IRS Form 8871: Who Must File, Deadlines, and Penalties

IRS Form 8871 is the electronic notice a political organization files with the IRS to claim tax-exempt status under Section 527 of the Internal Revenue Code. Who Has to File

A Section 527 organization is any group organized and operated primarily to accept contributions or make expenditures to influence the selection, nomination, election, or appointment of someone to federal, state, or local public office. Political parties, candidate campaign committees, political action committees, and independent election-spending groups all fit inside that definition.2Internal Revenue Service. Every such organization that wants tax-exempt treatment under Section 527 must file Form 8871 unless it falls into one of four narrow exceptions:

What to Gather Before You File

You will need an Employer Identification Number before you can complete the notice. Even organizations with no employees must obtain one by submitting Form SS-4, which can be done online through the IRS website.4Internal Revenue Service. Filing Requirements for Political Organizations

  • The organization’s legal name, mailing address, and email address.
  • A description of the organization’s purpose.
  • The names and addresses of officers, highly compensated employees, the contact person for public inquiries, the custodian of records, and board members.
  • The name, address, and relationship of any related organizations.
  • Whether the organization intends to claim an exemption from the periodic reporting requirements under Section 527(j) or the annual return requirement under Section 6033.

Someone authorized to act on the organization’s behalf has to sign the form.2Internal Revenue Service. Filing Deadlines

Deadlines depend on what kind of filing you are making.

The 24-hour window for new organizations is unusually short by IRS standards and catches people off guard. The practical takeaway: have your EIN, organizational details, and officer information in hand before you formally create the entity, not after.

How to File

Form 8871 must be filed electronically. The paper version is obsolete, and the IRS will not accept it.2Internal Revenue Service. When you submit the initial notice, the IRS assigns your organization a username and password. You will need those credentials for every future filing, including amendments, termination notices, and the Form 8872 periodic reports discussed below. What Happens If You Miss the Deadline

The penalty for late or missing filing is not a flat fine. The organization loses its Section 527 tax exemption for the entire period it is out of compliance. Every dollar of exempt function income received during that stretch, including political contributions, becomes taxable.1Internal Revenue Service. Taxable Income – Political Organizations

The tax is calculated at the highest corporate rate under Section 11(b), currently a flat 21 percent. Expenses directly connected to producing that income can be deducted, but the net amount is taxed at the full rate. The same rule applies to late amendments. If a material change occurs and the amended Form 8871 is filed after the 30-day window, the taxable period runs from the date of the change to the date of filing. Form 8872 Comes Next

Filing Form 8871 is the entry step, not the finish. Most Section 527 organizations must also file Form 8872 on a recurring basis to report contributions received and expenditures made.10Internal Revenue Service. About Form 8872 – Political Organization Report of Contributions and Expenditures

In even-numbered years, the organization chooses either a monthly or a quarterly schedule and sticks with it for the calendar year, with additional pre-election reports due 12 days before an election and post-general-election reports due 30 days after. Odd-numbered years follow a semiannual schedule. Each report must identify every contributor of $200 or more in the aggregate and every recipient of $500 or more.11Internal Revenue Service. The penalty for failing to file Form 8872 or leaving out required details is 21 percent of the total contributions and expenditures that should have been reported. Unlike the Form 8871 penalty, this one is a direct monetary assessment, and it applies to undisclosed amounts regardless of whether the failure was intentional.12Internal Revenue Service. Public Inspection Duty

The IRS posts filed Form 8871 data online, but the organization has its own separate duty. A tax-exempt Section 527 organization must make its Form 8871 and Form 8872 filings available for public inspection and copying on request.13Internal Revenue Service. Failing to comply with a public inspection request costs $20 per day, up to $10,000 per return. If the failure is willful, an additional $5,000 penalty applies on top of the daily charges.14Internal Revenue Service.
