IRS Form 709 Instructions: Filing, Deadlines, and Penalties

IRS Form 709 instructions require a donor to file a federal gift tax return by April 15 of the year after making a reportable gift, most commonly a gift of more than $19,000 to a single recipient in 2026. Filing the return does not mean you owe tax. A $15 million lifetime exclusion shelters cumulative gifts above the annual threshold, and Form 709 exists mainly to track how much of that lifetime amount you have used.1Internal Revenue Service. When You Have to File

Three situations trigger the filing requirement:

  • You gave more than $19,000 in cash or property to any one person during 2026.2Internal Revenue Service. Rev. Proc. 2025-32
  • You gave a future-interest gift of any value. If the recipient cannot use or enjoy the property right away, even a $50 transfer requires a return.3Internal Revenue Service. Instructions for Form 709 (2025)
  • You and your spouse agreed to split a gift. Both spouses file their own Form 709 to document the election, even when the split gift falls under the annual exclusion.3Internal Revenue Service. Instructions for Form 709 (2025)

The donor files. Recipients do not file Form 709 and generally owe no tax on gifts they receive.

Transfers You Do Not Report

Some transfers sit entirely outside the gift tax system and never appear on Form 709, regardless of amount.

Tuition paid directly to a qualifying educational institution is not a taxable gift. Neither is a medical bill paid directly to the provider. There is no dollar cap, and the person you help does not have to be a relative.4Office of the Law Revision Counsel. 26 USC 2503 – Taxable Gifts The exclusion is strict about routing. Handing cash to a student or patient and telling them to pay the bill does not qualify. The check must go to the school or provider. The tuition exclusion covers tuition only, not room and board, books, or supplies.5eCFR. 26 CFR 25.2503-6 – Exclusion for Certain Qualified Transfer for Tuition or Medical Expenses

Gifts between U.S. citizen spouses qualify for an unlimited marital deduction and are not reportable.6Office of the Law Revision Counsel. 26 USC 2523 – Gift to Spouse If your spouse is not a U.S. citizen, a separate annual exclusion of $194,000 for 2026 applies, and only gifts above that must be reported.7Internal Revenue Service. Frequently Asked Questions on Gift Taxes for Nonresidents Not Citizens of the United States

The annual exclusion itself covers up to $19,000 per recipient per year for present-interest gifts. You can give the full amount to as many separate people as you want without reporting anything, but the gift has to be one the recipient can use or enjoy immediately. A cash gift or publicly traded stock qualifies. A gift the recipient cannot touch until age 30 is a future interest and does not.4Office of the Law Revision Counsel. 26 USC 2503 – Taxable Gifts

Filling Out the Return

Gift tax is cumulative. Each Form 709 adds the current year’s taxable gifts to everything you have reported in prior years and applies the rate schedule to the running total. The top rate is 40%.3Internal Revenue Service. Instructions for Form 709 (2025)

Schedule A is where you list this year’s gifts. For each qualifying present-interest gift, subtract the annual exclusion to arrive at the taxable amount. Schedule B lists all taxable gifts from prior years for which you filed a return. Both totals flow to Part 2, the Tax Computation section, where the rate schedule produces a tentative tax on your cumulative lifetime giving.3Internal Revenue Service. Instructions for Form 709 (2025)

The unified credit then offsets that tentative tax. For 2026, the credit corresponds to a $15 million lifetime exclusion, so you owe no actual gift tax until cumulative taxable gifts pass that mark.1Internal Revenue Service. What’s New – Estate and Gift Tax Every dollar of credit you use during life reduces what remains to shelter your estate at death. That is the practical reason to file accurately even in years no tax is due: your return is the running ledger your estate will rely on.

