your Aflac premiums run through a Section 125 plan, your election is generally locked in for the full plan year. You can’t drop coverage or change the amount in June just because you’ve changed your mind. The IRS allows mid-year changes only during open enrollment or after a qualifying life event: marriage, divorce, the birth or adoption of a child, or a change in employment status that affects benefit eligibility.8IRS. Notice 2022-41 – Additional Permitted Election Changes for Health Coverage Under Section 125 Cafeteria Plans

Post-tax policies, especially ones purchased individually outside of payroll, are typically easier to adjust or cancel, though that depends on your contract with Aflac.

If You’re Self-Employed

Section 125 plans are strictly employer-employee arrangements, so self-employment rules them out. Self-employed individuals can take an above-the-line deduction for health insurance premiums under a separate provision, but it’s limited to insurance that constitutes “medical care” — medical, dental, vision, and qualified long-term care coverage.9Office of the Law Revision Counsel. 26 USC 162 – Trade or Business Expenses

Whether Aflac-type supplemental products qualify for that above-the-line deduction isn’t clearly addressed. The IRS instructions for Form 7206 list medical, dental, vision, and long-term care insurance but don’t speak to supplemental accident or indemnity policies.10Internal Revenue Service. Instructions for Form 7206 At a minimum, the premiums can be included with medical expenses on Schedule A if you itemize. For the above-the-line question, raise it with a tax professional.

Aflac Alongside an HSA

If you contribute to a Health Savings Account through a high-deductible health plan, Aflac usually doesn’t disqualify you. The IRS permits HSA-eligible individuals to carry additional insurance that pays for accidents, disability, a specific disease or illness, or a fixed daily amount for hospitalization — the typical shape of Aflac products.11Internal Revenue Service. Publication 969 – Health Savings Accounts and Other Tax-Favored Health Plans

The exception is a supplemental policy that reimburses general medical expenses before your HDHP deductible is met. Fixed indemnity benefits that pay a flat amount per event or per hospital day generally don’t threaten HSA eligibility, but a policy structured to reimburse actual medical costs could be treated as disqualifying coverage. Check the plan documents for how benefits are triggered before you enroll.11Internal Revenue Service. Publication 969 – Health Savings Accounts and Other Tax-Favored Health Plans
