It works automatically for immediate relatives of U.S. citizens. It works for spouses and unmarried children of lawful permanent residents only when a visa number is available in their preference category on the month they file. Applicants abroad take the consular processing route instead.<\/p>\n<h2>Why the U.S. Citizen vs. Green Card Holder Distinction Matters<\/h2>\n<p>Federal law bars people who have fallen out of status from adjusting: unauthorized employment, being in unlawful status at the time of filing, and failing to maintain continuous lawful status are all disqualifying. A U.S. citizen&#8217;s spouse who overstayed a tourist visa or worked without permission can still file Form I-485 from inside the country. The same overstay would block an LPR&#8217;s spouse filing in a preference category. If your petitioner is a green card holder rather than a citizen, the standard adjustment bars apply to you in full.<\/p>\n<p>The exemption is not a wildcard. Criminal convictions, fraud, security concerns, and certain health-related grounds of inadmissibility can still block an immediate relative&#8217;s adjustment. What the exception covers is status violations and unauthorized work.<\/p>\n<h2>The Visa Bulletin Gate for Preference Cases<\/h2>\n<p>Preference-category applicants can only file concurrently when their priority date is earlier than the applicable cutoff date on the Visa Bulletin. The State Department publishes the bulletin monthly with two charts: Final Action Dates and Dates for Filing. Each month, USCIS announces which chart adjustment-of-status applicants should use.<sup class=\"modern-footnotes-footnote \" data-mfn=\"7\" data-mfn-post-scope=\"00000000000001670000000000000000_64\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_64-7\">7<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_64-7\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"7\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/visa-availability-priority-dates\/adjustment-of-status-filing-charts-from-the-visa-bulletin\" target=\"_blank\" rel=\"noopener\">Adjustment of Status Filing Charts from the Visa Bulletin<\/a><\/span><\/p>\n<p>When USCIS determines that more immigrant visas are available in a fiscal year than there are known applicants, it authorizes use of the more generous Dates for Filing chart, which usually lets people file earlier. Otherwise, applicants use Final Action Dates. If it isn&#8217;t current, concurrent filing isn&#8217;t available and the I-485 waits.<\/p>\n<h2>What Goes in the Package<\/h2>\n<h3>Form I-130 With Relationship Evidence<\/h3>\n<p>The petitioner (the U.S. citizen or LPR) files Form I-130 to establish the qualifying family relationship. For spouses, that means the marriage certificate plus proof the marriage is real: joint bank accounts, a shared lease, insurance policies naming each other, and photographs over time. A joint sponsor can file a separate I-864 if the petitioner&#8217;s income falls short.<\/p>\n<h2>Filing Fees<\/h2>\n<p>USCIS revised its fee schedule effective April 1, 2024. Under the current schedule, Form I-130 is $625 and Form I-485 is $1,440. If the application is rejected for a technical error like the wrong fee, a missing signature, or an incomplete form, that money is gone. EADs issued with a five-year validity before December 5, 2025, stay valid through their printed expiration date.<\/p>\n<p>For international travel while the I-485 is pending, you need an advance parole document. In marriage-based cases, both the petitioner and the applicant attend. The officer&#8217;s aim is to verify that the relationship is genuine, so the questions cover daily life: how the couple met, routines, families, and shared household details. Bring originals of every document submitted as a copy, and bring any evidence of shared life that has accumulated since filing, such as utility bills in both names and updated financial records.<\/p>\n<h2>Why Concurrent Filings Get Denied<\/h2>\n<p>The most common denial reason is failure to prove the relationship is genuine. Officers weigh the whole picture: how long the couple knew each other before marrying, the depth of financial and household evidence, and whether the two people&#8217;s accounts match at the interview. Certain criminal convictions and fraud create inadmissibility grounds that apply regardless of category.<\/p>\n<p>If the I-130 is ultimately denied, the I-485 falls with it, because there is no approved petition to support the adjustment.<\/p>\n<h2>Children Approaching 21<\/h2>\n<p>A child turning 21 before the case is decided can be reclassified from immediate relative or child into a lower preference category with a long backlog. The Child Status Protection Act provides a formula that can preserve child status: subtract the number of days the I-130 was pending from the child&#8217;s biological age on the date a visa number becomes available. If the resulting CSPA age is under 21, the beneficiary keeps child classification. The beneficiary must also seek to acquire permanent residence within one year of the visa becoming available, which generally means filing the I-485 promptly.<\/p>\n<p>For immediate relatives of U.S. citizens, aging out is less of a concern because there is no visa backlog and both forms can be filed at once. For LPR families in the preference categories, the CSPA calculation can decide whether a child immigrates with the family or waits in a separate queue.<\/p>\n<h2>After Filing<\/h2>\n<p>Federal law requires reporting any change of address to USCIS within 10 days of moving.<sup class=\"modern-footnotes-footnote \" data-mfn=\"18\" data-mfn-post-scope=\"00000000000001670000000000000000_64\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_64-18\">18<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_64-18\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"18\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/ar-11\" target=\"_blank\" rel=\"noopener\">AR-11, Aliens Change of Address Card<\/a><\/span> The USCIS online account processes the change almost immediately; the paper Form AR-11 does not automatically update address records in USCIS systems, creating a risk that interview notices or approval documents go to the wrong place.<sup class=\"modern-footnotes-footnote \" data-mfn=\"19\" data-mfn-post-scope=\"00000000000001670000000000000000_64\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_64-19\">19<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_64-19\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"19\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/addresschange\" target=\"_blank\" rel=\"noopener\">How to Change Your Address<\/a><\/span><\/p>\n<p>If USCIS needs more from you, expect a Request for Evidence identifying exactly what is missing, with a deadline. Failing to respond in time, or responding incompletely, can result in denial. Read the RFE carefully, gather precisely what is asked for, and submit the response well before the deadline. Before an outright denial, USCIS sometimes issues a Notice of Intent to Deny (NOID) instead, which identifies the deficiency and gives 30 days to respond. A NOID means the officer has decided to deny unless the response changes their mind, so treat it accordingly.<\/p>\n<p>While the case is pending, keep whatever immigration status you currently hold, if possible.