Situations That Change How You File

Gift Splitting

Spouses can elect to treat a gift from one of them as if each gave half, effectively doubling the annual exclusion to $38,000 per recipient. The consenting spouse signs Part III of the donor’s Form 709, and the donor reports half the gift in column (h) of Schedule A. Both spouses file their own returns. The election applies to every gift either spouse made during the year, so you cannot pick and choose which gifts to split.3Internal Revenue Service. Instructions for Form 709 (2025)

529 Plan Front-Loading

A special election lets you contribute up to five years of annual exclusions to a 529 plan at once. For 2026, that means up to $95,000 for a single beneficiary, spread across five years of $19,000 exclusions. Check the box on line B at the top of Schedule A and attach a statement identifying the beneficiary, the total contribution, and the elected amount.8Internal Revenue Service. Instructions for Form 709 (2025) – PDF You must file for the contribution year and report one-fifth on Schedule A in each of the four following years. If you have no other reportable gifts in one of those later years, you can skip filing for that year.

Non-Cash Gifts and Valuation

Real estate, closely held business interests, artwork, and similar assets are valued at fair market value on the date of the gift. The instructions require either a qualified appraisal or a detailed explanation of how you reached the value.3Internal Revenue Service. Instructions for Form 709 (2025) Attach the appraisal to the return. For real estate, include a legal description, the street address, and a note on any improvements.

If you claim a valuation discount, such as a lack-of-marketability discount or a discount on a minority interest in a family business, answer “Yes” to the discount question at the top of Schedule A and attach a written explanation showing the basis and dollar amount of the discount.3Internal Revenue Service. Instructions for Form 709 (2025) The IRS examines these closely, and thin documentation is where most audit problems begin.

Generation-Skipping Transfers

Form 709 also handles the generation-skipping transfer (GST) tax on gifts to grandchildren or others two or more generations below you, or to trusts benefiting them. The GST exemption is $15 million for 2026. Unused exemption is automatically allocated to direct skips, so if you want to prevent that allocation or direct exemption to a specific trust, you must make the election on a timely filed Form 709.9eCFR. 26 CFR 26.2632-1 – Allocation of GST Exemption A misallocation can produce a 40% tax on top of gift tax, and most donors work with a tax professional for these transfers.

Deadlines and Where to Send It

Form 709 is due April 15 of the year after the gift. A 2026 gift is reported on a return due April 15, 2027.3Internal Revenue Service. Instructions for Form 709 (2025)

You can get an automatic six-month extension to October 15 in one of two ways. Filing Form 4868 to extend your individual income tax return also extends Form 709; no separate gift tax extension is needed. If you do not need an income tax extension but do need more time for the gift return, file Form 8892 by April 15.3Internal Revenue Service. Instructions for Form 709 (2025) An extension to file is not an extension to pay. Any gift tax owed must still be paid by April 15 to avoid interest and late-payment penalties.

Form 709 can be filed electronically through the IRS Modernized e-File (MeF) system or mailed to the Internal Revenue Service Center, Kansas City, MO 64999. Private delivery services should use 333 W. Pershing Road, Kansas City, MO 64108.3Internal Revenue Service. Instructions for Form 709 (2025) Payments can be made by check payable to the U.S. Treasury, through IRS Direct Pay, or through the Electronic Federal Tax Payment System.10Internal Revenue Service. Payments

Penalties and the Statute of Limitations

Filing late when tax is owed carries a penalty of 5% of the unpaid tax per month, capped at 25%. Late payment adds 0.5% per month, also capped at 25%. Both can be waived for reasonable cause.11Office of the Law Revision Counsel. 26 USC 6651 – Failure to File Tax Return or to Pay Tax

Valuation penalties apply if you understate a gift’s value. Reporting a value at 65% or less of what the property was actually worth is a substantial valuation understatement. Reporting at 40% or less is a gross valuation understatement and draws a steeper penalty.3Internal Revenue Service. Instructions for Form 709 (2025)

Adequate disclosure is what starts the clock. Once you file Form 709 and adequately disclose a gift, the IRS generally has three years to challenge the value or assess more tax. If you never file, or if a reported gift is not adequately disclosed, there is no statute of limitations and the IRS can assess at any time. Adequate disclosure generally means a qualified appraisal or a detailed description of the valuation method, plus enough information to identify the property and the parties.3Internal Revenue Service. Fixing a Return After You File

To correct or supplement a filed return, prepare a new Form 709, check the amended return box on line 15 of Part I, and attach a statement explaining the changes along with a copy of the original.3Internal Revenue Service.
