Indian Status Tax Exemption in Manitoba: RST, GST, and Refunds

If you are registered under the Indian Act, the Indian status tax exemption in Manitoba lets you buy free of the province’s 7% Retail Sales Tax, the 5% federal Goods and Services Tax, the 14-cent-per-litre fuel tax, and the tobacco tax, and may exempt some of your employment and investment income. Every one of these exemptions turns on the same requirement in section 87 of the Indian Act: the property or income has to be situated on a reserve.1Department of Justice Canada. Indian Act RSC 1985 c I-5 – Section 87 How each tax applies that test is where the practical rules differ.

Who Qualifies

The exemption is personal to individuals who meet the legal definition of “Indian” under the Indian Act and are registered in the Indian Register maintained by Indigenous Services Canada.2Canada Revenue Agency. Information on the Tax Exemption Under Section 87 of the Indian Act Corporations, trusts, and non-status individuals cannot claim it, even if they live or run a business on a reserve. Manitoba’s Retail Sales Tax Act adds a further condition, defining “Indian” as someone who both resides on a reserve and is registered under the Indian Act.3Manitoba Government. People newly registered after the Bill S-3 amendments qualify for section 87 the same as anyone else on the register.4Crown-Indigenous Relations and Northern Affairs Canada. Remaining Inequities Related to Registration and Membership If you think you became eligible through those changes, applying for registration is the first step.

One boundary worth naming: if your First Nation has a self-government or tax agreement with the federal government, the standard section 87 rules may not apply to you. Documents to Show at the Register

Getting the exemption at the till is the simplest route, and it depends on presenting one of three federally issued documents:

  • Secure Certificate of Indian Status (current card)
  • Certificate of Indian Status (older laminated card)
  • Temporary Confirmation of Registration Document (TCRD) while you wait for a permanent card

Indigenous Services Canada recognizes all three as valid proof of registration.5Indigenous Services Canada. About Indian Status An expired card or a TCRD has to be paired with government-issued photo ID that matches the name on the card.6Manitoba Finance. The vendor needs to record your name, your 10-digit registration number, and your signature on the receipt. If you are buying for a band, the band name and number go on as well. Point-of-sale systems print these details straight onto the receipt; manual-till vendors have to capture the same information on their own forms.6Manitoba Finance. Manitoba Retail Sales Tax

Manitoba’s RST is 7% on most goods and some services.7Government of Manitoba. Retail Sales Tax Buy on a reserve and no RST applies. Buy off-reserve and the exemption still works, but the vendor (or a common carrier the vendor arranges) has to deliver the goods to a reserve. Pick the goods up yourself and drive them back, and the exemption is lost.6Manitoba Finance. Bulletin No. TAMTA 003 – First Nations Individuals, Bands and Organizations

Services follow the same logic. A service performed entirely on a reserve, or one that relates to exempt property on a reserve, qualifies. Repairs at an off-reserve shop are normally taxable. Vendors have to keep the delivery address and status details on file for audit.

Vehicles

Vehicles are a category on their own because Manitoba Public Insurance collects the RST at registration. To buy a vehicle RST-free, three things all have to happen: title transfers on a reserve, the paperwork is signed on a reserve, and you take possession on the reserve (either the dealer delivers it there or it goes by common carrier).8Manitoba Public Insurance. Retail Sales Tax A gift from one Status Indian to another, siblings included, also qualifies. Miss any of the three conditions and the full 7% is owing.

Fuel and Tobacco

Manitoba’s 14-cents-per-litre fuel tax on gasoline and diesel9Government of Manitoba. Fuel Tax is refunded to on-reserve retailers under the First Nations Fuel Tax Refund Program so they can sell tax-free to Status Indians, bands, and eligible organizations. The fuel has to be bought and picked up on a reserve, and it has to be for the buyer’s own use.6Manitoba Finance. Bulletin No. TAMTA 003 – First Nations Individuals, Bands and Organizations Fuel for resale, or fuel used off-reserve, does not qualify. Bands buying in bulk pay tax at purchase and file a refund claim for the portion used on-reserve.

