The &#8220;C09&#8221; comes from eligibility category (c)(9) on Form I-765, the form you file to request the card. As of December 2025, a newly issued C09 EAD is valid for up to 18 months, the filing fee is $260 for most applicants, and \u2014 this is the change that matters most in 2026 \u2014 there is no longer any automatic extension of your work authorization while a renewal is pending.<\/p>\n<h2>Who Qualifies<\/h2>\n<p>The only core requirement is a properly filed, still-pending Form I-485.<sup class=\"modern-footnotes-footnote \" data-mfn=\"1\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-1\">1<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-1\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"1\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/employment-authorization\" target=\"_blank\" rel=\"noopener\">Employment Authorization<\/a><\/span> You can file Form I-765 at the same time as your I-485 or separately afterward, as long as you include a copy of the I-485 receipt notice showing the case is pending.<sup class=\"modern-footnotes-footnote \" data-mfn=\"2\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-2\">2<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-2\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"2\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/i-765\" target=\"_blank\" rel=\"noopener\">I-765, Application for Employment Authorization<\/a><\/span><\/p>\n<p>You also have to be admissible to the United States. Everyone else should talk to an immigration attorney before filing.<\/p>\n<h2>How to Apply<\/h2>\n<p>You apply by submitting Form I-765, Application for Employment Authorization. USCIS accepts it online or by mail. Online filing through a USCIS account at uscis.gov is generally faster and lets you upload supporting documents and pay through Pay.gov in one session.<sup class=\"modern-footnotes-footnote \" data-mfn=\"2\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-2\">2<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-2\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"2\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/i-765\" target=\"_blank\" rel=\"noopener\">I-765, Application for Employment Authorization<\/a><\/span><\/p>\n<p>Enter <strong>(c)(9)<\/strong> as your eligibility category in Part 2, Item Number 27. A wrong category code causes delays and denials.<\/p>\n<p>Documents to include:<\/p>\n<ul>\n<li>A copy of your I-485 receipt notice (Form I-797C) showing the adjustment case is pending.<\/li>\n<li>Two passport-style photos meeting USCIS specifications (paper filing only; online filers upload a digital photo).<\/li>\n<li>A copy of your passport, visa, or other government-issued identification.<\/li>\n<li>Copies of any prior EADs.<\/li>\n<\/ul>\n<p>Form I-765 also has a section where you can request a Social Security number and card at the same time. If your EAD is approved, USCIS sends the information to the Social Security Administration, and the card typically arrives within about seven business days of the EAD.<sup class=\"modern-footnotes-footnote \" data-mfn=\"5\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-5\">5<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-5\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"5\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/flyers\/EBE_Flyer_Apply_for_your_Social_Security_Number_While_Applying_for_Your.pdf\" target=\"_blank\" rel=\"noopener\">Apply for Your Social Security Number While Applying for Your Work Permit<\/a><\/span><\/p>\n<p>After USCIS receives your application, you&#8217;ll get a Form I-797C receipt notice with a case number you can use to check status online.<\/p>\n<h2>Fees and Fee Waivers<\/h2>\n<p>Because every C09 applicant by definition has a pending I-485, USCIS charges the reduced Form I-765 fee of $260, whether you file online or on paper. Biometrics costs are built in; there is no separate biometrics fee. If you filed and paid for your I-485 before April 1, 2024, you can generally renew your C09 EAD for free while the adjustment case remains pending.<sup class=\"modern-footnotes-footnote \" data-mfn=\"6\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-6\">6<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-6\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"6\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/archive\/frequently-asked-questions-on-the-uscis-fee-rule\" target=\"_blank\" rel=\"noopener\">Frequently Asked Questions on the USCIS Fee Rule<\/a><\/span><\/p>\n<p>Fee waivers are available to applicants who receive a means-tested government benefit, have household income at or below 150 percent of the Federal Poverty Guidelines, or face extreme financial hardship such as unexpected medical bills.