IRS Form 3210: What It Is and How Tax Court Documents Are Served

IRS Form 3210, the Document Transmittal, is an internal IRS tracking sheet that employees attach to packages of records moving between IRS offices. Taxpayers do not fill it out, do not receive it, and do not send it. What Form 3210 Is

Form 3210 is a four-part general-purpose transmittal used across all IRS functions to track documents moving between offices.1Internal Revenue Service. When one IRS office ships taxpayer records, case files, or other sensitive paperwork to another IRS office, a Form 3210 travels with the package so both sides can confirm what was sent, when, and when it arrived.

The form records the sender’s name and office, the recipient’s name and office, and a list of the documents inside, identified by document locator number, taxpayer identification number, and tax period. It also has fields for the recipient to sign and date on receipt. The receiving office has ten business days to acknowledge the shipment by returning a signed copy.2Internal Revenue Service. The IRS also requires a Form 3210 whenever a shipment contains personally identifiable information. Those packages must be double-wrapped so the contents are protected if the outer packaging is damaged, carry a duplicate shipping label on the inner package, and be monitored until the recipient confirms delivery.3Internal Revenue Service. None of that touches the taxpayer. The form is entirely an intra-agency control document.

Why Form 3210 Comes Up Around Tax Court

Form 3210 enters the Tax Court conversation because IRS staff use it behind the scenes when a case shifts between IRS components. Once a case has been petitioned to Tax Court and IRS Appeals finishes its work, the Appeals office transfers the administrative file to the Office of Chief Counsel, which handles the government’s side of the litigation. That transfer moves on a Form 3210 or its electronic equivalent, and the Appeals employee follows up until Chief Counsel confirms receipt.5Internal Revenue Service. If a case is remanded from Chief Counsel back to Appeals, the file travels the same way, with another Form 3210 documenting the handoff. The form is the chain-of-custody record that lets the IRS prove internally who held which documents and when. You will not be asked to prepare one, and sending one to the IRS or the Tax Court would create confusion rather than solve any problem.

What Taxpayers Actually Use to Serve Documents in Tax Court

If you have a docketed Tax Court case and need to get documents to the IRS attorney on the other side, Tax Court Rule 21 governs the process. There are three accepted ways to serve the IRS attorney:

  • Electronic service through DAWSON. The Tax Court’s electronic filing system automatically serves any party who has entered an appearance and consented to electronic service.   • Mail. You can mail a copy to the IRS attorney at the office address on the government’s Answer. Service by mail is complete on the date of mailing, not the date of arrival.6United States Tax Court. Rule 21 – Service of Papers
  • Hand delivery. You can deliver the copy directly to the IRS attorney or their authorized representative.

Every document you file needs a certificate of service stating who you served, the date, and the method.6United States Tax Court. That certificate is the paper trail that protects you if the IRS later claims it never received something. Filing Through DAWSON

Most Tax Court filings now move through DAWSON, the Court’s electronic case management system. You can file a petition electronically to open a case, and once docketed, you can file motions, stipulations, and other documents the same way. Documents uploaded to DAWSON must be in PDF and cannot exceed 250 MB per file; split larger documents into separate uploads. Approved Delivery Methods for Mailed Filings

When you mail documents to the Tax Court or to the IRS attorney, the postmark or delivery service record sets your filing date. The IRS recognizes specific private delivery services as meeting the timely-mailing-as-timely-filing rule, so the day you hand the package to the carrier counts as the filing date. Approved carriers include designated service levels from DHL Express, FedEx, and UPS.9Internal Revenue Service. Private Delivery Services (PDS) Not every service level qualifies. For a deadline-sensitive filing, use USPS certified mail or one of the specifically designated private delivery options.

One practical point from the Court itself: if you need to mail something to the Tax Court in Washington, D.C., within a week of your trial session, it may not arrive in time.
