IRS Form 941 vs 943: Filing Rules, FICA, and Deposits

The choice between Form 941 and Form 943 comes down to one question: are you paying people for agricultural labor? If yes, farm wages go on Form 943, filed once a year. If no, the wages belong on Form 941, filed every quarter. Both returns report the same underlying taxes (federal income tax withholding, Social Security, and Medicare), but they differ in filing frequency, the wage thresholds that trigger FICA, how non-cash pay is treated, and a few deposit rules.

Which Form You File

Form 941 is the default. If you pay wages subject to federal income tax withholding or Social Security and Medicare, you file it each quarter.1Internal Revenue Service. Instructions for Form 941 (03/2026) That covers nearly every U.S. employer: offices, shops, construction crews, restaurants.

Form 943 replaces Form 941 only for agricultural wages.2Internal Revenue Service. About Form 943, Employers Annual Federal Tax Return for Agricultural Employees What matters is the nature of the work, not whether your business calls itself a farm. A landscaping company that also runs a produce operation would file Form 943 for the workers harvesting crops and Form 941 for the landscaping crew.

Mixed workforces file both. Non-farm wages go on quarterly 941s; farm wages go on the annual 943.3Internal Revenue Service. Publication 225 (2025), Farmers Tax Guide Once you file a Form 943, the IRS expects one every year, even if you have no taxes to report, until you file a final return.4Internal Revenue Service. Topic no. 760, Form 943 – Reporting and Deposit Requirements for Agricultural Employers

One boundary worth flagging: very small non-farm employers with total annual liability of $1,000 or less for Social Security, Medicare, and withheld income tax may qualify to file Form 944 instead of 941.5Internal Revenue Service. About Form 944, Employers Annual Federal Tax Return Form 944 is not an option for agricultural employers. Farm wages use Form 943 regardless of how small the liability is.

What Counts as Agricultural Labor

The IRS defines agricultural labor broadly: work performed on a farm in connection with cultivating soil, raising or managing livestock (including bees and poultry), and harvesting crops or other horticultural commodities.6eCFR. 26 CFR 31.3121(g)-1 – Agricultural Labor It reaches past fieldwork. Handling, packing, drying, grading, and storing a farm commodity in its raw state count too, as long as the worker is employed by the farm operator and the work is done as part of that farm’s operation. Cotton ginning qualifies. Maintaining non-commercial irrigation systems qualifies.

Some work doesn’t qualify even on a farm. Forestry, lumbering, and landscaping fall outside the definition. Workers at a farm’s retail market or gift shop are non-farm employees whose wages belong on Form 941.

Two scenarios complicate the picture. If a crew leader assembles and pays the workers directly without a written agreement designating them as the farm’s employees, the crew leader is treated as the employer and files Form 943 for those workers.7eCFR. 26 CFR 31.3121(o)-1 – Crew Leader And foreign workers on H-2A visas are exempt from Social Security and Medicare on their farm wages; income tax withholding is voluntary and happens only if both parties agree and the worker submits a W-4.8Internal Revenue Service. Filing Frequency and Due Dates

This is the most practical difference. Form 941 is due four times a year, after the close of each calendar quarter:1Internal Revenue Service. Instructions for Form 941 (03/2026)

  • First quarter (January–March): due April 30
  • Second quarter (April–June): due July 31
  • Third quarter (July–September): due October 31
  • Fourth quarter (October–December): due January 31 of the following year

Form 943 is due once a year, on January 31 of the year after the wages were paid. For tax year 2026, January 31, 2027 falls on a Sunday, so the deadline moves to Monday, February 1, 2027. Both forms give you an extra 10 calendar days to file if you deposited all taxes on time throughout the period.9Internal Revenue Service. Instructions for Form 943 (2025) When any due date lands on a Saturday, Sunday, or federal holiday, it shifts to the next business day.10Internal Revenue Service. Employment Tax Due Dates

The annual schedule is a real advantage for seasonal farm operations with only a few months of payroll activity. One return instead of four, three of which might otherwise be zeros.

