To get the IRS to treat your tax return as filed on the day you ship it rather than the day it arrives, you have to use one of the specific service tiers on the IRS list of approved private delivery services. Only certain premium options from DHL Express, FedEx, and UPS qualify under 26 U.S.C. ยง 7502(f).1Office of the Law Revision Counsel. 26 USC 7502 – Timely Mailing Treated as Timely Filing Ship through any other tier, including FedEx Ground or UPS Ground, and the IRS uses the actual arrival date, which can trigger a failure-to-file penalty of 5% of the unpaid tax per month, up to 25%.2Internal Revenue Service. Use the Street Address, Not the P.O. Box
Private carriers cannot deliver to P.O. boxes, so the addresses printed in most tax form instructions will not work. You need the physical street address of the IRS submission processing center assigned to your return. There are three:4Internal Revenue Service. Submission Processing Center Street Addresses for Private Delivery Service (PDS)
- Austin: Internal Revenue Submission Processing Center, 3651 S IH35, Austin, TX 78741
- Kansas City: Internal Revenue Submission Processing Center, 333 W. Pershing, Kansas City, MO 64108
- Ogden: Internal Revenue Submission Processing Center, 1973 Rulon White Blvd., Ogden, UT 84201
Which center you use depends on the form you are filing; the IRS publishes a directory by form number. One convenience: for private delivery, the same street address is used whether or not you include a payment, which is not the case with USPS mail.4Internal Revenue Service. Submission Processing Center Street Addresses for Private Delivery Service (PDS) A package sent to a P.O. box typically gets returned, and the timely-mailing date goes with it.
USPS Certified or Registered Mail Also Works
Private carriers are not the only way to lock in the shipping date. USPS certified mail and registered mail both qualify under the same statute and cost far less than an overnight carrier.1Office of the Law Revision Counsel. 26 USC 7502 – Timely Mailing Treated as Timely Filing A certified mail receipt postmarked April 15 gives you the same protection as a FedEx Priority Overnight scan on April 15. The Treasury Regulations recognize certified and registered mail, along with the designated private delivery services, as the ways to establish prima facie evidence of delivery.5eCFR. 26 CFR 301.7502-1 – Timely Mailing of Documents and Payments Ordinary first-class mail does not.
Private delivery is worth the extra cost when you need guaranteed speed, real-time tracking, or you are shipping from outside the United States.
Keep Proof of the Shipping Date
The burden of showing you filed on time is on you. Under Treasury Regulation 301.7502-1, using a designated private delivery service or USPS certified or registered mail is the only way to create a legal presumption of delivery without actually proving the IRS received the package.5eCFR. 26 CFR 301.7502-1 – Timely Mailing of Documents and Payments No other mailing evidence, however persuasive, carries that presumption.6Federal Register. Timely Mailing Treated as Timely Filing
Hold on to three things:
- The counter receipt showing the date, service tier, and tracking number.
- A copy of the airbill or shipping label confirming the destination address and service level.
- A printout of the full tracking history from the carrier’s website, including the initial acceptance scan and delivery confirmation.
The date the carrier electronically records when it first accepts the package is the date the IRS treats as your postmark.7Internal Revenue Service. Notice 2016-30 – Designation of Private Delivery Services Carriers keep that data for at least six months, and IRS disputes can run longer, so save the tracking record before that window closes.
Mistakes That Void the Protection
Choosing a Non-Designated Tier
This is where most filers slip. You go into a FedEx or UPS store, pick Ground because it is cheaper, and assume the shipping date protects you. It does not. FedEx Ground, UPS Ground, UPS SurePost, and every tier missing from the approved list get zero postmark protection.3Internal Revenue Service. Private Delivery Services (PDS) If the package arrives a day past the deadline, the late-filing penalty starts at 5% per month.8Office of the Law Revision Counsel. 26 USC 6651 – Failure to File Tax Return or to Pay Tax Look at the receipt at the counter and confirm the service name is on the IRS list before you leave.
Copying the Address from the Form Instructions
The addresses on tax form instructions are usually P.O. boxes for USPS. Private carriers cannot deliver there. If you hand that address to FedEx, the package can bounce back. Even the right city with the wrong street address risks losing the shipping date.
Dropping It in an Unattended Box
A counter agent scans your package on the spot and gives you a dated receipt. An unattended drop box does not necessarily do the same at the moment you deposit it. The IRS advises asking the carrier how to get written proof of the mailing date.3Internal Revenue Service. Private Delivery Services (PDS) On the deadline day, go to the counter.
E-Filing Sidesteps the Question
If proving the filing date is the whole reason you are looking at private delivery services, e-filing removes the problem. When the IRS accepts an electronically filed return, it sends back an acknowledgment with the acceptance date and a submission ID within hours. That timestamp is the proof. For most individual returns, e-filing is free through IRS Free File or inexpensive through commercial software. Private delivery makes sense when you have to send physical documents the IRS will not take electronically, or you are shipping from abroad and need a firm delivery window.