<sup class=\"modern-footnotes-footnote \" data-mfn=\"7\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-7\">7<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-7\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"7\">eCFR. <a href=\"https:\/\/www.ecfr.gov\/current\/title-8\/chapter-I\/subchapter-B\/part-106\/section-106.3\" target=\"_blank\" rel=\"noopener\">8 CFR 106.3 &#8211; Fee Waivers and Exemptions<\/a><\/span> Request one by filing Form I-912, Request for Fee Waiver, with your I-765 and documentation of your finances.<\/p>\n<h2>Processing Times and Expedite Requests<\/h2>\n<p>USCIS does not publish a guaranteed timeline for C09 applications. Wait times move with the workload at each service center. The current estimate for your case is available through the USCIS processing times tool at egov.uscis.gov, filtered to Form I-765, category (c)(9).<sup class=\"modern-footnotes-footnote \" data-mfn=\"8\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-8\">8<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-8\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"8\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/egov.uscis.gov\/processing-times\/\" target=\"_blank\" rel=\"noopener\">Processing Times &#8211; Case Status Online<\/a><\/span><\/p>\n<p>A clean application avoids Requests for Evidence, which can add weeks or months. If USCIS schedules a biometrics appointment, go. Missing it stalls the case.<\/p>\n<p>Expedite requests require more than a need to work. USCIS looks for severe financial loss, an emergency, or other compelling circumstances \u2014 for example, that the delay will cost you your job, force your employer to lay off other workers, or cut off critical benefits.<sup class=\"modern-footnotes-footnote \" data-mfn=\"9\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-9\">9<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-9\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"9\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-1-part-a-chapter-5\" target=\"_blank\" rel=\"noopener\">USCIS Policy Manual, Volume 1, Part A, Chapter 5 &#8211; Expedite Requests<\/a><\/span> USCIS will also decline the request if the urgency was caused by your own late filing.<\/p>\n<h2>How Long a C09 Permit Lasts<\/h2>\n<p>On December 5, 2025, USCIS reduced the maximum validity period for newly issued C09 EADs from five years to 18 months.<sup class=\"modern-footnotes-footnote \" data-mfn=\"10\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-10\">10<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-10\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"10\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/save\/current-user-agencies\/news-alerts\/reduced-validity-periods-for-newly-issued-employment-authorization-documents\" target=\"_blank\" rel=\"noopener\">Reduced Validity Periods for Newly Issued Employment Authorization Documents<\/a><\/span> Cards issued before that date remain valid through the expiration printed on them. Any C09 EAD issued now, including a renewal, carries the shorter window, so most applicants will renew more often while the I-485 is pending.<\/p>\n<h3>When to File a Renewal<\/h3>\n<p>File the renewal no earlier than 180 days (six months) before your current EAD expires, and no later than 90 days before expiration.<sup class=\"modern-footnotes-footnote \" data-mfn=\"2\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-2\">2<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-2\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"2\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/i-765\" target=\"_blank\" rel=\"noopener\">I-765, Application for Employment Authorization<\/a><\/span> That three-month window is where you want to be. Aim for the early end of it.<\/p>\n<h3>No More Automatic Extension<\/h3>\n<p>This is the single biggest change facing C09 applicants in 2026. Before, a timely-filed EAD renewal automatically extended your work authorization for up to 540 days while USCIS processed the case. That automatic extension ended on October 30, 2025.<sup class=\"modern-footnotes-footnote \" data-mfn=\"11\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-11\">11<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-11\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"11\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/newsroom\/news-releases\/dhs-ends-automatic-extension-of-employment-authorization\" target=\"_blank\" rel=\"noopener\">DHS Ends Automatic Extension of Employment Authorization<\/a><\/span> If you file your renewal on or after that date, your current EAD expires on the date printed on the card. There is no grace period and no bridge authorization while you wait.<\/p>\n<p>The practical result is stark. If USCIS takes months to process your renewal and your existing EAD expires in the gap, you cannot legally work, and your employer must remove you from the payroll until the new card arrives. Filing early within the 180-day window is now much more urgent than it used to be. If your renewal is already pending and your EAD is nearly out, an expedite request based on imminent job loss may be your only real lever.