How FICA Applies Differently

Under Form 941, every dollar of cash wages is subject to Social Security and Medicare from the first paycheck. There is no minimum.

Farm wages reported on Form 943 work differently. FICA applies only when one of two tests is met:4Internal Revenue Service. Topic no. 760, Form 943 – Reporting and Deposit Requirements for Agricultural Employers

  • Individual cash wage test: you pay a single farmworker $150 or more in cash wages during the calendar year.
  • Aggregate expenditure test: your total wages (cash and non-cash) to all farmworkers combined reach $2,500 or more during the calendar year.

Meeting either test triggers FICA on all cash farm wages paid that year, not just the wages above the threshold.11Office of the Law Revision Counsel. 26 U.S. Code 3121 – Definitions A narrow exception applies to hand-harvest laborers paid on a piece-rate basis who commute daily from a permanent home and worked fewer than 13 weeks in agriculture the prior year: they are excluded from the aggregate test, though the $150 individual test still applies. These thresholds are statutory and have not been adjusted for inflation, so they remain at $150 and $2,500 for 2026.

Non-cash pay follows a different split too. For Form 941 employees, non-cash compensation like meals and lodging is generally subject to FICA and income tax withholding unless provided for the employer’s convenience on the business premises. For farm wages, non-cash payments to agricultural workers (commodities, meals, housing) are entirely exempt from Social Security and Medicare.12Internal Revenue Service. 2025 Instructions for Form 943 – Employers Annual Federal Tax Return for Agricultural Employees You don’t include their value on the Form 943 lines for Social Security or Medicare wages. For farms that provide room and board, this materially simplifies payroll.

One family-wages rule can also change the math on a farm. If you run a sole proprietorship or a partnership where both partners are the child’s parents, wages paid to your child under 18 are exempt from Social Security and Medicare, and wages paid to a child under 21 are also exempt from FUTA.13Internal Revenue Service. 14Internal Revenue Service. Publication 15 (2026), (Circular E), Employers Tax Guide Monthly depositors (lookback liability of $50,000 or less) deposit by the 15th of the following month; semiweekly depositors (over $50,000) follow a payday-based schedule.

Where the forms really differ is the small-liability safe harbor. Form 943 filers with total annual tax liability under $2,500 can skip periodic deposits entirely and pay the full amount when they file the return.9Internal Revenue Service. Instructions for Form 943 (2025) Form 941 has an analogous rule, but the $2,500 threshold is measured per quarter rather than per year, a much smaller window. For a small farm with modest payroll, the annual measurement often means no deposits at all.

FUTA Is a Separate Return

Filing Form 943 does not cover federal unemployment tax. Agricultural employers must also file Form 940 if either of two conditions is met: cash wages to farmworkers reached $20,000 or more in any calendar quarter of the current or preceding year, or the operation employed 10 or more farmworkers during at least part of the day in 20 or more different weeks across the current or preceding year.15Internal Revenue Service. Instructions for Form 940 (2025) These thresholds are higher than the general Form 940 rule for non-farm employers ($1,500 in any quarter, or any employee for any part of a day in 20 or more weeks). A farm that falls below both agricultural thresholds may have no FUTA obligation at all.

If You Filed on the Wrong Form

Errors on a filed Form 941 are corrected with Form 941-X; errors on Form 943 are corrected with Form 943-X. Each correction form matches only its parent; you cannot use 941-X to fix a 943 filing or the reverse.16Internal Revenue Service. Instructions for Form 941-X (Rev. April 2025)

If you reported farm wages on Form 941 (or non-farm wages on Form 943), the fix is to file a correction on the form where the wages were incorrectly reported, then report them on the correct form. For 941-X, you generally have three years from the original filing date to correct underreported taxes; for overreported taxes, three years from the filing date or two years from when you paid the tax, whichever is later.17Internal Revenue Service. Instructions for Form 941-X Forms 941 filed before April 15 of the following year are treated as filed on April 15 for this purpose. Form 943-X follows similar period-of-limitations rules.
