The voucher belongs to you, not to the apartment, so a proper exit lets the PHA issue you a new one to search for another unit. Most leases require 30 to 60 days of written notice. Several federal protections also let you leave before the term is up without penalty and without jeopardizing your voucher.<\/p>\n<h3>The Unit Fails Housing Quality Standards<\/h3>\n<p>Every Section 8 unit has to meet HUD&#8217;s Housing Quality Standards. During the initial lease term, the landlord cannot terminate your tenancy for business or personal reasons unrelated to something your household did, and that same protection reflects the underlying principle: if the landlord is the one breaking the agreement, you have grounds to exit.<sup class=\"modern-footnotes-footnote \" data-mfn=\"6\" data-mfn-post-scope=\"00000000000001670000000000000000_81\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_81-6\">6<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_81-6\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"6\">eCFR. <a href=\"https:\/\/www.ecfr.gov\/current\/title-24\/section-982.310\" target=\"_blank\" rel=\"noopener\">24 CFR 982.310 &#8211; Owner Termination of Tenancy<\/a><\/span> Put the landlord on notice in writing, file a complaint with the PHA if the behavior continues, and ask the PHA to support your request to terminate the lease and move with your voucher.<\/p>\n<h3>Domestic Violence, Dating Violence, Sexual Assault, or Stalking<\/h3>\n<p>The Violence Against Women Act protects Section 8 tenants who experience domestic violence, dating violence, sexual assault, or stalking. You cannot be denied housing or evicted because of violence committed against you, and you must be allowed to move with continued voucher assistance.<sup class=\"modern-footnotes-footnote \" data-mfn=\"7\" data-mfn-post-scope=\"00000000000001670000000000000000_81\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_81-7\">7<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_81-7\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"7\">U.S. Department of Housing and Urban Development. <a href=\"http:\/\/www.hud.gov\/vawa\" target=\"_blank\" rel=\"noopener\">Violence Against Women Act (VAWA)<\/a><\/span><\/p>\n<p>You do not need a police report or court order. You can self-certify using HUD Form 5382, and the housing provider cannot demand additional proof unless it has conflicting information.<sup class=\"modern-footnotes-footnote \" data-mfn=\"7\" data-mfn-post-scope=\"00000000000001670000000000000000_81\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_81-7\">7<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_81-7\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"7\">U.S. Department of Housing and Urban Development. <a href=\"http:\/\/www.hud.gov\/vawa\" target=\"_blank\" rel=\"noopener\">Violence Against Women Act (VAWA)<\/a><\/span> Every covered housing provider must maintain an emergency transfer plan. If you face an imminent threat of further violence, you can request an emergency transfer, and the provider must keep your new location confidential.<sup class=\"modern-footnotes-footnote \" data-mfn=\"8\" data-mfn-post-scope=\"00000000000001670000000000000000_81\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_81-8\">8<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_81-8\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"8\">eCFR. <a href=\"https:\/\/www.ecfr.gov\/current\/title-24\/subtitle-A\/part-5\/subpart-L\/section-5.2005\" target=\"_blank\" rel=\"noopener\">24 CFR 5.2005 &#8211; VAWA Protections<\/a><\/span> If no safe internal unit is available, the provider must help you look externally.<\/p>\n<h3>A Disability Accommodation the Landlord Won&#8217;t Make<\/h3>\n<p>The Fair Housing Act requires landlords to allow reasonable modifications at the tenant&#8217;s expense and to make reasonable accommodations in their rules and policies when a tenant with a disability needs them to use and enjoy the home.<sup class=\"modern-footnotes-footnote \" data-mfn=\"9\" data-mfn-post-scope=\"00000000000001670000000000000000_81\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_81-9\">9<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_81-9\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"9\">Office of the Law Revision Counsel. <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:42%20section:3604%20edition:prelim)\" target=\"_blank\" rel=\"noopener\">42 USC 3604 &#8211; Discrimination in the Sale or Rental of Housing and Other Prohibited Practices<\/a><\/span> If the landlord refuses, or if the unit simply can&#8217;t be adapted, you may have grounds to end the lease and move to an accessible unit with your voucher. Make the request in writing. If it&#8217;s denied, file a complaint with the PHA or with HUD&#8217;s Office of Fair Housing and Equal Opportunity.<\/p>\n<h3>Military Orders<\/h3>\n<p>The Servicemembers Civil Relief Act allows active-duty military members to terminate a residential lease after entering military service, receiving permanent change-of-station orders, or receiving deployment orders for 90 days or more. The termination also covers any obligations a dependent has under the same lease.<sup class=\"modern-footnotes-footnote \" data-mfn=\"10\" data-mfn-post-scope=\"00000000000001670000000000000000_81\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_81-10\">10<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_81-10\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"10\">Office of the Law Revision Counsel. <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:50%20section:3955%20edition:prelim)\" target=\"_blank\" rel=\"noopener\">50 USC 3955 &#8211; Termination of Residential or Motor Vehicle Leases<\/a><\/span><\/p>\n<p>Deliver written notice to the landlord with a copy of your orders. For a lease with monthly rent, the termination becomes effective 30 days after the next rent payment is due following delivery of the notice. The landlord cannot charge an early termination fee, and any lease clause trying to waive these protections is unenforceable.