IRS Form 1096 is the cover sheet a business attaches when mailing paper copies of information returns such as the 1099, 1098, W-2G, 3921, 3922, and 5498 series to the IRS. It summarizes the batch: how many forms, how much was reported, how much tax was withheld. One important catch before you spend any time on it: if you file 10 or more information returns in a calendar year, you must file electronically, and Form 1096 disappears from the process entirely.1Internal Revenue Service. When You Still Need Form 1096
Starting with returns filed in 2024, the IRS dropped the electronic filing threshold from 250 returns per type to 10 returns in aggregate across all information return types.1Internal Revenue Service. Only filers submitting nine or fewer total information returns can still use paper and Form 1096. If you cross the threshold but can’t file electronically, you can request a hardship waiver on Form 8508 at least 45 days before the due date. Grounds include undue financial hardship (backed by two written cost estimates from service bureaus), lack of internet access, a federally declared disaster, or being a first-year business. A first-time waiver request is automatically granted.3Internal Revenue Service. Application for a Waiver From Electronic Filing of Information Returns Approved waiver in hand, you’re back to paper with Form 1096.
The IRS also offers a free e-filing option called the Information Returns Intake System (IRIS) Taxpayer Portal, which handles up to 100 returns at a time and supports the full range of forms that would otherwise ride with a 1096.4Internal Revenue Service. Which Returns Form 1096 Covers
Form 1096 accompanies paper submissions of the 1097, 1098, 1099, 3921, 3922, 5498, and W-2G series.5Internal Revenue Service. About Form 1096, Annual Summary and Transmittal of U.S. Information Returns The most common use is a business mailing 1099-NEC forms for independent contractors, but the same transmittal covers mortgage interest, gambling winnings, stock option exercises, and retirement or health savings account contributions.
Each type of form gets its own Form 1096. Five 1099-NEC forms and three 1099-DIV forms means two separate 1096 transmittals, one per batch.6Internal Revenue Service. Form 1096 Annual Summary and Transmittal of U.S. Information Returns Never combine different form types on a single 1096.
How to Complete the Form
The form is short. What matters is that the numbers match the returns behind it.
- Filer identification: business name, address, and EIN, plus a contact person’s name and phone number.
- Form type checkbox: one box, marking the type of information return this transmittal covers.
- Box 3, number of forms: a straight count of the returns in the batch. Don’t count blank forms, voided forms, or the 1096 itself.
- Box 4, federal income tax withheld: total backup withholding across all forms in the batch. Enter zero if none.
- Box 5, total amount reported: the sum of reportable dollar amounts from the specific box named in that form type’s instructions. For 1099-NEC, it’s the combined nonemployee compensation. Forms 1098-T, 1099-A, and 1099-G don’t require a Box 5 entry.
- Signature: an authorized person signs and dates, certifying accuracy under penalties of perjury.
The most common error is a mismatch between Box 5 and the totals on the individual returns. The IRS matches these figures, and any gap triggers correspondence.
Deadlines for 2026
The Form 1096 deadline is the deadline of the returns it transmits. When a due date falls on a weekend or legal holiday, it moves to the next business day.

- Most other returns (1097, 1098, 1099-MISC, 1099-DIV, 3921, 3922, W-2G): February 28 on paper, March 31 electronically. February 28, 2026 is a Saturday, so the paper deadline is March 2, 2026.2Internal Revenue Service. General Instructions for Certain Information Returns (2025)

1099-NEC and 1099-MISC share one set of IRS instructions but different due dates, and you can’t put them on the same 1096 in any case.
Ordering and Mailing Paper Forms
You cannot download Form 1096 from the IRS website and print a usable copy. The official form is printed in scannable red ink that a home or office printer can’t reproduce, and filing a non-scannable copy can draw a penalty.6Internal Revenue Service. Mail the completed Form 1096 with Copy A of the accompanying returns to the IRS Submission Processing Center assigned to your state. Filers are routed to Austin, TX; Kansas City, MO; or Ogden, UT depending on where the business is located.9Internal Revenue Service. Correcting a Filed Form 1096
You don’t correct a previously filed 1096 on its own. You prepare a new 1096 to transmit the corrected information returns.2Internal Revenue Service. General Instructions for Certain Information Returns (2025) How you fix the underlying return depends on the error:
- Wrong dollar amount or code: prepare a corrected copy of the return with an “X” in the “CORRECTED” box at the top, enter the right figures, and attach a new 1096. Do not resend the original incorrect return.
- Wrong payee name or TIN: two steps. File a return that zeros out the incorrect entry, then file a second return with the correct information. Attach a new 1096 and write “Filed To Correct TIN” or “Filed To Correct Name” in the bottom margin.2Internal Revenue Service. General Instructions for Certain Information Returns (2025)
Keep each correction type on its own 1096. Correcting a 1099-INT and a 1099-MISC means two transmittals.
Penalties for Late or Incorrect Filing
Penalties apply per form for information returns filed late, filed incorrectly, or never filed. For returns due in 2026:10Internal Revenue Service. Information Return Penalties
- Filed within 30 days of the deadline: $60 per form.
- More than 30 days late but by August 1: $130 per form.
- Filed after August 1 or never filed: $340 per form.
- Intentional disregard: $680 per form, with no annual cap.
Annual maximums apply at each tier and are lower for small businesses, defined as those with average annual gross receipts of $5 million or less over the three most recent tax years.11Office of the Law Revision Counsel. 26 U.S. Code 6721 – Failure to File Correct Information Returns Fifty late 1099s filed after August 1 would run $17,000 before any cap. E-filing through IRIS removes the 1096 from the equation and takes postal delays out of your deadline calculation.