<\/p>\n<p>Applicants who filed a renewal before October 30, 2025 and are still waiting may still benefit from the 540-day extension.<sup class=\"modern-footnotes-footnote \" data-mfn=\"12\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-12\">12<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-12\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"12\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/i-9-central\/form-i-9-resources\/handbook-for-employers-m-274\/50-automatic-extensions-of-employment-authorization-andor-employment-authorization-documents-eads-in\/51-automatic-extensions-based-on-a-timely-filed-application-to-renew-employment-authorization\" target=\"_blank\" rel=\"noopener\">Automatic Extensions Based on a Timely Filed Application to Renew Employment Authorization<\/a><\/span> To prove it to an employer, show the expired EAD together with the I-797C receipt notice. The eligibility category on both documents has to match.<\/p>\n<h3>Lost, Stolen, or Damaged Cards<\/h3>\n<p>To replace a lost, stolen, or defective EAD, file a new Form I-765 with documentation of the problem, such as a police report for a stolen card. The $260 fee applies unless you qualify for a waiver.<\/p>\n<h2>The C09 Does Not Authorize Travel<\/h2>\n<p>A C09 work permit is not a travel document. If you leave the United States while your I-485 is pending without first getting advance parole, USCIS will generally treat your adjustment case as abandoned, and you may not be allowed back in.<sup class=\"modern-footnotes-footnote \" data-mfn=\"13\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-13\">13<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-13\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"13\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/travel-documents\" target=\"_blank\" rel=\"noopener\">Travel Documents<\/a><\/span> A narrow exception exists for applicants who hold certain valid nonimmigrant visas such as H-1B or L-1. Most C09 applicants should not risk international travel without advance parole, which is requested on Form I-131, Application for Travel Documents. Many applicants file I-131 alongside I-765 and I-485 to receive a combined document.<sup class=\"modern-footnotes-footnote \" data-mfn=\"14\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-14\">14<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-14\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"14\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/forms\/all-forms\/filing-form-i-765-with-other-forms\" target=\"_blank\" rel=\"noopener\">Filing Form I-765 with Other Forms<\/a><\/span><\/p>\n<h2>Using the EAD at Work<\/h2>\n<p>The C09 EAD (Form I-766) is a List A document for Form I-9 purposes. It establishes both identity and work authorization on its own, so your employer cannot demand additional documents.<sup class=\"modern-footnotes-footnote \" data-mfn=\"15\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-15\">15<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-15\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"15\">U.S. Citizenship and Immigration Services. <a href=\"https:\/\/www.uscis.gov\/i-9-central\/form-i-9-acceptable-documents\" target=\"_blank\" rel=\"noopener\">Form I-9 Acceptable Documents<\/a><\/span><\/p>\n<p>There is also a protective rule worth understanding. Federal regulations provide that while your I-485 is pending, you are not considered an &#8220;unauthorized alien&#8221; for purposes of the INA 245(c)(8) employment bar, as long as you have a valid EAD or had employment authorization that hasn&#8217;t expired during the pendency of your case.<sup class=\"modern-footnotes-footnote \" data-mfn=\"16\" data-mfn-post-scope=\"00000000000001670000000000000000_60\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_60-16\">16<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_60-16\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"16\">eCFR. <a href=\"https:\/\/www.ecfr.gov\/current\/title-8\/chapter-I\/subchapter-B\/part-274a\" target=\"_blank\" rel=\"noopener\">8 CFR Part 274a &#8211; Control of Employment of Aliens<\/a><\/span> Working legally on your C09 will not sink your green card case. Working after the card expires without a renewal in place will.<\/p>\n<h2>Common Reasons for Denial<\/h2>\n<p>Most C09 denials fall into a handful of predictable categories:<\/p>\n<ul>\n<li>No pending I-485. The C09 depends entirely on an active adjustment case. Some problems can be cured by refiling. Others, especially inadmissibility grounds, may require a waiver or legal representation.<\/p>\n<h2>If Your I-485 Is Denied<\/h2>\n<p>Your C09 exists only because your I-485 is pending.