<sup class=\"modern-footnotes-footnote \" data-mfn=\"10\" data-mfn-post-scope=\"00000000000001670000000000000000_81\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_81-10\">10<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_81-10\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"10\">Office of the Law Revision Counsel. <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:50%20section:3955%20edition:prelim)\" target=\"_blank\" rel=\"noopener\">50 USC 3955 &#8211; Termination of Residential or Motor Vehicle Leases<\/a><\/span><\/p>\n<h2>What Proper Notice Looks Like<\/h2>\n<p>The notice, whether hand-delivered or mailed, should state clearly that you intend to leave, the date you plan to vacate, and the legal ground you&#8217;re relying on if you&#8217;re ending the lease early \u2014 VAWA, SCRA, HQS failure, disability accommodation refusal, or landlord breach. Send one copy to the landlord and one to the PHA. Confirm the notice period against your lease and, if you&#8217;re leaving for cause, against the shorter timelines the applicable federal protection may allow.<\/p>\n<p>Keep copies of everything: the notice itself, proof of delivery, photographs of the unit&#8217;s condition on the day you leave, and any documentation supporting the reason you&#8217;re leaving. If you&#8217;re terminating because of HQS failures, PHA inspection reports become the central evidence. If you&#8217;re leaving under VAWA, keep your self-certification form and any related communications. This file is what protects you if the landlord later disputes how you left or the PHA later questions whether you followed program rules.<\/p>\n<h2>What Keeps Your Voucher \u2014 and What Forfeits It<\/h2>\n<p>Follow the notice rules, use a legitimate reason, and the PHA will issue you a new voucher for your next unit. The picture changes if you leave improperly. The PHA must terminate assistance if you&#8217;re evicted for a serious lease violation, and it has discretion to terminate for any program violation, including failing to notify the PHA before moving, owing unpaid rent or damages to the landlord, or breaching a repayment agreement with the PHA.<sup class=\"modern-footnotes-footnote \" data-mfn=\"2\" data-mfn-post-scope=\"00000000000001670000000000000000_81\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_81-2\">2<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_81-2\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"2\">eCFR. <a href=\"https:\/\/www.ecfr.gov\/current\/title-24\/subtitle-B\/chapter-IX\/part-982\/subpart-L\/section-982.552\" target=\"_blank\" rel=\"noopener\">24 CFR 982.552 &#8211; PHA Denial or Termination of Assistance for Family<\/a><\/span><\/p>\n<p>Termination reaches beyond your current tenancy. PHAs can deny future applications from anyone who was evicted from federally assisted housing within the last five years, whose assistance was previously terminated, or who still owes money to any PHA.<sup class=\"modern-footnotes-footnote \" data-mfn=\"2\" data-mfn-post-scope=\"00000000000001670000000000000000_81\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_81-2\">2<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_81-2\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"2\">eCFR. <a href=\"https:\/\/www.ecfr.gov\/current\/title-24\/subtitle-B\/chapter-IX\/part-982\/subpart-L\/section-982.552\" target=\"_blank\" rel=\"noopener\">24 CFR 982.552 &#8211; PHA Denial or Termination of Assistance for Family<\/a><\/span> Given how long Section 8 waitlists run, losing a voucher can set you back years.<\/p>\n<h2>If the PHA Moves to Terminate Your Assistance, Ask for a Hearing<\/h2>\n<p>If the PHA decides to terminate your voucher, it must give you written notice of the reason, and you have the right to request an informal hearing before the termination takes effect.<sup class=\"modern-footnotes-footnote \" data-mfn=\"11\" data-mfn-post-scope=\"00000000000001670000000000000000_81\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_81-11\">11<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_81-11\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"11\">eCFR. <a href=\"https:\/\/www.ecfr.gov\/current\/title-24\/subtitle-B\/chapter-IX\/part-982\/subpart-L\/section-982.555\" target=\"_blank\" rel=\"noopener\">24 CFR 982.555 &#8211; Informal Hearing for Participant<\/a><\/span><\/p>\n<p>At the hearing you can review the PHA&#8217;s documents, present your own evidence, question witnesses, and bring a lawyer or other representative at your own expense. The hearing officer cannot be the person who made the original termination decision or that person&#8217;s subordinate, and the officer must issue a written decision based on the evidence.<sup class=\"modern-footnotes-footnote \" data-mfn=\"11\" data-mfn-post-scope=\"00000000000001670000000000000000_81\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_81-11\">11<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_81-11\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"11\">eCFR. <a href=\"https:\/\/www.ecfr.gov\/current\/title-24\/subtitle-B\/chapter-IX\/part-982\/subpart-L\/section-982.555\" target=\"_blank\" rel=\"noopener\">24 CFR 982.555 &#8211; Informal Hearing for Participant<\/a><\/span> If the PHA relied on inaccurate information, or if you can show mitigating circumstances, the officer can reverse the termination. Local legal aid organizations handle these hearings regularly. Request the hearing immediately when you get the notice; there&#8217;s a deadline, and missing it waives the right.<\/p>\n<h2>Moving Your Voucher to a New Area<\/h2>\n<p>If you&#8217;re moving outside your current PHA&#8217;s jurisdiction, portability is the mechanism. Your current PHA sends transfer paperwork to the receiving PHA, which issues you a voucher to search for housing in its area. If you applied from outside the PHA&#8217;s jurisdiction, you generally cannot port your voucher elsewhere for the first 12 months after admission. The initial PHA can make exceptions for things like employment needs, but they aren&#8217;t guaranteed. New applicants who port out do have to meet the receiving PHA&#8217;s income limits. The receiving PHA&#8217;s voucher must give you at least 30 calendar days beyond your initial PHA&#8217;s voucher expiration date to search. If you break the lease before it expires, the landlord may seek unpaid rent for the remaining term. Most states require landlords to make reasonable efforts to find a replacement tenant, but the obligation to mitigate varies by state, and until a new tenant moves in you may owe rent. The landlord may also withhold part or all of your security deposit for unpaid rent or damage beyond normal wear and tear. State laws set the caps and return timelines and give you a process to dispute deductions.<\/p>\n<p>The debt that most affects your voucher is money owed to the PHA.