Tobacco works the same way. The provincial tobacco tax runs at 30 cents per cigarette, or $60 per carton,10Government of Manitoba. Tobacco Tax and the Tobacco Tax Refund Limit Program lets on-reserve retailers recover the embedded tax on stock sold tax-free to Status Indians and bands for personal use. The transaction has to happen on a reserve.6Manitoba Finance. Bulletin No. TAMTA 003 – First Nations Individuals, Bands and Organizations

Federal GST

The 5% GST is exempt on the same basic logic: purchases connected to a reserve are not taxed.11Canada Revenue Agency. GST/HST and First Nations Peoples The CRA’s rules live in Technical Information Bulletin B-039. Buy on a reserve and no GST is charged. Buy off-reserve and the vendor or the vendor’s agent has to deliver the goods to a reserve.12Canada Revenue Agency. GST/HST Administrative Policy – Application of the GST/HST to Indians

Watch the common-carrier point carefully. A carrier only counts as the vendor’s agent if the vendor arranged and contracted them. Hire your own courier and that carrier is not the vendor’s agent, so the exemption is gone.12Canada Revenue Agency. GST/HST Administrative Policy – Application of the GST/HST to Indians Online orders where you pick the shipping method are the usual place this trips people up.

Services are GST-exempt when performed in whole or in part on a reserve, and utilities such as electricity and telecommunications qualify when they are delivered to a reserve address. Proof of Indian status has to be shown at the time of purchase.12Canada Revenue Agency. GST/HST Administrative Policy – Application of the GST/HST to Indians

Income, Interest, and Dividends

Employment income is exempt from federal and provincial income tax when the income itself is situated on a reserve. The CRA applies a connecting factors test the courts developed, weighing where the work is done, where the employer is located, and where the employee lives, in light of the exemption’s purpose of protecting Indian property on reserves.2Canada Revenue Agency. Information on the Tax Exemption Under Section 87 of the Indian Act No single factor decides the result.

The clearest exempt case is living on a reserve, working for a reserve-based employer, and performing your duties on the reserve. The picture gets harder when the factors split. Work performed off-reserve for a non-Indigenous employer with no reserve connection is almost always taxable. The CRA’s Indian Act Exemption for Employment Income Guidelines walk through the common patterns.

Interest income from savings accounts, chequing accounts, term deposits, and GICs is exempt when the account is at a financial institution located on a reserve and the institution is required to pay the interest to you at that on-reserve location. For term deposits and GICs, the rate has to be fixed or calculable at the time you invest.2Canada Revenue Agency. Information on the Tax Exemption Under Section 87 of the Indian Act

Dividends are exempt when the corporation’s head office, management, and main income-generating activities are all situated on a reserve. Capital gains from property located on a reserve are not taxable, and where an asset generated both exempt and non-exempt income, the CRA prorates the exemption.2Canada Revenue Agency. Getting a Refund When Tax Is Charged in Error

The best outcome is not paying the tax in the first place. When RST or GST is charged anyway, you can claim it back, but the two taxes have separate processes and both have a two-year filing window.

Manitoba RST

File the Manitoba Application for Refund with the date of purchase, the vendor’s name and address, a description of the goods, the purchase price, and the RST paid.13Government of Manitoba. Federal GST

For GST paid in error, file Form GST189 (General Application for GST/HST Rebates) using reason code 1A. Include copies of your receipts, proof of payment, a copy of your status card or TCRD, and proof of delivery to a reserve for any off-reserve purchase. Never send your original status card. You have two years from the date you paid the tax to file, and you can only submit one rebate application per calendar month.15Canada Revenue Agency. General Application for GST/HST Rebates Missing documents delay processing, so assemble the file before you send it.

A Related Protection for On-Reserve Property

Section 89 of the Indian Act prevents the real and personal property of an Indian or a band, when situated on a reserve, from being seized, mortgaged, pledged, or attached by anyone other than another Indian or band. It sits alongside the tax exemption and is worth knowing about if you are deciding where to keep financial assets, because on-reserve property carries both the tax advantage and a layer of protection from outside seizure.
